10-17-95 CC Minutes unsigned Regular Meeting of the City Council October 17, 1995 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Golden Valley, Hennepin County, Minnesota was held at 7800 Golden Valley Road in said City on October 17, 1995 at 6:30 PM. The following members were present: Johnson, Micks, Russell, Thompson and Tremere. Also present were: William Joynes, City Manager; Allen Barnard, City Attorney; and Judy Nally, Administrative Secretary. Approval of Agenda MOVED by Russell, seconded by Micks and motion carried unanimously to approve the agenda of October 17, 1995 as amended: Addition of Manager's Items - Approval of Schaper Property Environmental Assessment Worksheet for Distribution to the Environmental Quality Board, and Mayor and Council Item - Set Dates for Budget Workshop and Reset Canvassing Board Meeting Time. A�proval of Consent Agenda MOVED by Micks, seconded by Johnson and motion carried unanimously to approve the items on the consent agenda, indicated by an asterisk (*). *Bills and Claims MOVED by Micks, seconded by Johnson and motion carried unanimously to authorize payment of the bills as submitted. *General Business and Heating Licenses MOVED by Micks, seconded by Johnson and motion carried unanimously to authorize the issuance of license #15680. *Gambling License Exem�tion - Good Shepherd Catholic Church MOVED by Micks, seconded by Johnson and motion carried unanimously to receive and file the gambling license exemption for the Good Shepherd Catholic Church. *Peddler's License - Girl Scout Council of Greater Minneapolis ,VIOVED by Micks, seconded by Johnson and motion carried unanimously to approve the peddler's license for the Girl Scout Council of Greater Minneapolis. Off Sale Liquor License - Golden Valley L�i uor Barrel. Inc. d/b/a Lic�uor Barrel William Joynes introduced the agenda item. Allen Barnard answered questions from the Council. Mel Henry, Applicant, answered questions from the Council. MOVED by Micks, seconded by Thompson and motion carried unanimously to approve the off-sale liquor license for Golden Valley Liquor Barrel, Inc. d/b/a Liquor Barrel at their new location of 7890 Olson Memorial Highway effective October 30, 1995. *Minutes of Boards and Commissions MOVED by Micks, seconded by Johnson and motion carried unanimously to receive and file the minutes received as follows: Community Standards Task Force - September 27, 1995 Human Services Foundation - October 19, 1995 Public Hearina - Ordinance #137 - Conditional Use Permit - 9405 Medicine Lake Road The following ordinance was MOVED by Russell, seconded by Johnson: ORDINANCE NO. 137, 2ND SERIES AN ORDINANCE AMENDING THE CITY CODE APPROVAL OF CONDITIONAL USE PERMIT NO. 95-67 9504 MEDICINE LAKE ROAD Marcelliono Hark, Applicant Mark Grimes, Director of Planning and Development; introduced the agenda item. Marcelliono Hark, Applicant, reviewed the plans for the site and answered questions from the Council. Regular Meeting of the City Council October 17, 1995 Page 3 Public Hearing - Ordinance #137 - Conditional Use Permit - 9405 Medicine Lake Road - Continued MOVED by Tremere, seconded by Micks and motion carried unanimously to add a condition to the ordinance: Petitioner shall provide a copy of the easement agreement to the City of Golden Valley no later than December 15, 1995. MOVED by Johnson, seconded by Johnson and motion carried unanimously to adopt Ordinance #137, 2nd Series, as amended. Upon a roll call vote, the vote was as follows: JOHNSON - YES MICKS - YES RUSSELL - YES THOMPSON - YES TREMERE - YES Participation in the Local Housing Incentives Account Proqram Under the Metropolitan Livable Communities Act William Joynes introduced the agenda item. Mark Grimes, Director of Planning and Development answered questions from the Council. Member Thompson introduced the following resolution and moved its adoption: RESOLUTION 95-73 RESOLUTION ELECTING TO PARTICIPATE IN THE LOCAL HOUSING INCENTIVES ACCOUNT PROGRAM UNDER THE METROPOLITAN LIVABLE COMMUNITIES ACT (CALENDAR YEAR 1996) The motion for the adoption of the foregoing resolution was seconded by Member Johnson and upon a vote being taken thereon, the following voted in favor thereof: Johnson, Micks, Russell, Thompson and Tremere; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the City Clerk. *Receipt of September. 1995 General Fund Bud.eq t Report MOVED by Micks, seconded by Johnson and motion carried unanimously to receive and file the September, 1995 General Fund Budget Report. Regular Meeting of the City Council October 17, 1995 Page 4 Approval of Schaper Property Environmental Assessment Worksheet for Distribution to the Environmental Quality Board Allen Barnard reviewed the procedure and answered questions from the Council. MOVED by Micks, seconded by Russell and motion carried unanimously to approve the release of the Environmental Assessment Worksheet for the Schaper Property for distribution by the responsible governing unit to the Environmental Quality Board. Staff was requested to change the cover of the official copies of the Environmental Assessment Worksheet, removing "proposed ballfields". Announcements of Meetings The League of Women Voters Candidate Forum will be held on October 25, 1995 beginning at 7:00 PM in the Council Chambers. The Covenant Manor Candidate Forum will be held at 3:00 PM at Covenant Manor. The Metropolitan Council, elected officials and city staff will be holding a bus tour on October 23, 1995 beginning at 8:30 AM at the Nicolett Island Inn. Mark Grimes, Director of Planning and Development updated the Council on the tour route and answered questions. The Association of Metropolitan Municipalities Policy Adoption Meeting is scheduled for November 2, 1995. Hoakins School District 270 Presentation - David ShapleX David Shapley, Hopkins School District #270's Director of Business Services, updated the Council on the school district's levy referendum, background on the referendum, including program improvements, polling places, tax impacts, wording on the ballot, and answered questions from the Council. *Request by Human Services Foundation to Send Solicitation Letters to Businesses MOVED by Micks, seconded by Johnson and motion carried unanimously to approve sending out a solicitation letter to the businesses of Golden Valley. Regular Meeting of the City Council October 17, 1995 Page 5 Registration for Leaaue of Minnesota Cities Policy Adoption Meetinq Mayor Tremere requested the Council notify staff if they plan on attending the LMC policy adoption meeting scheduled for November 17, 1995. Se# Dates for Budget Workshop and Reset Canvassing Board Meeting Time The Council reviewed their calendars and discussed the dates and process for the budget workshop. MOVED by Russell, seconded by Tremere and motion carried unanimously to reset the Canvassing Board Meeting time to 6:30 PM and set the budget workshop for November 8, 1995, immediately following the Canvassing Board Meeting (6:45 PM).
