04-07-87 CC MinutesRegular Meeting of the City Council April 7, 1987 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Golden Valley, Hennepin County, Minnesota was held at 7800 Golden Valley Road in said City on April 7, 1987 at 6:30 PM. The following members were present: Anderson, Bakken, Johnson, Stockman and Thompson. Also present were: William Joynes, City Manager; Lowell Odland, Director of Public Works; Robert Skare, City Attorney; and Judy Nally, Deputy City Clerk. Approval of City Council Minutes - March 17, 1987 MOVED by Stockman, seconded by Johnson and motion carried unanimously to approve the minutes of the Regular Council meeting of March 17, 1987 as submitted. Approval of Council/Manager Minutes - March 17, 1987 MOVED by Johnson, seconded by Bakken and motion carried unanimously to approve the minutes of the Council/Manager meeting of March 17, 1987 as submitted. Approval of Agenda MOVED by Thompson, seconded by Bakken and motion carried unanimously to approve the agenda of April 7, 1987 as submitted. Approval of Consent Agenda MOVED by Johnson, seconded by Bakken and motion carried unanimously to approve the items on the consent agenda, indicated by an asterisk (*), removing Manager's Item: Defense of Punitive Damage Claim in Berg vs. City of Golden Valley Lawsuit. *Bills and Claims MOVED by Johnson, seconded by Bakken and motion carried unanimously to authorize payment of the bills as submitted. *Licenses MOVED by Johnson, seconded by Bakken and motion carried unanimously to authorize the issuance of licenses #11326 to #11384 and 5816 to #5824. Class D Gambling License - Golden Valley Rotary Club Mayor Anderson introduced the agenda item. MOVED by Bakken, seconded by Thompson and motion carried unanimously to remove the item from the consent agenda and authorized approval of the amended Gambling License for the Golden Valley Rotary Club. *Taxicab Driver's Licenses MOVED by Johnson, seconded by Bakken and motion carried unanimously to approve the taxicab driver's licenses as submitted by staff. Regular Meeting of the City Council *Minutes of Boards and Commissions April 7, 1987 MOVED by Johnson, seconded by Bakken and motion carried unanimously to receive is and file the minutes received as follows: Bassett Creek Water Management Commission - February 17, 1987 Board of Zoning Appeals - March 10, 1987 Black History Month - March 12, 1987 Planning Commission - March 22, 1987 Open Space and Recreation Commission - February 23, 1987 Public Hearing - RSL 164 - (Resident Street Lighting) - Major Avenue Lowell Odland presented the project. The Mayor opened the meeting for public input and persons present to do so were afforded the oportunity to express their views thereon. Daniel LaFontaine, 2944 Major Avenue North, he feels the current lighting is adequate and wants to be removed from the district. Larry Rassatt, 3126 Major Avenue North, Petitioner, in favor of lights. Gary Wilson, 3230 Major Avenue, he doesn't want the overhead light removed by the park and would prefer overhead lights not ornamental. Ed Golusky, 3225 Major Avenue North, feels ornamental lighting is not adequate. Dave Gallagher, 2945 Major Avenue North, he would like to be removed from the lighting district, and likes the overhead light at the intersection. MOVED by Thompson, seconded by Bakken and motion carried unanimously to request staff to redesign the lighting district, eliminating the six lots on the south end, indicate to NSP the City's interest in maintaining the overhead light on Adell Avenue and continue the public hearing to May 5, 1987. Public Hearing - First and Second Reading - Ordinance Amendment - Providing for Resident -Only Parking Zones and Suspension of Parking Regulations MOVED by Thompson, seconded by Johnson and motion carried unanimously to bring on the table for first reading the ordinance amendment herein entitled: f-&1A11-4A1L4- A/6, lr9y� AN ORDINANCE AMENDING THE CITY CODE (Providing for Resident -only Parking Zones and Suspension of Parking Regulations) William Joynes reviewed the history of the proposed ordinance. Dean Mooney, Acting Director of Public Safety, reviewed the implementation of the ordinance. Robert Skare, explained the process for passing the ordinance. The Mayor opened the meeting for public input and persons present to do so were afforded the oportunity to express their views thereon. Jane Gjerstad, 5420 Circle Down, she had questions regarding how permits will be issued to each household, the cost, what area the regulations will effect and when the ordinance goes into effect will the cars be towed or tagged. CJ Regular Meeting of the City Council April 7, 1987 Public Hearing - First and Second Reading - Ordinance Amendment - Providing for Resident -Only Parking Zones and Suspension of Parking Regulations - ontinue Mark Holmbock, Attorney representing Herm Held, 5400 Circle Down, does not feel the residents should pay the permit fees, the fees should be assessed to Rupert's because the problem was not caused by the residents. Sonja Fortier, 408 Turnpike Road, she