03-02-93 CC Minutes Regular Meeting of the City Council March 2, 1993 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Golden Valley, Hennepin County, Minnesota was held at 7800 Golden Valley Road in said City on March 2, 1993 at 6:30 PM. The following members were present: Bakken, Johnson, Russell , Stockman and Thompson. Also present were: Jeanne Andre, Assistant to the Manager; Fred Salsbury, Director of Public Works; Al1en Barnard, City Attorney; and Judy Nally, Administrative Secretary. Approval of Agenda MOVED by Johnson, seconded by Russell and motion carried unanimously to approve the agenda of March 2, 1993 as amended: Addition of Mayor and Council Items - Proclamation Regarding Dorothy Wandersee and City Manager's 1993 Compensation. Approval of Consent Agenda MOVED by Thompson, seconded by Stockman and motion carried unanimously to approve the items on the consent agenda, indicated by an asterisk (*). *Bills and Claims MOVED by Thompson, seconded by Stockman and motion carried unanimously to authorize payment of the bills as submitted. *Licenses MOVED by Thompson, seconded by Stockman and motion carried unanimously to authorize the issuance of licenses #14415 - #14438 and #6435 - #6452. *Gamblin License Exem tion and Waiver of Notice Re uirement - Ladies Auxiliary to eterans o oreign ars MOVED by Thompson, seconded by Stockman and motion carried unanimusly to receive and file the gambling license exemption and approve the waiver of notice requirement for the Ladies Auxiliary to Veterans of Foreign Wars. *Minutes of Boards and Commissions MOVED by Thompson, seconded by Stockman and motion carried unanimously to receive and file the minutes received as follows: Bassett Creek Water Management Commission - December 17, 1992 Black History Committee - February 11, 1993 Board of Zoning Appeals - February 9, 1993 Human Rights Commission - December 10, 1992, January 14, and February 11, 1993 Civil Service Commission - February 3, and November 2, 1992; February 1, and February 17, 1993 Regular Meeting of the City Council March 2, 1993 Page 2 Letter from Vernon Peterson Regarding Restrictions on Commercial Lots Jeanne Andre introduced the agenda item and answered questions regarding the zoning districts. Vernon Peterson, 17425 County Road 47 North, feels he should be able to park vehicles on his lot, stated other companies park vehicles on their property and wanted to know why he was not allowed to, and left photos of other sites around the City where other vehicles were parked on commercial lots. He feels he should not have been fined and the City should reimburse him and asked if the City wanted to purchase the lot. Mayor Bakken stated the City would not reimburse him for the fines and informed him that he should write a letter to the City Manager regarding the City buying his lot. *Inter-Fund Loan for Hydroject Aerifier at Golf Course Member Thompson introduced the following resolution and moved its adoption: RESOLUTION 93-20 RESOLUTION AUTHORIZING THE INTER-FUND LOAN NEEDED TO FINANCE THE PURCHASE OF A HYDROJECT AERIFIER FOR THE BROOKVIEW GOLF COURSE AND SETTING THE TERMS OF THIS INTER-FUND LOAN The motion for the adoption of the foregoing resolution was seconded by Member Stockman and upon a vote being taken thereon, the following voted in favor thereof: Bakken, Johnson, Russell , Stockman and Thompson; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the City Clerk. *Call for Informal Public Hearing - Winnetka Avenue Reconstruction - 3/16/93 MOVED by Thompson, seconded by Stockman and motion carried unanimously to call for an informal public hearing to consider the design for the reconstruction of Winnetka Avenue North from Harold Avenue to 200 feet north of Orkla Drive for March 16, 1993. *Recall Public Hearin - Ordinance Amendment - Railroad Zonin District - 9 MOVED by Thompson, seconded by Stockman and motion carried unanimously to recall the public hearing to consider an ordinance amendment deleting Sec. 11.41 regarding the Railroad Zoning District for April 13, 1993. *Recall Public Hearin - Ordinance Amendment - Ado tion of Amended Official oning ap - MOVED by Thompson, seconded by Stockman and motion carried unanimously to recall the public hearing to consider an ordinance amendment in Sec. 11.11 adopting a new official zoning map for April 13, 1993. Regular Meeting of the City Council March 2, 1993 Page 3 *Request by Down in the Vallev for Inflatable Balloons MOVED by Thompson, seconded by Stockman and motion carried unanimously to grant the request submitted by Down in the Valley to display an inflatable advertising ballon at their store located at 8020 Olson Memorial Highway on the following dates: March 17-23, June 16-22, September 15-21 and December 8-12, 