Pursuant to due call and notice thereof, a regular meeting of the City Council
of the City of Golden Valley, Hennepin County, Minnesota was held at 7800 Golden
Valley Road in said City on November 29, 1988 at 6:30 PM.
The following members were present: Anderson, Bakken (arrived 6:36 PH), Johnson,
Stockman and Thompson. Also present were: William Joynes, City Manager; Lowell
Odland, Director of Public Works; Allen Barnard, City Attorney; and Judy Nally,
Deputy City Clerk.
Approval of Minutes - November 18, 1988
MOVED by Stockman, seconded by Johnson and motion carried unanimously to receive
and file the minutes of the City Council meeting of November 15, 1988 as submitted.
Approval of Agenda
MOVED by Thompson, seconded by Stockman and motion carried unanimously to approve
the agenda of November 29, 1988 as submitted.
Approval of Consent Agenda
MOVED by Johnson, seconded by Thompson and motion carried unanimously to approve
the items on the consent agenda, indicated by an asterisk (*).

MOVED by Johnson, seconded by Thompson and motion carried unanimously to authorize
payment of the bills as submitted.

MOVED by Johnson, seconded by Thompson and motion carried unanimously to authorize
the issuance of license #12211 to #12225 and #5976 to #5977.

MOVED by Johnson, seconded by Thompson and motion carried unanimously to call a
public hearing to consider approval of the preliminary design plan for PUD #55,

roval of 1989 Recreation and Golf Fees
0 Mayor Anderson introduced the agenda item.
Rick Jacobson, Director of Park and Recreation, reviewed the staff's proposals
and the Open Space and Recreation Commisson's recommendation regarding the golf
course fees and answered questions from the Council.
Geroge Murad, Open Space and Recreation Commission and Brookview, Improvement
Committee, reviewed the Commission and Commitee's recommendation regarding the
increasing of the golf fees.
William Joynes reviewed a survey of the rates for other golf courses in the
metropolitan area.
Hal Younghans, Brookview Improvement Committee, stated he feels residents who
supported the course should get a fee break and feels the course should be
primarily for Golden Valley residents.
MOVED by Stockman, seconded by Johnson and motion carried unanimously to approve
the staff recommendation for the 1989 recreation fees and approve the staff
recommendation for the golf fees with one exception - the fee for resident
patron cards should be $45.00.
MOVED by Stockman, seconded by Johnson and motion carried unanimously to amend
the foregoing motion and approve the staff recommendation for all 1989 recreation
•
fees and golf fees with the following exception - all fees for resident patron
cards remain as they were in 1988.
MOVED by Stockman, seconded by Johnson and motion carried unanimously to reconsider
the two forgoing motions.
MOVED by Stockman, seconded by Johnson and notion carried unaniously to approve
the staff recommendation for the 1989 recreation fees and approve the staff
recommendation for the golf fees, except maintain the 1988 fees for the resident
patron card holders.
Appeal of Board of Zoning Appeals Denial - Gregg Malik - 1900 Douglas Drive
Mayor Anderson introduced the agenda item.
Allen Barnard reviewed his memo regarding making a record for zoning and zoning
type hearings
Gregg Malik, 1900 Douglas Drive, stated he has been doing marine maintenance
for 12 years, his company would not be able to financial make it without the
marine repair work, feels its a service to the community, and requested that he
be allowed to park boats on the property instead of automobiles.
Art Flannagan, Board of Zoning Appeals Chair, stated the Board denied the waivers
requested by Mr. Malik, stating that per State Statute, financial hardship is
not an acceptable hardship to grant variances and granting the waivers would
• not meet the intent and spirit of the Zoning Code by legalizing and perpetuating
the existing non -conforming conditions.

Appeal of Board of Zoning Appeals Denial - Gregg Malik - 1900 Douglas Drive -

The Mayor opened the meeting for public input and persons present to do so were
afforded the opportunity to express their views thereon.
Belle Prior, Manager, Golden Valley Arms, 6150 St. Croix Avenue North, opposed
to marine engine repair at station because she feels the station is to small,
and objects to the noise and fumes at the swimming pool.
Mary Swanson, 6150 St. Croix Avenue North, feels the gas fumes are annoying to
people at the pool and the residents of the apartment building.
Tony Farmer, 6150 St. Croix Avenue North, feels there is a saftey hazard by
repairing the marine engines at the station because of the excess fuel, and
objects to the storage of boats because of aesthetics.
TheMayorclosed the public hearing.
MOVED by Stockman, seconded by Johnson and motion carried unanimously to uphold
the denial by the Board of Zoning Appeals of the waivers and make the following
findings of fact:
1. an undue hardship does not exist;
2. that the property in question can be put to a reasonable use under the Zoning
Code;
• 3. the problem presented by the landowner is due to circumstances created by the
landowner;
4. the granting of the variance would alter the essential character of the
locality.
Upon a roll call vote, the vote was as follows:

*Letters Regarding Boat Engine Repair at 1900 Douglas Drive
MOVED by Johnson, seconded by Thompson and motion carried unanimously to receive
and file the letters from: Steve Vanderboom, PACE Laboratories, Inc., dated
November 16, 1988; Mark Ogren, Croix Oil, dated November 1, 1988; Dennis Taylor,
Shenehon-Goodlund-Taylor, Inc., dated October 31, 1988; and Mildren Hanson, dated
October 21, 1988 regarding boat engine repair at 1900 Douglas Drive.
*Authorization to Hire Pannell Kerr Forster to Perform the 1988 Audit
MOVED by Johnson, seconded by Thompson and motion carried unanimously to authorize
the Mayor and Manager to sign the arrangement letter with Pannell Kerr Forster
for the 1988 Audit.
*Call for Public Hearing - Ordinance Amendment - I-394 Overlay Zoning District -
12/20/88
• MOVED by Johnson, seconded by Thompson and motion carried unanimously to call a
public hearing to consider an ordinance amendment regarding the I-394 overlay
zoning district for December 20, 1988.

• MOVED by Johnson, seconded by Thompson and motion carried unanimously to authorize
the re-lamping of the main parking areas from the lowest responsible bidder,
Gopher Electric for $1,078.00. The quotes were as follows:

*Bids - Water System Control Board
MOVED by Johnson, seconded by Thompson and notion carried unanimously to award
the bid for the water utility control system for Golden Valley, Crystal and New
Hope from the lowest responsible bidder, AutoCon Industries for $129,435.00.
The bids were as follows:

Aquatrol Corp. 179,900.00
1988-1989 Patrol Officer's Contract Settlement
William Joynes reviewed the proposed contract and answered questions from the
Council. A formal contract will be placed on the agenda for signatures at a
future date.
• MOVED by Johnson, seconded by Bakken and notion carried unanimously to authorize
staff to implement the 1988-1989 Patrol Officer's Contract settlement as outlined
in the City Manager's memo dated November 23, 1988.
Announcements of Meetinqs
Mayor Anderson and Council Members Bakken and Johnson will attend the National
League of Cities Conference in Boston from December 2 - 6, 1988.
William Joynes will be on vacation from December 8 - 11, 1988.
The Council, Planning Commission and Hunan Rights Commission will meet on
December 11, 1988 to discuss residential facility policy as it relates to Level
IV board and lodging facilities.
Mayor's Communications
Mayor Anderson and William Joynes will meet with members of the Valley Days
Committee to discuss possible locations for the 1989 celebration.
Council Retreat Date - 2/11/89
The Council set February 11, 1989 as the date for the Council retreat to be held
at Brookview Community Center.
