03-15-76 City Council MinutesREGULAR MEETING of the CITY COUNCIL March 15, 1976 Pursuant to due call and notice thereof, a regular meeting of the Council of the City of Golden Valley, Hennepin County, Minnesota was held at 7800 Golden Valley Road in said City on March 15, 1976 at 6:30 p.m. The following members were present: Anderson, Johnson, Thorsen and Swartz. Also present were City Manager Barkley G. Omans, City Attorney Robert M. Skare, Assistant Engineer Thomas Snetsinger and City Clerk Mary H. Marske. Approval of Minutes of_March 1 1976: MOVED by Thorsen, seconded by Johnson and carried to approve the minutes of March 1, 1976 as submitted. Approval of Minutes of March 81976: MOVED by Swartz, seconded by Johnson and carried to approve the minutes of March 8, 1976 as corrected. Approval_of Bills MOVED by Thorsen, seconded by Swartz and carried to approve the payment of the verified accounts submitted on the prelist. Approval of Licenses MOVED by Johnson, seconded by Thorsen and carried to approve the issuance of licenses as submitted by the City Clerk. Councilmember Thorsen abstained from voting on the licenses for Minnesota Toro and Big B's Pizza. Safety Council Chairman-- Re: Stop Sign at Mendelssohn and N� ager The newly elected chairman of the Safety Council, Mr. Richard Bloom and Mr. George Murad were present to submit the request of the Safety Council for a stop sign at Mendelssohn and Naper. MOVED by Swartz, seconded by Thorsen and carried to deny the request as sub- mitted. The Council then considered the traffic problem at Western Avenue and Jersey. MOVED by Thorsen, seconded by Swartz and carried to deny the request for a pedestrian crossing at the intersection of Western and Jersey and request the staff to make a recommendation of more permanent nature for that inter- section. Southeast FLre Station Site Committee Minutes - February 17_._19Z6 MOVED by Swartz, seconded by Johnson and carried to receive and file the Regular Meeting of the City Council, March 15, 1976 South east Fire Station continued minutes of the Southeast Fire Station Site Committee of February 17, 1976 and request the Mayor to direct a letter to explain that the staffing of the new fire station with salaried personnel is unfeasible economically. Transportation Options Committee Minutes - February 112 _1976 MOVED by Johnson, seconded by Thorsen and carried to receive and file the minutes of the Transportation Options Committee of February 12, 1976. MOVED by Swartz, seconded by Johnson and carried to dissolve this committee and request a letter of appreciation be directed to the members of the Transportation Options Committee and inquire if any of those members have any desire to serve on any other boards or commissions and if so, to noti- fy the City Clerk of their desire. Suburban Hennepin Count Municinal Orga.ni.zation -- James Krautkremer MOVED by Johnson, seconded by Thorsen and carried to request the Manager to direct a letter to Mayor Krautkremer indicating the Council's willing- ness to work with the Association of Metropolitan Municipalities to con- duct an unbiased study regarding shared tax aids. Councilmember Thorsen will contact the League of Minnesota Municipalities regarding the same matter. Opsal representing Golden Valley Lutheran College was present to request permission to move a building from Burnsville and locate it on the east end of the college campus. Mr. Opsal stated this would be the last temporary building to be used by the college. MOVED by Johnson, seconded by Swartz and carried to grant the request to move the building to the campus grounds to be located as specified on the plan submitted to the Council, with the stipulation that the Council will review the placement of the building in three years. Flood Plain Ordinance_ Amendments The City Attorney and Staff member Jon Westlake briefly summarized the pro- posed changes in the Flood Plain Ordinance. MOVED by Swartz, seconded by Johnson and carried to submit the proposed ord- inance with the attachment of the attorney's memo to the Department of Nat- ural Resources for comment and authorize the staff to meet with the Depart- ment of Natural Resources to request approval before a public hearing is set on the ordinance reading. 