Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of
Golden Valley, Hennepin County, Minnesota was held at 7800 Golden Valley Road in said
City on February 6, 1996 at 6:30 p.m.
The following members were present: Anderson, Johnson, LeSuer, Micks and Russell.
Also present were: William Joynes, City Manager; Fred Salsbury, Director of Public Works;
Allen Barnard, City Attorney; and Judy Nally, Administrative Secretary.
Approval of Minutes: City Council Meeting - January 16 1996
MOVED by Micks, seconded by Russell and motion carried unanimously to approve the
City Council meeting minutes of January 16, 1996 as submitted.
Approval of Agenda
MOVED by Johnson, seconded by Russell and motion carried unanimously to approve the
agenda of February 6, 1996 as amended: Petition from Ottawa Avenue South Residents
Regarding Street Improvement Program.
Approval of Consent Agenda
MOVED by Russell, seconded by Johnson and motion carried unanimously to approve the
items on the consent agenda, indicated by an asterisk (*) as amended: Removal of
Departmental Item - Setting the Employee Mileage Reimbursement Rate and Employee
Car Allowances Consistent with IRS Rules.

The motion for the adoption of the foregoing resolution was seconded by Member Johnson

whereupon said resolution was declared duly passed and adopted, signed by the Mayor

the opportunity to express their views thereon. Hearing and seeing no one, the Mayor
closed the public hearing.

Mayor Anderson introduced the agenda item and reviewed the procedure for consideration
of the street improvement program. Fred Salsbury will present each of the individual street
projects. William Joynes, Allen Barnard and Jeff Oliver, Assistant Engineer; were available
to answer questions.

MOVED by Russell, seconded by LeSuer and motion carried to bring 95 SI 2 - Ottawa
Avenue South, Glenwood Avenue to Circle Down on the table for consideration.
The Mayor opened the meeting for public input and persons present to do so were afforded
the opportunity to express their views thereon.
John Galvin, 609 Ottawa Avenue South, signed the petition for a 24 foot street, doesn't
understand why parking has to be removed on only a portion of the street, opposed to the
parking ban, feels there is barely any traffic now, feels the road is a little bit deteriorated,
and suggested the project be put off to another date.
Joe Breimayer, 4700 Circle Down, asked why parking isn't prevented now, asked what
happens during the street reconstruction process that makes parking on Ottawa not
acceptable now, and asked if they are any streets that are 20' that allow parking on both
sides.
Tim Scott, 501 Ottawa Avenue South, stated he lives in the middle of the street, lives on a
steep incline, expressed concern that with the parking ban his guests will have to walk up
the hill and may slip and/or fall and asked who would be responsible, suggested that
parking be allowed at least on one side of the street, feels that other areas of the City have
retaining walls where needed, why not there; asked about different types of curbing and
are there options, feels the parking ban may affect his property values, suggested
narrowing the street to the necessary width and widen other sections of the street, and
mark that area with posts for snow plowing purposes.

Cynthia Kivo, 417 Ottawa Avenue South, stated if the road is widened an easement would
probably be needed from them and she doesn't want to give up any more of their yard,
doesn't have a need for on -street parking, suggested that residents get permission to bag
the no parking signs when needed; and expressed concern over the size of the
replacement trees.
Ed Phillips, 601 Ottawa Avenue South, opposed to parking ban, doesn't want the parking
they have had for 26 years taken away, feels that bagging of signs is ridiculous; requested
the Council review the project and hold off doing anything until they have time to look at
their street, and suggested reconsidering it at the next meeting.
John Digioia, 433 Ottawa Avenue South, asked what the costs would be to expand the
roadway on the west side of the street if that's what it takes to have parking.
The Mayor closed the public hearing.
MOVED by Micks, seconded by Johnson and motion carried to table Resolution 96-19,
Resolution Ordering Certain Proposed Public Improvements and Authorizing Advertising
for Bids - 95 SI 2 - Ottawa Avenue South, Glenwood Avenue to Circle Down, until the
February 20, 1996 Council Meeting at 6:30 p.m. Mayor Anderson voted no.
The Council did not consider Resolution 96-27, Resolution Restricting Parking on Portions
of Ottawa Avenue South.