questioned why the problem has to be addressed by an ordinance which effects the entire city. David Brown, 5210 Circle Down, he feels the problem was created by Rupert's and the cost of the permit should not be forced on the residents and requested that residents be allowed four permits per household. Tom Fox, 5211 Circle Down, he would like to park in front of his house without paying a fee. Sandy Brown, 5120 Circle Down, she wanted to know what the administrative costs were for the fee, and questioned why it will take so long to enforce the ordinance. Daryl Fortier, 408 Turnpike Road, he feels the property owner should have exclusive use of the parking spaces available in front of their home. Shirley Burkard, 5301 Circle Down, she wanted to know if the parking ramp will charge a fee for its use. The Mayor closed the public hearing. MOVED by Thompson, seconded by Bakken and motion carried unanimously to amend the ordinance as follows: Page 4: 5. ... limited to "three"... 6. "No fees shall be charged for the first two resident and/or visitor permits issued for a particular dwelling unit. Thereafter a fee, as specified in Section 800:10 of the City Code, shall be charged for each resident and/or visitor permit issued or transferred as respects said dwelling unit" MOVED by Johnson, seconded by Stockman and motion carried unanimously to approve on first reading the ordinance amendment herein quoted by title. Informal Public Hearing - Consideration of Resident -Only Parking Zone - Circle Down/Radisson Roa The Mayor opened the meeting for public input and persons present to do so were afforded the oportunity to express their views thereon. Jane Gjerstad, 5420 Circle Down, she doesn't feel residents should pay and feels Turner's Crossroad should be included in the zone. Daryl Fortier, 408 Turnpike Road, feels resident only parking should be applied to Turner's Crossroad up to Radisson Road. The Mayor closed the public hearing. MOVED by Johnson, seconded by Bakken and motion carried unanimously to continue the informal public hearing for consideration of resident -only parking zone to the April 21, 1987 meeting. Regular Meeting of the City Council April 7, 1987 Public Hearing - First Reading - Ordinance Amendment - Revocation of Conditional Use Permits MOVED by Johnson, seconded by Bakken and motion carried unanimously to bring on the table for first reading the ordinance amendment herein entitled: �L'U; tili��ti� 4,L/ G- 5;-6 AN ORDINANCE AMENDING THE CITY CODE (Procedures Affecting Conditional Use Permits) Warren Kapsner, Planning Commissioner, stated the Commission recommended approval. Staff Report- Request to Remove "No Right Turn" Sign - Duluth Street and Brunswick Avenue North Lowell Odland introduced the agenda item. MOVED by Johnson, seconded by Bakken and motion carried unanimously to call for an informal public hearing to consider the request to remove the "No Right Turn" sign at Duluth Street and Brunswick Avenue North for May 5, 1987. Resolution Determining the Desirability of Issuing $5,000,000 General Obligation Pool and Recreational Facility Bonds and Providing for an Election Thereon William Joynes introduced the agenda item. MOVED by Thompson, seconded by Johnson and motion carried unanimously to authorize the Mayor and Manager to sign the Sergeant's contract. MOVED by Stockman, seconded by Bakken and motion carried unanimously to authorize the Mayor and Manager to sign the MAMA -49 Master Labor Agreement. Membership Availability and Fee Priorities - Proposed Recreation Center William Joynes introduced the agenda item. MOVED by Johnson, seconded by Thompson and motion carried unanimously to approve the Open Space and Recreation Commission's policy statement for membership availability and fee priorities at the proposed recreation center. Defense of Punitive Damage Claim in Berg vs. City of Golden Valley Lawsuit William Joynes requested the Council authorize the staff to have the flexibility to hire more than one attorney, if it becomes necessary, to represent the officers. MOVED by Bakken, seconded by Thompson and motion carried unanimously to approve the expenditure of funds necessary to underwrite the reasonable legal costs of retaining attorneys to represent the interests of the officers involved in the Berg vs. City of Golden Valley Lawsuit, only in regard to the punitive damage eclaims. Announcements of Meetings The Human Rights Commision Video Showing will be held on Wednesday, April 8 at 7:30 PM at Brookview The AMM Annual Meeting will be Thursday, May 28, 1987 Set Date for Board/Commission Recognition Dinner The Council set May 26, 1987 at 6:30 PM at Brookview as the Board/Commission Recognition Dinner. A menu will be presented at the April 21 meeting for the Council's review. Presentations to Len Dittrich and Glen Olson Wayne Henry, AWWA, was present to give Len Dittrich a plaque on behalf of his organization. Mayor Anderson presented a pewter bowl to Len on behalf of the Council. Council Member Stockman presented a pewter bowl to Glen Olson on behalf of the Council.