1976 Real Estate Assessment Report City Assessor, Mr. James Ingmunson, was present to present the 1976 Real Estate Report. The Council discussed the alternatives of sitting as the Board of Review or appointing a citizen's committee to function in that position. It was determined that the Council would assume the responsibil" ity as Board of Review and set May 10, 1976 at 7:30 p.m., as a meeting date with the assessor to become better acquainted with appraising and assessing techniques. Lilac Festiyaj Repgi The Council reviewed the letter of request from Mr. Rolf Nelson, chairman of the 1976 Lilac Festival. Regular Meeting of the City Council, March 15, 1976 MOVED by Swartz, seconded by Thorsen and carried to make available to the Golden Valley Festival Committee the Brookview facilities for the 1976 Lilac Festival, including use of the golf course, rent free for either Saturday June 5 or until noon of June 5 & 6 at the option of the Golden Valley Festival Committee. MOVED by Johnson, seconded by Thorsen and carried to grant the Golden Valley Lilac Festival Committee permission to locate and remove signs as requested in the letter of March 8, 1976. MOVED by Swartz, seconded by Thorsen and carried to allow use of the public address system by the Golden Valley Festival Corporation in the manner so as not to cause undue complaints by neighborhood residents. MOVED by Johnson, seconded by Swartz and carried to issue a temporary food and non -intoxicating beer license at an exempt fee subject to the filing of the necessary bond and license application with the City Clerk. Public Works Sites The Council reviewed the memo from the City Manager regarding Public Works Site. MOVED by Johnson, seconded by Thorsen and carried to request the Planning Commission to make a recommendation on the zoning considerations in regard to zoning site #4 at Boone and Plymouth on the southeast corner. MOVED by Thorsen, seconded by Johnson and carried to request the Manager to inform the Park & Recreation Commission, Open Space and Trails Committee and the Environmental Commission that the Council has asked the Planning Commission for comments on rezoning and any comments these boards and com- missions might have should be directed to the Planning Commission to be submitted to the Council.as a total report. Hennepin County Fire�TraininQ Center - Joint Powers Agreement Amendment MOVED by Swartz, seconded by Johnson and carried to authorize the Mayor and Manager to enter into an agreement to amend the Fire Training Center Agree- ment with School District 287 and surrounding municipalities. CI.T.A. Agreement and Contract with Hennepin Count MOVED by Johnson, seconded by Thorsen and carried to authorize the Mayor and Manager to enter into an agreement with Hennepin County regarding the Comprehensive Employment and Training Act for 1976. Recording Agreement for Sewer Connection Extension - Emma Nelson The City Manager and Attorney informed the Council of the complicated pro- cedure of recording an agreement for a sewer connection with a land title. MOVED by Swartz, seconded by Thorsen and carried to direct the City Manager Regular Meeting of the City Council, March 15, 1976 to inform Mrs. Nelson that the Council will require that an agreement with a plumber be made before February 1, 1977 for the installation of the sew- er connection which shall be'completed by June 30, 1977. Disclosure - Manager and Attorney - Re: Possible Conflict of Interest_ -_ P.U.D. #17 MOVED by Swartz, seconded by Thorsen and carried to receive and file the dis- closure letter received by the City Manager. dated March 5, 1976, and note that -the disclosure does not constitute a sufficient conflict of interest that would disable the Manager fr(m presenting background information on P.U.D. #17, but that the Council shall make a disclosure announcement at public hear- ings held in connection with P.U.D. X617. MOVED by Johnson, seconded by Thorsen and carried that in recognition of the City Attorney's statement of conflict of interest received March 11, 1976 does in fact represent a conflict of interest and direct the City Manager to seek outside counsel from the firm of LeFevere and Lefler regarding P.U.D. #17. 1976 Agreement - Local #4�9 MOVED by Johnson, seconded by Swartz and carried to authorize the Manager to sign the agreement with Local X649 as submitted to the Council. February Budget Report MOVED by Thorsen, seconded by Johnson and carried to receive and file the February Budget Report as submitted. Brookview Carpet Insurance Settlement The City Council reviewed a memo from John Brenna, Director of the Park & Recreation Department in regard to damage to carpeting at Brookview. MOVED by Johnson, seconded by Thorsen and carried to accept the insurance settlement as proposed and appropriate $1,293.00 from the Enterprise Fund as recommended by the City Manager.
