Approval of Consent Aqenda MOVED by Johnson, seconded by Micks and motion carried unanimously to approve the items on the consent agenda, indicated by an asterisk (*), as amended: Removal of Communications and Petitions - Petitions and Letters from James and Jacqueline Johnson, Kathleen Sansaver, Judith Dahl , Gerald Dahl and Bernard Robbins Regarding Schaper Property. *Bills and Claims MOVED by Johnson, seconded by Micks and motion carried unanimously to authorize payment of the bills as submitted. *Licenses MOVED by Johnson, seconded by Micks and motion carried unanimously to authorize the issuance of licenses #6636 - #6638. *Minutes of Boards and Commissions MOVED by Johnson, seconded by Micks and motion carried unanimously to receive and file the minutes received as follows: Black History Committee - November 3, 1994 Board of Zoning Appeals - October 26, 1994 Community Standards Task Force - November 2, 1994 ; i` Regular Meeting of the City Council November 15, 1994 Page 2 Continued Public Hearinq - First Consideration - Ordinance �119 - General Plan Approval PUD #65 Golden Valle Shoppin Center The following ordinance ��as MOVED by Thompson, seconded by Russell : ORDINANCE #119, 2ND SERIES AN ORDINANCE AMENDING THE CITY CODE Approval of the General Plan of Development for PUD #65 7901 Golden Valley Road, 505 Winnetka Avenue, 7860-8040, 8200, and 8224 Olson Memorial Highway Trach Properties, Applicant William Joynes introduced the agenda item. Dave Clark, representing the applicant, stated they are in negotiations with MnDOT regarding the encroachments of the parking lot and are waiting for final approval from MnDOT. The Mayor opened the meeting for public input and persons present to do so were afforded the opportunity to express their views thereon. Hearing and seeing no one, the Mayor closed the public hearing. MOVED by Russell , seconded by Johnson and motion carried unanimously to continue the public hearing for consideration of Ordinance #119 until December 20, 1994. Public Hearin - First and Second Consideration - Ordinance #120 - General Plan Approval - Amendment #1 - PUD #6 - Dahlberq Commerce Center The following ordinance was MOVED by Johnson, seconded by Thompson: ORDINANCE #120, 2ND SERIES AN ORDINANCE AMENDING THE CITY CODE Amendment No. 1 to the General Plan of Development for Dahlberg Commerce Center, P.U.D. No. 61, Grow Biz International , Applicant Mark Grimes, Director of Planning and Development; introduced the agenda item. Marlys Enger, Director, Administrative and Facility Services, Grow Biz; reviewed the amendment and answered questions from the Council . The Mayor opened the meeting for public input and persons present to do so were afforded the opportunity to express their views thereon. MOVED by Russell , seconded by Thompson and motion carried to suspend the rules and hold first and second consideration as published in the notice of public nearing, as there is no residential property near the property, it is a non- controversial item. Council Member Micks voted no. The following ordinance was MOVED by Russell , seconded by Thompson; ORDINANCE #120, 2ND SERIES AN ORDINANCE AMENDING THE CITY CODE Amendment No. 1 to the General Plan of Development for Dahlberg Commerce Center, P.U.D. Brenda Johnson, 4840 Killarney Drive, reviewed their petition and requested the Council meet with area residents to review the dev�lopment of the property and answer their questions. A1 DeWald, property manager, Valley Village, he would like to hear both sides of the issue so he can inform his residents. The Mayor closed the public hearing. William Joynes reviewed the process for consideration of the issue by the Council . MOVED by Thompson, seconded by Tremere to appoint a subcommittee of comprised of Council Member Thompson and Mayor Tremere to meet with the neighborhood to review their concerns. MOVED by Johnson, seconded by Russell and motion carried unanimously to receive and file the petition, received November 7, 1994; letter from James C. and Jaqueline Johnson, dated November 2, 1994; letters from Kathleen Sansaver, received November 9, 1994; Judith Dahl , dated November 3, 1994; Gerald Dahl , dated November 4, 1994; and Bernard Robbins, dated November 