1993. *Quote - 1993 Diseased Tree Removal and Public Tree Trimmin Contract MOVED by Thompson, seconded by Stockman and motion carried unanimously to renew the contract for the trimming and removal of trees and stumps on public and private property from Tim's Tree Service, as outlined in the memo from Don Taylor, dated February 23, 1993. Announcements of Meetings The NLC Congressional City Conference will be held from March 6 - 9, 1993 in Washington, DC. Mayor's Communications Mayor Bakken received a letter from Patrick McCoy, dated February 22, 1993 regarding a skateboard park. Staff was requested to review the letter and make a recommendation. Mayor Bakken received a letter from Vaike Radamus, dated February 23, 1993, regarding customer service. Mayor Bakken received a letter from the Metropolitan Waste Control Commission, dated February 26, 1993 regarding pre-budget breakfast meetings. Any Council Members wishing to attend should notify staff. Mayor Bakken received a letter from the National League of Cities, dated February 24, 1993 regarding the 1993 Congress of Cities Program Committee. Any Council Member interested in serving on the Committee should let him know. Mayor Bakken received a letter from Just for Kids, dated February 18, 1993 and staff will provide copies for the Council . MOVED by Johnson, seconded by Russell and motion carried unanimously to receive and file the following letters: Patrick McCoy, dated February 22, 1993; Vaike Radamus, dated February 23, 1993; Metropolitan Waste Control Commission, dated February 22, 1993; National League of Cities, dated February 24, 1993; and Just for Kids, dated February 18, 1993. Regular Meeting of the City Council March 2, 1993 Page 4 Pedestrian Safety on Sidewalks Jeanne Andre, introduced the agenda item. Dean Mooney, Public Safety Director, reviewed the background on the request to restrict riding bicycles on sidewalks, staff recommendation, Hopkins Bicycle Ordinance, and alternative suggestions. The Council requested staff prepare a recommendation for the installation of bicycle informational signs and suggested locations along Golden Valley Road, and report back to the Council it its April 13, 1993 meeting. They also suggested an article regarding bicycle safety and information regarding the safety camp be put in the City newsletter and make information regarding bicycle safety available at the City. Board/Commission Appointments Mayor Bakken introduced the agenda item. MOVED by Thompson, seconded by Stockman and motion carried unanimously to make the following reappointments: Planning Commission - 3 year term - expires March 1, 1996 Emilie Johnson, Warren Kapsner, and Paula Pentel Building Board of Review - 3 year term - expires March 1, 1996 Stan Chasney and John Foster Human Rights Commission - 3 year term - expires March l, 1996 Sondra Kelly and Jeff Loeb Open Space and Recreation Commission - 3 year term - expires 1, 1996 Patricia Borchert Head Start Fundin Request Jeanne Andre introduced the agenda item. MOVED by Stockman, seconded by Russell and motion carried to prepare a resolution supporting the Nead Start facility, including a $5,000 contribution, and informtion for the CDBG public hearing for Council consideration on March 16, 1993. Council Member Thompson voted no. The Council requested staff to provide background information on the housing rehabilitation program including the number of people served, projects done in the past, who have been served, the number of people who have applied and the size of the grants and the types of improvements. Regular Meeting of the City Council March 2, 1993 Page 5 American Indian Religious Freedom Act (AIRFA) Mayor Bakken introduced the agenda item. MOVED by Johnson, seconded by Stockman and motion carried to accept the Human Rights Commission 's recommendation and endorse the AIRFA amendment, but not formally join the AIRFA Coalition at this time. Council Member Russell and Thompson abstained. Proclamation Regardin Doroth Wandersee Mayor Bakken read the proclamation regarding Dorothy Wandersee. MOVED by Russell , seconded by Thompson and motion carried unanimously to approve the proclamation regarding Dorothy Wandersee. MOVED by Stockman, seconded by Thompson and motion carried unanimously to direct staff to have a plaque made incorporating said proclamation to be presented to the family at a later date. City Manager's 1993 Compensation Mayor Bakken reviewed the subcommittee recommendation. MOVED by Stockman, seconded by Johnson and motion carried unanimously to approve the City P�anager's compensation for 1993 as follows: base salary increase of 2.5q from $86,615 to $88,780 and an additional lump sum of five days of vacation which would not increase the future accrual rate.
