March 20, 1972
Pursuant to due call and notice thereof, a regular meeting of the Council of
the Village of Golden Valley, Hennepin County, Minnesota, was held at 7800
Golden Valley Road in said Village on March 20, 1972, at 7:30 o'clock P. M.
The following members were present: Hoover, Paulson, Riggs, Stockman, and
Ulstad; and the following were absent: None.
Present were Assistant Village Manager, John Murphy; Village Attorney, Robert
M. Skare; Village Engineer, Lowell Odland; Village Cler, Helen Penniman;
Director of Public Safety, David Gorski; Superintendent of Building & Zoning,
Jon Westlake.
Minutes of March 6. 1972:
MOVED by Paulson seconded by Stockman carried to approve the minutes of March
6, 1972, as submitted.
Certificate Award - Ronald Christenson:
The Mayor presented a Certificate to Ronald Christenson, Engineering Aide II
for completion of the American Public Works Association training course for
Public Works Inspectors.
Public Hearing - Second Reading Ordinance, "Gun Control":
The Mayor limited questions to Golden Valley residents who had not been heard
on the proposed ordinance for "Gun Control".
Mr. James Rleba, 29 Western Terrace, in favor of the gun ordinance, the police
are in danger from mentally irresponsible and others.
Allen Greenberg, Attorney for Golden Valley Sports Center, stated three days
waiting period too burdensome and not workable, doesn't give guidelines to
his client, totally ineffective and economically damaging, need similar wait-
ing period as "Ban the Can" before enforcement i.e., surrounding communities
or statewide adoption.
Steven Horowitz, Golden Valley Sports Center, asked how the ordinance would
effect black powder weapons andastiques, three day waiting period not workable.
Donald L. Carlson, General Manager Committee for Hunters, stated the cost has
has been determined but not published, the ordinance is fraudlent, the proced-
ings are illegal, in violation of presumed innocence. The Attorney General
appeared against the rulings of the courts in Minnesota, political science
professors of the University of Minnesota involved in gun control ordinances.
Mr. Carlson requested that the ordinance be tabled.
Mrs. Melemed, Golden Valley Sports Center, stated three day wait not needed.

The Mayor stated the proposed ordinance had been thoroughly discussed at
three public hearings and closed the public hearing.
The Village Attorney reviewed minor revisions, and deleted 525:01 Section 1
from the ordinance.
MOVED by Stockman seconded by Hoover carried that the proposed amendments be
adopted, and give a second reading to an ordinance entitled:
"AN ORDINANCE AMENDING THE VILLAGE CODE"
(Sale, Possession and Discharge of Firearms,
Fireworks and Other Weapons)
MOVED by Ulstad seconded by Paulson carried unanimously to approve the ord-
inance herein quoted by title on its second reading and to order publication
thereof. See Ordinance Book page_.
Public Hearing - Rezoning, Fred Seed Property to PUD -5:
The Village Clerk presented an affidavit showing publication in the official
newspaper of the Notice of Public Hearing on certain proposed rezoning des-
cribed in said affidavit. Said affidavit was examined, approved and ordered
filed in the Clerk's office.
The Mayor then announced that the meeting was open for public hearing on said
proposed zoning, and all persons present to do so were afforded opportunity
to express their views thereon.
Mr. Warren Lundsgaard, Chairman of the Planning Commission, presented the
Planning Commission recommendation in favor of the proposed PUD -5. Mr. Lund-
sgaard reviewed the procedure of PUD zoning for the benefit -of the audience.
Mr. Joe Kelsop,5&-}Quebec Avenue South, requested rezoning to Residential for
the property be considered before PUD -5.
MOVED by Paulson seconded by Ulstad carried to consider request for zoning
to Residential before the request for PUD -5.

cribed in said affidavit. Said affidavit was examined, approved and ordered

proposed zoning, and all persons present to do so were afforded opportunity
to express their views thereon.

