09-02-86 CC MinutesRegular Meeting of the City Council September 2, 1986 iPursuant to due call and notice thereof, a regular meeting of the City Council of the City of Golden Valley, Hennepin County, Minnesota was held at 7800 Golden Valley Road in said City on September 2, 1986 at 6:30 PM. The following members were present: Anderson, Bakken, Johnson, Stockman and Thompson. Also present were: William Joynes, City Manager; Lowell Odland, Director of Public Works; Allen Barnard, Assistant City Attorney; and Judy Nally, Deputy City Clerk. Approval of City Council Minutes - August 19, 1986 MOVED by Stockman, seconded by Johnson and motion carried unanimously to approve the minutes of the City Council meeting of August 19, 1986 as submitted. Approval of Agenda MOVED by Johnson, seconded by Bakken and motion carried unanimously to approve the agenda of September 2, 1986 as amended: Addition of Mayor and Council Items: Centennial Town Meeting and Hennepin County Task Force Approval of Consent Agenda • MOVED by Thompson, seconded by Bakken and motion carried unanimously to approve the items on the consent agenda, indicated by an asterisk (*). *Bills and Claims MOVED by Thompson, seconded by Bakken and motion carried unanimously to authorize payment of the bills as submitted. *Licenses MOVED by Thompson, seconded by Bakken and motion carried unanimously to authorize the issuance of licenses #10891 to #10897 and #5753 to #5755. On Sale and Sunday Sale Liquor License - Criterion West William Joynes stated that staff recommends approval of the license subject to the owners signing personal guarantees. Robert Sandler, Marc Sandler, and Allan Salita, Attorney representing Bobmar, stated since his clients are tenants and not owners of the property where their, restaurant is located, they did not want to sign a personal guarantee that would make them responsible for payment of real estate taxes. Allen Barnard stated that a letter would be written and attached to the guarantee that would exclude the payment of real estate taxes from the guarantee. MOVED by Johnson, seconded by Stockman and motion carried unanimously to authorize the issuance of a On Sale and Sunday Sale Liquor License to Criterion West, subject to signing the personal guarantee by Bobmar with the attached letter of explanation from Best and Flanagan. Regular Meeting of the City Council *Solicitor's License - Noble School PTO September 2, 1986 • MOVED by Thompson, seconded by Bakken and motion carried unanimously to approve the solicitor's license for the Noble School PTO. *Taxi Cab Driver's Licenses MOVED by Thompson, seconded by Bakken and motion carried unanimously to authorize the issuance of taxi cab licenses as recommended by staff. *Minutes of Boards and Commissions MOVED by Thompson, seconded by Bakken and motion carried unanimously to receive and file the minutes received as follows: Recreational Facility/Pool Committee - August 11, 1986 Open Space and Recreation Commission - July 28, 1986 Board of Zoning Appeals - August 12, 1986 Bassett Creek Water Management Commission - July 17, 1986 Brookview Improvement Committee - August 14, 1986 Building Board of Review - August 18, 1986 Planning Commission - August 25, 1986 *Call for Public Hearing - Preliminary Plat Approval - John James Addition - 10786 MOVED by Thompson, seconded by Bakken and motion carried unanimously to call a • public hearing to consider approval of the preliminary plat of John James Addition for October 7, 1986. *Call for Public Hearing - Conditional Use Permit - 8950 Olson Memorial Highway - 10 [7-T8 —6 MOVED by Thompson, seconded by Bakken and motion carried unanimously to call a public hearing to consider approval of a conditional use permit to allow for expansion of an automotive service facility at 8950 Olson Memorial Highway in a Commercial Zoning District for October 7, 1986. Public Hearing - Preliminary Plat Approval - Quinn Addition Lowell' Odland reviewed the plat. John Quinn, proponent, was present to answer questions from the Council. The Mayor opened the meeting for public input and persons present to do so were afforded the opportunity to express their views thereon. Hearing and seeing no one, the Mayor closed the public hearing. MOVED by Thompson, seconded by Stockman and motion carried unanimously to approve the preliminary plat as proposed, conditional upon dedication to the City on the Final Plat of standard drainage and utility easements along lot lines as required in the City Subdivision Regulations. • a Regular Meeting of the City Council September 2, 1986 Public Hearing - Preliminary Plat Approval - Valley Square Third Addition 0 Lowell Odland reviewed the plat and answered questions from the Council. The Mayor opened the meeting for public input and persons present to do so were afforded the opportunity to express their views thereon. Marti Micks, 90 Louisiana Avenue South, asked what the preliminary plat was for. The Mayor closed the public hearing. MOVED by Stockman, seconded by Thompson and motion carried unanimously to approve the preliminary plat as proposed, conditional upon inclusion on the Final Plat of all easements shown on the survey. Waiver of Platting Ordinance - 4215 Poplar Drive and 205-215 Meadow Lane Lowell 0 dland reviewed the waiver. Bruce Monick, proponent, was present to answer any questions. The Mayor opened the