06-20-95 CC Minutes unsigned Regular Meeting of the City Council June 20, 1995 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Golden Valley, Hennepin County, Minnesota was held at 7800 Golden Valley Road in said City on June 20, 1995 at 6:30 PM. The following members were present: Johnson, Micks, Thompson and Tremere; and the following members were absent: Russell. Also present were: William Joynes, City Manager; Allen Barnard, City Attorney; and Judy Nally, Administrative Secretary. Approval of Minutes� Council/Manager Meeting - April 4 1995 and City Council Meeting - April 4, 1995 The minutes will be approved at the next meeting. Approval of Aaenda MOVED by Johnson, seconded by Micks and motion carried unanimously to approve the agenda of June 20, 1995 as amended: Addition of Manager's Item - New 60 Day Time Limit for Planning Approval Process. William Joynes and Fred Salsbury, Director of Public Works; answered questions from the Council. MOVED by Tremere, seconded by Johnson and motion carried unanimously to receive and file the April 20 and May 18, 1995 Bassett Creek Water Management Commission minutes. *Call for Public Hearing - Rezonina to Two-Family (R-2) Residential Zoning District - 1511- 1_521 Xerxes Avenue North - 7/11/95 MOVED by Thompson, seconded by Johnson and motion carried unanimously to call for a public hearing to consider rezoning 1511-1521 Xerxes Avenue North from single-family residential zoning district to two-family (R-2) residential zoning district for July 11, 1995. Public Hearing - Second Consideration - Ordinance #132 - Conditional Use Permit - 710 Pennsylvania Avenue South The following ordinance was MOVED by Johnson, seconded by Thompson: ORDINANCE #132, 2ND SERIES AN ORDINANCE AMENDING THE CITY CODE Approval of Conditional Use Permit No. 95-66 710 Pennsylvania Avenue South Dent Kraft Plus Inc., Applicant William Joynes introduced the agenda item. Allen Barnard answered questions from the CounciL Don Cavanaugh, Dent Kraft Plus, Inc., reviewed the operation of the repair shop and stated there is very little noise associated with their operation. The Mayor opened the meeting for public input and persons present to do so were afforded the opportunity to express their views thereon. Hearing and seeing no one, the Mayor closed the public hearing. MOVED by Johnson, seconded by Thompson and motion carried unanimously to adopt Ordinance #132, 2nd Series. Upon a roll call vote, the vote was as follows: JOHNSON - YES MICKS - YES RUSSELL -ABSENT THOMPSON - YES TREMERE - YES Regular Meeting of the City Council June 20, 1995 Page 4 *Letter from Rick Groger Requesting Extension of Deadline for Submittal of CommunitX Standards Task Force Report MOVED by Thompson, seconded by Johnson and motion carried unanimously to receive and file the letter from Rick Groger, dated May 31, 1995; and extend the deadline for submittal of the Community Standards Task Force Report until November 1, 1995. *A�proval of Requests for Beer and/or Wine at Brookview Park MOVED by Thompson, seconded by Johnson and motion carried unanimously to approve the requests for beer and/or wine at Brookview Park as recommended by staff. *Authorization to Sign Contract with State for Inspection of State Licensed Facilities MOVED by Thompson, seconded by Johnson and motion carried unanimously to authorize the City Manager to sign the contractual agreement between the City, State of Minnesota, Department of Administration Building Codes and Standards Division to provide plan review and inspections or only inspections on a project-by-project basis for state licensed facilities within the city through June 30, 1996. *Call for Feasibility Study - 94 SI 11 - Sandburg Lane, Medicine Lake Road to Sandburq Road Member Thompson introduced the following resolution and moved its adoption: RESOLUTION 95-53 RESOLUTION ORDERING PREPARATION OF REPORT ON IMPROVEMENT 94 S I 11 SANDBURG LANE, MEDICINE LAKE ROAD TO SANDBURG ROAD The motion for the adoption of the foregoing resolution was seconded by Member Johnson and upon a vote being taken thereon, the following voted in favor thereof: Johnson, Micks Thompson and Tremere; and the following was absent: Russell; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the City Clerk. Regular Meeting of the City Council � June 20, 1995 Page 5 *Call for Public Hearinq - 94 SI 11 - Sandburg Lane, Medicine Lake Road to Sandburg Road - 7/18/95 Member Thompson introduced the following resolution and moved its adoption: RESOLUTION 95-54 RESOLUTION PROVIDING FOR PUBLIC HEARING ON CERTAIN PROPOSED PUBLIC