7, 1994; regarding the Schaper property. *October, 1994 General Fund Budget Report MOVED by Johnson, seconded by Micks and motion carried unanimously to receive and file the October, 1994 General Fund Budget Report. *Call for Public Hearin - General Plan A roval - PUD #67 - Westwood Lake Office ark - MOVED by Johnson, seconded by Micks and motion carried unaimously to call a public hearing to consider general plan approval for PUD #67, West�vood Lake Office Park for December 6, 1994. Regular Meeting of the City Council November 15, 1994 Page 5 *Call for Feasibility Study - RSL 213 - Turnpike Road and Lawn Terrace �1ember Johnson introduced the following resolution and moved its adoption: RESOLUTION 94-81 RESOLUTION ORDERING PREPARATION OF REPORT ON IMPROVEMENT RSL 213 TURNPIKE ROAD AND LAWN TERRACE The motion for the adoption of the foregoing resolution was seconded by Member �icks and upon a vote being taken thereon, the following voted in favor thereof: Johnson, Micks, Russell , Thompson and Tremere; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the City Clerk. *RSL 213 - Turnpike Road and Lawn Terrace - Call for Public Hearinq - 12/6/94 Member Johnson introduced the following resolution and moved its adoption: RESOLUTION 94-82 RESOLUTION PROVIDING FOR PUBLIC HEARING ON CERTAIN PROPOSED PUBLIC IMPROVEMENTS RSL 213 TURNPIKE ROAD AND LAWN TERRACE The motion for the adoption of the foregoing resolution was seconded by Member Micks and upon a vote being taken thereon, the following voted in favor thereof: Johnson, Micks, Russell , Thompson and Tremere; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the City Clerk. Call for Public Hearing - Minor Subdivision - Valley Square 5th Addition - 12/6/94 Mark Grimes, Director of Planning and Development; introduced the agenda item. MOVED by Johnson, seconded by Russell and motion carried unanimously to call a public hearing to consider a minor subdivision for Valley Square 5th Addtion for December 6, 1994. Authorization to Sign PUD Permit - Amendment #1 - PUD #61 - Dahlberg Commerce Center William Joynes introduced the agenda item. MOVED by Russell , seconded by Thompson and motion carried to authorize the Mayor and City Manager to sign the PUD Permit f or Amendment #1, PUD #61, Dahlberg Commerce Center. Council Member Micks abstained. - - Regular Meeting of the City Council November 15, 1994 Page 6 Announcements of Meetinas The LMC Policy Adoption Meeting will be held on November 18, 1994 Budget Workshops will be held at the City Hall on November 22, 1994 from 5:00 PM to 7:30 PM and November 29, 1994 beginning at 5:30 PM. Council Member Russell updated the Council on the upcoming Cable P�eeting scheduled for November 17, 1994. The Council discussed the city's participation in a pilot program in interactive bulletin board technology. MOVED by Thompson, seconded by Micks and motion carried unanimously to place the item on the December 6, 1994 Council agenda for discussion and action; and requested staff prepare a report on the impact on City if choosen to participate. M�or's Communications - Budqet Worksessions The Mayor requested staff provide the Council with a more detailed business plan and/or marketing plan for the proposed alarm monitoring service. Mayor 's Communications - Attitude Survey The Council discussed the concerns over not receiving the final product from Decision Resources LTD. The Council requested P4ayor Tremere contact Dr. Morris regarding receipt of the final survey. Authorization for Human Riqhts Commission Poster Contest Marion Helland, Human Rights Commissioner, reviewed the propsed poster contest. The Council discussed the contest and made a suggestion for the Human Rights Commission to consider, including participation by all children in K-5 by both Robbinsdale and Hopkins school districts, Olson Elementary, and notification of other students by the newsl etter. ,��,,, �� Marion Helland will review the discussion with the Human Rights Commisison and report back to the Council . Human Services Foundation and Civil Service Commission Appointments Mayor Tremere stated he was unable to contact the appropriate parties and requests the item be delayed until the December 12, 1994 Council Meeting.