meeting for public input and persons present to do so were afforded the opportunity to express their views thereon. Hearing and seeing no one, the Mayor closed the public hearing. Petition from Residents Regarding I-394 Noise Wall Lowell Odland reviewed background information on the petition from the neighborhood regarding the concerns over the construction of the I-394 noise wall. The Mayor opened the meeting for public input and persons present to do so were afforded the opportunity to express their views thereon. Jeff Wirth, 1515 Princeton, he would like his property be purchased by the State for the noise wall. • Carlton Fish, 1400 Natchez Avenue South, he is in support of the wall being on the residential side but not adjacent to his property. Bob Torbert, 1450 Ottawa Avenue South, petitioner, was present to answer any questions. Wayne Jopp, 1423-25 Ottawa Avenue South, he is in support of moving the wall and will meet with Lowell Odland to decide on the location of the noise wall by his property. The Mayor closed the public hearing. MOVED by Stockman, seconded by Johnson and motion carried unanimously to request the Mayor send a letter to MnDOT indicating the Council's support of the changes outlined in the petition regarding the I-394 noise wall. *Letter from Bill Riley Regarding Golf Course MOVED by Thompson, seconded by Bakken and motion carried unanimously to receive and file the letter from Bill Riley, dated August 15, 1986, regarding the Golf Course. *July, 1986 - General Fund Budget Report • MOVED by Thompson, seconded by Bakken and motion carried unanimously to receive and file the July, 1986 General Fund Budget Report. 31 Regular Meeting of the City Council September 2, 1986 *Bids - 86 LF 1 (Lateral Fund, Mallard Creek) MOVED by Thompson, seconded by Bakken and motion carried unanimously to award the bid for 86 LF 1 to the lowest responsible bidder, G. Ruffridge-Johnson is the only distributor in the area. *Bids - Public Safety Building and Fire Station Improvements MOVED by Thompson, seconded by Bakken and motion carried unanimously to award the bid for improvements to the Public Safety Building and Fire Stations from the lowest responsible bidder, Parkos Construction Co for $28,955.00. The bids are as follows: Parkos Construction Co. $28,955 Morcon Construction, Inc. 31,200 Rocon Construction Co. 31,840 Ll 0 Regular Meeting of the City Council September 2, 1986 Authorization to Hire Architect for Golf Course Green and Tee Reconstruction • William Joynes reviewed the recommendation and answered questions from the Council. MOVED by Stockman, seconded by Thompson and motion carried unanimously to authorize the hiring of Don Herfort to do the design and planning work on #9 green and #2 tee; #2 green and #7 green and approach area; and master plan of the entire course for a cost not to exceed $7,800.00. Request by Animal Humane Society for Donation William Joynes reviewed the request for a donation submitted by the Animal Humane Society. MOVED by Thompson, seconded by Johnson and motion carried unanimously to authorize a donation of $962.00 to the Animal Humane Society, as outlined in their request dated August 25, 1986. Set Date for Budget Workshop and Call for Public Hearing: 1987 Budgets (General Fund, Revenue Sharing, Utility, Brookview Golf and Motor Vehicle License unds The Council set September 16, 1986 at 4:30 PM in the Manager's Conference Room for the budget workshop. The Council called a public hearing for September 23, 1986 at 7:30 PM in the . Council Chambers to adopt the 1986 budgets for the General Fund, Revenue Sharing, Utility, Brookview Golf and Motor Vehicle License Funds. *Call for Public Hearing - Special Assessments - 10/7/86 MOVED by Thompson, seconded by Bakken and motion carried unanimously to call a public hearing on October 7, 1986 at 7:30 PM in the Council Chambers as the date for the special assessment hearing on the following projects: 84 SI 3, 85 SI 3, 85 SI 4, 85 SI 10, 84 WM 3, 84 LF 3, RSL 160, 86 SC 1, delinquent utility bills, weed eradication, tree removal, fire alarm violations and other delinquent invoices. Announcements of Meetings Mayor Anderson will represent the City at the Courage Center Dedication event scheduled for Monday, September 8, 1986 beginning at 8:00 AM. A meeting will be held with Regional Transit Board members, legislators and local officials on September 18, 1986 at 7:00 PM at the Crystal City Hall to discuss transit issues. A seminar/training session will be held on Nuclear Spent Fuel Shipments on September 25, 1986 beginning at 1:30 PM or 7:00 PM in the Osseo City Hall. • M Regular Meeting of the City Council Centennial Town Meeting September 2, 1986 Council Member Thompson distributed and reviewed a report on the first meeting of the Centennial Town Meeting Committee. MOVED by Stockman, seconded by Johnson and motion carried unanimously to receive and file the report submitted by Council Member Thompson dated August 29, 1986. The next meeting is scheduled for September 10, 1986 at 6:30 PM in the Manager's Conference Room. Hennepin County Park Task Force Mayor Anderson reviewed a letter from David Latvaaho, Chair, Hennepin Parks Board of Commissioners, regarding the formation of a task force to prepare a master plan for a regional park entity on Lake Minnetonka and asked if any Council Member wished to participate.