IMPROVEMENT 94 S I 11 SANDBURG LANE, MEDICINE LAKE ROAD TO SANDBURG ROAD The motion for the adoption of the foregoing resolution was seconded by Member Johnson and upon a vote being taken thereon, the following voted in favor thereof: Johnson, Micks, Thompson and Tremere; and the following was absent: Russell; and the following voted against the same: none; whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the City Clerk. *Call for Public Hearinq - No Parking Restrictions - Portions of Colonial Road - 7/11/95 MOVED by Thompson, seconded by Johnson and motion carried unanimously to call a public hearing to consider no parking restrictions on the north side of Colonial Road, between Jersey Avenue South and Louisiana Avenue South for July 11, 1995. *Bids - 94 SI 9 - Jersey Avenue. Laurel Avenue to Glenwood Avenue MOVED by Thompson, seconded by Johnson and motion carried unanimously to award the bid for 94 SI 9 to the lowest responsible bidder, Valley Paving for $496,782.61. The bids were as follows: Valley Paving $496,782.61 Hardrives, Inc. 521,396.20 Midwest Asphalt 530,563.11 C. S. McCrossan 542,087.06 Driveway Design 550,594.35 Road Maintenance - Reconstruction William Joynes reviewed the Pavement Management Policy and read the section pertaining to maintenance and answered questions from the Council. MOVED by Micks, seconded by Johnson and motion carried unanimously to direct staff to fill the potholes on Culver Road because the public hearing was held prior to adoption of the Pavement Management Policy. Staff was requested to prepare a pamphlet and/or handout that explains the Pavement Management Policy for distribution prior to informational meetings and/or public hearings. Regular Meeting of the City Council June 20, 1995 Page 6 New 60 Day Time Limit for Planning Approval Process William Joynes and Allen Barnard reviewed the memo distributed by the City Attorney, and the impact the new Statute will have on the City and answered questions from the Council. Linda Loomis, League of Women Voters Representative, was at the meeting and available to answer questions. MOVED by Micks, seconded by Johnson and motion carried unanimously to direct staff to 1) authorize the staff to call public hearings when it sets your meeting agendas; thereby eliminating one Council consideration of a zoning request; 2) authorize the planning staff to send letters denying zoning requests where the fee has not been paid and authorizing staff to extend the deadline for city action for an additional 60 days if necessary and/or if requested by the applicant; and 3) authorize staff to advise applicants in writing if the information supplied by the party requesting the approval is insufficient or if the Planning Commission requires more information or studies which are provided for by ordinance. It was the Councils intent that if an application is submitted to the Council that would require action the Council would defer to the new state legislation and hold both considerations at one meeting. The Council will hold the continued public hearing for second consideration of Ordinance #131 on July 18, 1995 and wait for the report from the League of Women Voters. Staff will review the following items and recommend ordinance changes, as outlined in the city attorney's memo, and provide the report to the Council at their July 11, 1995 meeting: 1) Revise city procedure to provide for one formal public hearing on zoning and related matters before the Planning Commission and an informal public hearing before the City Council. 2) Whether the existing PUD process can be considered as two separate approvals: the preliminary design stage requires one set of information and the general plan approval stage requires a more complete set of information 3) The staff could have the PUD permit ready for approval at the same meeting that the Council considers the PUD general plan approval. Regular Meeting of the City Council June 20, 1995 Page 7 Announcements of Meetings A discussion will be held covering the impact of the federal budget custs to the state on June 29 in Room 130 at the State CapitaL The City will hold the Community Open House and Grand Opening Celebration on Wednesday, June 21, 1995. Activities include - Winnetka Avenue Grand Opening and Ribbon Cutting Ceremony at 3:00 PM, Golden Valley Post Office Ground Breaking Ceremony at 3:30 PM; and the Public Safety Building Dedication and Grand Opening at 4:00 PM. The Housing and Redevelopment Authority Meeting will be held on June 27, 1995 at 6:30 PM. Mayor and Council Communications No action taken.