The Mayor opened the meeting for public input and persons present to do so were afforded
the opportunity to express their views thereon.
Joe Breimayer, 4700 Circle Down, asked for clarification of why there is a recommendation
banning street parking on this street, asked what the City can do about the quality of street
repairs done by MnDOT, and about the elevation of the street.
John Galvin, 609 Ottawa Avenue South, asked questions about the running water near the
retaining wall, and asked if this will affect the wall.

MOVED by Russell, seconded by LeSuer and motion carried to bring 95 SI 4 - Sunset
Ridge, Natchez Avenue South to Ravine Trail on the table for consideration.
The Mayor opened the meeting for public input and persons present to do so were afforded
the opportunity to express their views thereon.
Marvin Lind, 4505 Sunset Ridge, opposed to removal of parking on the street, asked about
the vacating of Sumac Road, stated his property abuts Sumac Road and he uses the street
for parking, asked about the continued use if Sumac Road is vacated, can they still park
there and will it be maintained.
Jim Albright, 4505 Sunset Ridge, stated he parks on Sumac Road and wanted to know if
the street is vacated, would he still be able to park there as it is a hardship for him to walk
up stairs.

Maxine Heinitz, 108 Natchez Avenue South, had questions about the water collection and
drainage on the street, is concerned over the silting of Strawberry Pond, and expressed
concern over the removal of the oak tree at 4414 Sunset Ridge which is very old and
asked if the tree could be saved.
Jim Breimayer, 4700 Circle Down, stated that parking is permitted now, cars park on both
sides and he has not heard or seen a problem parking on both sides.
Tim Scott, 501 Ottawa Avenue South, sister lives at 4609 Sunset Ridge, feels its not
necessary to take away the parking and doesn't want parking on one side of the street.
The Mayor closed the public hearing.
Member Johnson introduced the following resolution and moved its adoption:

MOVED by Johnson, seconded by Micks and motion carried to request staff to contact the
property owner (4414 Sunset Ridge) with the intent of attempting to preserve the tree and
give her that option with the blessing of the Council. Council Member Russell voted no.

Harry Hauck, 1100 Tyrol Trail, submitted a petition from residents on North Tyrol Trail,
distributed a handout. on projected rehabilitation costs and reviewed the handout, asked
what are the city costs for maintenance, suggested a street asphalt overlay would work
fine, doesn't feel the road should be reconstructed, doesn't like installation of curb and
gutter, had questions about the corner design at Tyrol Trail and Parkview Terrace, and
stated the neighborhood would like it left the way it is.
Joe Breimayer, 4700 Circle Down, asked which streets in the North Tyrol area have curb
and gutter and which do not, feels residents moved into the neighborhood because there
was not curb and gutters, that people like the rural appearance, feels the question is how
do you want the neighborhood to look - not how long will the street last.
Joan Lancaster, 1031 Tyrol Trail North, feels the street still has some life in it and it is very
expensive to change it at this point, and doesn't want the aesthetic changes, stated there
is hardly any traffic and speeding is not a problem.
Richard Peet, 3245 Noble Avenue North, suggested that staff provide the Council with
information as to the benefit of curb and gutter, how an S shaped curb or the absence of
curb is detrimental to the reconstruction of a street.
Luther Frank, 400 Natchez Avenue South, asked what is the percentage of people who
signed the petition to delay or terminate the plans for the proposed reconstruction of North
Tyrol Trail.

