09-06-77 City Council MinutesRegular Meeting of the City Council September 6, 1977 Pursuant to due call and notice thereof, a regular meeting of the Council of the City of Golden Valley, Hennepin County, Minnesota, was held at 7800 Golden Valley Road in said City on September 6, 1977 at 6:30 p.m. The following members were present: Anderson, Hoover, Johnson, Swartz and Thorsen. Also present were: City Manager, Barkley G. Omans, City Engineer, Lowell Odland, City Attorney, Robert Skare and Council Secretary Kathy Middleton. Approval of Minutes of August 15, 1977 MOVED by Thorsen, seconded by Johnson and carried to approve the minutes of August 15, 1977 as amended: page 130 Delete Metro Council Representative item as this was a non -action topic. Felt they should open it up for public use. MOVED by Johnson, seconded by Swartz and carried to defer and direct our Attorney to meet with the Elks Lodges Attorney to discuss the parameters under which they could operate. Minutes of N.E.F.S. MOVED by Anderson, seconded by Johnson and carried to recommend that Councilmember Swartz take the material that has been presented by the Ethics Committee and put it in a form that would be effective for candidates. MOVED by Johnson, seconded by Anderson and carried to send a letter of thanks to the members of the Ethics Committee and the Chairperson for their report. MOVED by Swartz, seconded.by Johnson and carried to receive and file the report of the Campaign Ethics Committee Meetings. David Peters Letter Re: Resignation from Environmental Commission MOVED.by Thorsen, seconded by Johnson and carried to receive and file the letter of resignation and send a letter of thanks. Golden Valley Historical Society Re: Re -naming Culver Road. MOVED by Johnson, seconded by Thorsen and carried to receive and file the letter from.the Historical Society. John Gearty, Treasurer of the Historical Society was present and gave the history of the Gearty family in Golden Valley. MOVED by Anderson, seconded by Johnson and carried to refer this request to the Planning Commission with our recommendation that they hold an informal public hearing after Mr. John Gearty sends his letter to all residents of Culver Road. Bid Opening - September 1, 1977 - Bitum1nous Walkway- Plymouth - Orkla City Manager presented the bids as publicly opened on September 1, 1977 at 11:00 a.m. and recommends award to Bitumnious Roadways, Inc. MOVED by Anderson, seconded by Swartz and carried to award the construction of bituminous walkways to Bituminous Roadways, Inc. in the amount of $15,476.50. Bid Opening - September 1, 1977 - 77 -SI -12 Orkla and 25th City Manager made a recommendation of denial of all bids as he feels they can do better in the Spring of 1978. MOVED by Swartz, seconded by Anderson and carried to reject the bids and hold over until next Spring.and also to notify the lead petitioner. Personal Cars & Transportation City Manager stated two points that should be added to the existing policy. 1. Golden Valley places no restrictions on employee residence other than it must be within a reasonable distance to not interfere with their work duty performance; therefore, each employee is responsible for providing transportation from home to the job, as their duties may require. Regular Meeting of the City Council - September 6, 1977 Personal Cars .& Transportation (con't) 2. No employee shall be assigned a personal car for his exclusive use. Rather, vehicles shall be for City transportation needs, except as the Council may specifically provide. MOVED by Swartz, seconded by Johnson and carried to have the City Manager take the request that the recommended policy be revised and be presented to the Council again for some action. Assessing Options Jeff Sweet, Assistant City Manager, gave background information. MOVED.by Anderson, seconded by Swartz and carried to authorize the Mayor and City Manager to enter into the Agreement with Hennepin County providing assessing services for 1978 taxes payable in 1979• MOVED by Anderson, seconded by Thorsen to direct the Assistant City Manager to draft and negotiate a longer term agreement with the County Board and report back to the Council. Affirmative Action Program Policy Davide Simmons, Affirmative Action Director, was present to answer questions regarding Policy. MOVED by Thorsen, seconded by Johnson and carried to adopt the policy as recommended with one change on page 7 item 5 change committee to Advisory Board. Agreement for realignment and construction of Xerxes Ave. North. MOVED by Johnson, seconded by Thorsen and carried to authorize the Mayor and City Manager to enter into an agreement with the City of Minneapolis. Phieffer & Schultz - Energy Efficiency Report. Bob Layman representative from Phieffer & Schultz Company gave a short presentation, Stated study concerns itself with the consumption or reduction of energy consumed by the Golden Valley Village Hall as well as providing recommendations for improving the present heating and air distribution system. MOVED by Thorsen and seconded by Swartz and carried to receive and file report and consider it at one of our Budget Work Sessions. Family Life Workshop - Ron Haskavitz, Chairman of Human Rights Commission Ron Haskavitz stated this would be a one day work shop on November 5, 1977 from 1 p.m. to 3 p.m. Price would be $2.50 per person which would include lunch. Golden Valley, Crystal and Robbinsdale Human Rights Commissions and I.D.S. #281 Community Education Department. Total Cost is $860.00 Cost to Golden Valley is $215.00. MOVED by Anderson, seconded by Johnson and carried to approve the Golden Valley Human Rights Proposed Community Education Workshop and to authorize the cost from the 1977 budget. 1 1 Regular Meeting of City Council - September 6, 1977 Human Rights.Commission request for Agreement with State Human Rights Commission Ron Haskvitz, Chairman, stated the Human Rights Commission had not reviewed the memorandum of agreement. MOVED by Anderson, seconded by Johnson and carried to defer action on this until the Human Rights Commission can take further action. 1978 Budget MOVED by Anderson, seconded by Swartz and carried to set budget hearing at 7:30 p.m. on Monday, September 26, 1977 in the Council Chambers. MOVED by Swartz, seconded by Anderson and carried to set Revenue Sharing Use Hearing at 7:30 p.m. on ,Monday, September 26, 1977 in the Council Chambers. MOVED by Anderson, seconded by Thorsen and carried to set September 8 & 14th at 7:30 p.m. as a work session on Budget. MOVED by Swartz, seconded by Thorsen and carried to receive for study and consideration the Managers Budget report. Police Unit Determination MOVED by Anderson, seconded by Johnson and carried to pursue appeal of the Bureau of Mediation's finding that Sergeants are non -supervisory personnel. Attorneys report on Noise Ordinance MOVED by Anderson, seconded by Johnson and carried to refer this to the Environmental Commission and put on agenda of October 17th for first reading after the Environmental Commission has met. Housing & Community Development Block Grant eligibility Status Jeff Sweet, Assistant City Manager, was present to answer any questions on the status of the eligibility of the proposed funding of Senior Citizen activities and the Youth Employment Service with Housing and Community Development Block Grant Funds. MOVED by Johnson, seconded by Anderson and carried to authorize a transfer of $1,000 from the General Contingency to Senior Citizen Programs. Fund Transfer Public Works Reserve to Storm Sewer - Western Ave. City Manager gave background information. Storm water now runs off the end of Western Avenue onto the golf course. After the storm sewer is connected it will run into the pond. MOVED by Johnson, seconded by Anderson and carried to transfer $6,120 from Public Works Reserve to the Storm Sewer budget. 14 Regular Meeting of the City Council - September 6, 1977 MN/DOT Frontage Road Agreement — Maintenance of previously surfaced roads under prior agreement. Member Anderson introduced the following written Resolution and moved its adoption: RESOLUTION (Approving Maintenance Agreement with Minnesota Department of Transportation Re: Frontage Roads) The motion for the adoption of the foregoing resolution was duly seconded by Member Thorsen and upon vote being taken thereon, the following members voted in favor thereof: Anderson, Hoover, Johnson, Swartz and Thorsen and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the City Clerk. Quote Concrete Slab mud -jacking City Manager received quote and recommends award on quote not to exceed $3,000.00. Solidification, Inc. Labor & Equipment $67.00/hour Material Invoice plus 20% MOVED by Anderson, seconded by Thorsen and carried to award the contract to the Solidification, Inc. for the concrete slab mud -jacking and accept the per hour amount up to $3,000. No Parking at anytime on both sides of Western Ave. from Louisiana to Ridgeway Rd. Member Johnson introduced the following written resolution and moved its adoption: RESOLUTION (Restrictive Parking on Certain Portions of Western Ave.) The motion for the adoption of the foregoing resolution was duly seconded by Member Anderson and upon vote being taken thereon, the following members voted in favor thereof: Anderson, Hoover, Johnson, Swartz and Thorsen and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the City Clerk.
