VILLAGE COUNCIL
February 20, 1973
Pursuant to due call and notice thereof, a regular meeting of the Council of
the Village of Golden Valley, Hennepin County, Minnesota, was held at 7800
Golden Valley Road in said Village on February 20, 1973, at 7:30 o'clock P.M.
The following members were present: Bix, Moberg, and Riggs; and the follow-
ing were absent: Hoover and Ulstad.
Present were Village Manager, Barkley G. Omans; Village Attorney, Robert M.
Skare; Village Engineer, Lowell Odland; Village Clerk, Helen Penniman;
Deputy Assessor, James Ingemunson.
Minutes of February 5, 1973:
MOVED by Bix seconded by Moberg carried to approve the minutes of February
5, 1973, as submitted.
Appeal from BZA - W. W. Grainger Company, Inc., 2360 Nevada Avenue North:
Mr. Mahlon Swedberg, member of the Board of Zoning Appeals, presented the
recommendation of the board, primarily the size of the addition was unaccept-
able.
Mr. James A. Dueholm, presented a new proposed site plan and building plan.
Mr. Robert Bishop representing W. W. Grainger Company was also present.
MOVED by Bix seconded by Moberg carried to refer the new plans to the Board
of Zoning Appeals.
Appeal from BZA - Condor Corporation, G. V. Industrial Park, 7th Ave. North:
Mr. Mahlon Swedberg, member of the Board of Zoning Appeals, presented the
findings of the Board of Zoning Appeals, the parking waiver was of primary
concern.
Mr. Jim Smuda, Executive Vice -President of Condor Corporation, presented the
appeal of parking spaces and treatment of green area.
MOVED by Bix seconded by Moberg carried to deny the request for waiver of
parking spaces in agreement with the Board of Zoning Appeals. Moberg voted
"NO".
The proponent requested the Council to refer the parking requirements in
a commercial area to the Planning Commission for recommendation.
MOVED by Bix seconded by Riggs carried to reconsider the motion to deny the
appeal.

MOVED by Bix seconded by Moberg carried to continue the appeal hearing
from the Board of Zoning Appeals after the Planning Commission recommendation
on parking requirements in a Commercial zone with with respect to this develop-
ment.
State Highway Department - re: T. H. #12 Pedestrian Foot Bridge:
The Village Manager reviewed a letter dated February 6, 1973, from the
State Highway Department regarding the stateformulae for construction of
Pedestrian Foot Bridges.
Mrs. Jody Sehlin, 4525 Douglas Avenue suggested the Highway Department would
finance 100% of the proposed foot bridge if the Tyrol Trail cut -across were
closed to traffic.
Council discussed the need of assurance from Prudential Insurance Company
for the continued use of the road thru Prudential to South Tyrol Hills area.
MOVED by Bix seconded by Moberg carried, resolved that the Village Manager
reply to the Highway Department District Engineer's letter of February 6,
1973, on the Pedestrian Foot Bridge (73 -SI -4) urging early preparation of
plans for 1973 construction.
Resolved further that the Village will purchase any necessary right-of-way
although none is expected to be necessary.
Resolved further that the Village will agree to maintain the completed
structure.
Resolved further that the Village is willing to work out a cost participa-
tion plan based on the fact that the State is largely responsible for the
changes that have caused the need for the separation, however the Council
does not have enough information and is not ready to commit itself on this
date to a specific cost figure.
I-394, David Brown:
Mr. Curtis Green, Village representative on the Citizens Advisory Committee,
reported on the public meeting at Prudential Insurance Company on February
7, 1973. Mr. David Brown discussed policy points with the Council for prep-
aration for the proposed meeting on February 27, 1973.
Member Bix introduced the following resolution and MOVED its adoption:

The motion for the adoption of the foregoing resolution was duly seconded by
Member Moberg, and upon vote being taken thereon, the following voted in
favor thereof: Bix, Moberg, Riggs, and the following voted against the same:
None, whereupon said resolution was declared duly passed and adopted, signed

Alternative Estimate - 69 -SS -1:
The Village Engineer presented a topography map of the proposed settling
pond and estimated cost of construction.
Mr. Richard Gunn, Attorney for Sweeney Lake Association, stated the associa-
tion looks favorably on the proposed alternative plan for the settling pond.
MOVED by Bix seconded by Moberg carried to enter into negotiation with the
Sweeney Lake Association and obtain the releases required.
Hennepin County League of Municipalities:
Notice of items on the Hennepin County League of Municipalities agenda. No
action required.
MOVED by Moberg seconded by Bix carried to receive and file the League Agenda.
Town Taxi - re: Fare Increase:
Town Taxi informed Council that revisions of taxi rates are under considera-
tion and negotiations between the union and the City of Minneapolis to achieve
rate increases.
MOVED by Moberg seconded by Bix carried to receive and file the notice of pro-
posed rate changes.

The Village Manager reviewed proposed deferred compensation for village employees.
MOVED by Moberg seconded by Bix carried to authorize the Village Manager to
prepare the necessary resolutions and agreements for deferred compensation.
Bulletin Information:
The Village Manager presented a resume of costs for Village Bulletin publi-
cation and mailing.

MOVED by Bix seconded by Moberg carried to receive and file bulletin in-
formation.
Property Assessment Contract:
MOVED by Bix seconded by Moberg carried to table the property assessment
until March 5, 1973.
Reserve Capacity Charge Report:
The Reserve Capacity Charge Report for the month of January, 1973, was
submitted.
MOVED by Moberg seconded by Bix carried to send the report for January, 1973
to the Metropolitan Sewer Board and withhold the payment pending the outcome
of the current court case.
Water Meter Contract Option:
The Village Manager reported on the Badger Meter Contract.
MOVED by Bix seconded by Riggs carried to exercise the option in the 1972
contract for additional meters, and extend the contract to December 31, 1973
at the same bid price.
State Department of Administration - Jagodzinski Appeal:
The Village Manager presented the findings of the State Department of Admin-
istration in the Jagodzinski appeal i.e., that the Village of Golden Valley
Ordinance 4405:03 is not in conflict with the state building code and is not
superseded thereby.
MOVED by Bix seconded by Moberg carried to receive the Facts from the State
Department of Administration and file.
January Budget Report:
MOVED by Bix seconded by Moberg carried to receive and file the January budget
report.
Jane Wallace - Resignation From Human Rights Commission:
All present agreed to add the above item to the agenda.
MOVED by Moberg seconded by Bix carried to receive and file the resignation
of Jane Wallace from the Human Rights Commission.
Bassett Creek Cleaning - T.H. 44100, Natural Area:
The Village Engineer reported that the Department of Natural Resources has
not replied to the village application to clean Bassett Creek at the Natural
area on T. H. 4100.

ments without indicating which ones.