The Mayor opened the meeting for public input and persons present to do so were afforded
the opportunity to express their views thereon.
Morton Silverman, 8 Natchez Avenue South, asked who is requesting the street be
widened, and stated that he has not seen any problem with the street width of 24 feet.
Max Weitz, 100 Natchez Avenue South, doesn't feel the road reconstruction is necessary,
feels the street is in good shape and submitted a petition from area residents objecting to
the proposed public improvement, and asked questions about the elevation of the street.
Joel Lavintman, 7329 Ridgeway Road, speaking on behalf of his mother Myrl Lavintman,
316 Natchez Avenue South, expressed concern over the taking of 2 feet from the property,
grade of street and access from street to driveway, feels its an issue of aesthetics, that
most people do not park on the street.
Larry McDonough, 101 Natchez Avenue South, asked questions about the storm sewer
project, doesn't feel the street needs to reconstructed, and would like to see the project
delayed for a few more years.
Maxine Heinitz, 108 Natchez Avenue South, expressed concern over the special
assessment cost; and read letters from the following residents who are opposed to the
project and submitted them to be added to the record: Charlotte Blodgett, 601 Natchez
Avenue South; Amy Nguyen, 518 Natchez Avenue South; and Mary Spoke, 604 Natchez
Avenue South.
Peggy Breimayer, 4700 Circle Down, feels the streets do need to be taken care of and kept
up and feels the property values are being affected by run-down looking streets.

Sandy Satz, 308 Natchez Avenue South, feel the street doesn't need to be reconstructed,
that there are other streets in the city that need it more, the width of the street has never
been an issue, and parking should be allowed on both sides.
Steve Mendel, 4625 Glenwood Avenue, doesn't feel the street reconstruction is needed,
stated there is no drainage problem, most people do not park on the street, objects to the
installation of curb, gutter and sidewalks, and requests the Council table the project.
Brian Morgan, 108 Natchez Avenue South, can see the need for some type of gutter, feels
you don't need a lot of concrete for gutters, objects to the removal of parking, the
installation of no parking signs, feels the street reconstruction is not needed and thinks the
neighborhood should be preserved.
Richard Peet, 3245 Noble Avenue North, stated he has reviewed the Pavement

aesthetics, feels the Council should decide the width of the street, not the engineering
department, and the code sections relative to vegetation in the right-of-way should be
repealed.

Adoption of Investment Policy
William Joynes introduced the agenda item. Don Taylor, Finance Director; reviewed the
policy and answered questions from the Council.
MOVED by Johnson, seconded by Micks and motion carried unanimously to adopt the
Investment Policy, dated February, 1996.
Proposed Code Revisions - Community Standards Task Force
William Joynes introduced the agenda item.
MOVED by Russell, seconded by LeSuer and motion carried unanimously to direct staff to
prepare a list of proposed code revisions related to the work of the Community Standards
Task Force and suggest a process for public input, comment and adoption of the proposed
revisions, such list and process to be brought back to the City Council before proceeding
with legal drafting of the proposed code provisions.
Mayor Anderson will send a letter to the Community Standards Task Force and inform
them of the City Council action.

`Bids - Fairway Mower
MOVED by Russell, seconded by Johnson and motion carried unanimously to purchase a
fairway mower, with groomers from Northstar Turf for $35,020.40. Staff chose Northstar
Turf because the MTI unit did not meet specifications. The bids are as follows:

Announcements of Meetings
Mayor Anderson, Council Members Johnson and LeSuer; along with Walter Gray, Black
History Chair, will attend the Human Rights Commission on February 8, 1996 to review the
relationship between the Black History Committee and Human Rights Commission. Mayor
Anderson stated that some of the Black History events were canceled because the
Committee was unable to raise the corporate funds needed for the program.
Mayor Anderson and Council Member LeSuer will meet with the Planning Commission on
February 12, 1996. Mayor Anderson and Council Member LeSuer will meet with Bill
Joynes and Mark Grimes, Director of Planning and Development on February 9, 1996 at
10:00 a.m.
Mayor Anderson will meet with Linda Loomis, Chair, Open Space and Recreation
Commission, William Joynes and Rick Jacobson, Director of Parks and Recreation on
February 9, 1996 at 11:00 a.m. to prepare for the joint meeting with the Open Space and
Recreation Commission.
Mayor Anderson, Council Member LeSuer, and William Joynes will meet on February 14,
1996 at 12:00 noon with the Cities of Hopkins, Minnetonka and the Hopkins School District.
Mayor Anderson requested that the Council notify staff if they plan on attending the Caring
Youth Program on February 15, 1996 at 7:00 p.m.
Mayor Anderson will attend the Livable Communities Workshop on February 16, 1996.