Reviewed their plans for PUD -5 showed
slides of various townhouses and multi-
ple dwellings. They proposed buildings
on 24% of the 30 acres with open space

Questioned buying a townhouse as
opposed to renting in the $50,000

Concerned over traffic from townhouses

Grouping of houses would look strange

Is dismayed that no plan is shown
for the traffic for 80 units on 15 acres.
How would costs of municipal services
compare to tax returns on the property.

The density is high for 15 acres.
Questioned the amount of taxes from
$50,000 units and $25,000 units.
Proponents not well prepared with answers.
Has a study been made by the Planning
Commission or Council of the possibilities
for single family dwwllings in the area.
Lives on lowest land in the area, is
there provision for drainage of the storm
water.

Dick Ulrick - Termination of Emplovment:
Mr. Ulrick appeared to request the 202 of unused sick leave benefit for an
employee leaving village employment.
The Village Attorney pointed out that Mr. Ulrick did not have five years of
continuous service with the village.
MOVED by Stockman seconded by Hoover carried to deny the request for 20% of
unused sick leave benefits.
Request for Waiver of Platting Ordinance - 710 Mendelssohn Avenue North:
The request is for waiver of Platting Ordinance at 710 Mendelssohn Avenue
North for division of the following property:
"Commencing at a point in West line of Northwest 1/4 distant

MOVED by Ulstad seconded by Stockman carried to approve the Waiver of Plat-
ting Ordinance for the above referenced property.
Liquor License Issuance - Clubs. Village Attorney:
The Village Attorney summarized his opinion on public liquor licenses issued
to clubs and recommended a Council policy on issuance be established until
the United States Supreme Court hears the subject.
Council requested an additional report from the Village Attorney regarding
issuance of a club on -sale liquor license to clubs that discriminate on the
basis of color or race within thirty days.
Human Rights Commission re: Housing Institute:
Mr. Gene Sylvestre, consultant to Human Rights Commission, proposed plans
for a Housing Institute in Golden Valley or an educational workshop on:
1. Developing housing for low and moderate income families.
2. Managing non-profit housing.
3. Case histories of successful projects.
MOVED by Stockman seconded by Hoover carried that the Council directs the
Human Rights Commission to hold a housing institute and requests that a
member of the Planning Commission, Environmental Commission, Park & Recrea-
tion Commission, Building Board of Review and Board of Zoning Appeals and
any other interested commission cooperate in this effort.
Re: Letter on Hair and Sex Discrimination - Human Rights Commission:
Mr. Gerald Jackson, Chairman Human Rights Commission, presented a request
to mail a letter to Golden Valley Employers on discrimination regarding the
length of hair and sex discrimination.
After discussion no action was taken.
Resignation. Planning Commission - Dean Moran:
MOVED by Stockman seconded by Ulstad carried to accept the resignation of
Dean Moran from the Planning Commission.
Declination of Appointment:
MOVED by Ulstad seconded by Paulson carried to accept the declination of
Marcella Ingvoldstad from the Human Rights Commission and Prank G. Comers
from the Golden Valley Safety Council and remove their names from the res-
pective commissions.

Village Attorney - re: Sweeney Lake Case:
The Village Attorney reported that the Supreme Court of Minnesota has dis-
missed the appeal by the Sweeney Lake Association.
Park & Recreation Commission - Fees at Brookview Golf Club:
The Director of the Park & Recreation Commission reported that the commiss-
ion recommended to continue the fee schedule at the 1971 level.
MOVED by Stockman seconded by Ulstad carried to approve retaining the fee
schedule for 1971 as recommended by the Park & Recreation Commission.
Request by Golden Valley Women's Club - Recycling Glass:
The Golden Valley Women's Club requested the village to place two warming
houses under the water tower for collection of glass for recycling.
MOVED by Stockman seconded by Hoover carried to provide two warming houses
for glass collection for recycling and to research other provisions for a
collection center.
Appointments - Planning Commission:
MOVED by Ulstad seconded by Stockman carried to reappoint Lowell Swanson
and Donald Franzen until October, 1972, and their replacement appointments
to serve without vote until October, 1972.
