07-02-96 CC minutesRegular Meeting of the City Council July 2, 1996 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Golden Valley, Hennepin County, Minnesota was held at 7800 Golden Valley Road in said City on July 2, 1996 at 6:30 p.m. The following members were present: Anderson, Johnson, LeSuer, Micks and Russell. Also present were: Jeanne Andre, Assistant to the Manager; Fred Salsbury, Director of Public Works; Allen Barnard, City Attorney; and Judy Nally, Administrative Secretary. Citizen Input Mayor Anderson introduced the agenda item. Hearing and seeing no one, the Council continued the meeting. Letter from Charles Clark Regarding Ordinance #146 MOVED by Russell, seconded by LeSuer and motion carried unanimously to receive and file the letter from Charles Clark, dated June 25, 1996 regarding Ordinance #146. Approval of Minutes: City Council Meeting - June 18 1996 MOVED by Russell, seconded by Johnson and motion carried unanimously to approve the City Council Meeting minutes of June 18, 1996 as submitted. MOVED by Johnson, seconded by Russell and motion carried unanimously to approve the agenda of July 2, 1996 as amended: Open Forum/Communication Item - Addition of Letter from Charles Clark Regarding Ordinance #146; and Departmental Item - Ratifiy Emergency Installation of Stop Signs on Boone Avenue North at 10th Avenue North 96-61. Approval of Consent Agenda MOVED by Russell, seconded by Johnson and motion carried unanimously to approve the items on the consent agenda, indicated by an asterisk. Regular Meeting of the City Council July 2, 1996 Page 2 *General Business and Heating Licenses MOVED by Russell, seconded by Johnson and motion carried unanimously to authorize the issuance of general business licenses #16123 - #16127 and #6839 - #6842. *Peddler's License - Inventive Advertising Inc MOVED by Russell, seconded by Johnson and motion carried unanimously to authorize the issuance of a peddler's license to Inventive Advertising Inc. *Gambling License Exemption and Waiver of Notice Requirement - North Memorial Medical Center MOVED by Russell, seconded by Johnson and motion carried unanimously to receive and file the gambling license exemption and approve the waiver of notice requirement for North Memorial Medical Center. *Taxi Driver Licenses MOVED by Russell, seconded by Johnson and motion carried unanimously to approve the taxi driver licenses as recommended by staff. *Minutes of Boards and Commissions MOVED by Russell, seconded by Johnson and motion carried unanimously to receive and file the minutes received as follows: Human Rights Commission - May 9, 1996 Planning Commission - June 10, 1996 Bassett Creek Water Management Commission - May 16, 1996 Public Hearing -Ordinance #146 - Conditional Use Permit - 5400 Glenwood Avenue North The following ordinance was MOVED by Russell, seconded by LeSuer: ORDINANCE #146, 2ND SERIES AN ORDINANCE AMENDING THE CITY CODE Approval of Conditional Use Permit No. 96-69 5400 Glenwood Avenue North Minneapolis Crisis Nursery, Applicant Mark Grimes, Director of Planning and Development, introduced the agenda item. Regular Meeting of the City Council July 2, 1996 Page 3 Public Hearing - Ordinance #146 - Conditional Use Permit - 5400 Glenwood Avenue North Continued Emilie Johnson, Planning Commission Representative, presented the Commission report. Connie Skillingstad, Executive Director, Minneapolis Crisis Nursery, reviewed the plans for the nursery and answered questions from the Council. The Mayor opened the meeting for public input and persons present to do so were afforded the opportunity to express their views thereon. Elizabeth Gardner, Northwest Hennepin Human Services Council, stated the Council supports approval of the nursery and stated there is a need for their services in the suburbs. The Mayor closed the public hearing. MOVED by Russell, seconded by LeSuer and motion carried unanimously to approve Ordinance #146, 2nd Series. Upon a roll call vote, the vote was as follows: ANDERSON - YES JOHNSON - YES LESUER - YES MICKS - YES RUSSELL - YES Public Hearing -Ordinance #147 - Special Provisions For (PUD's) Planned Unit Developments Involving Multiple Parcels The following ordinance was MOVED by Johnson, seconded by Russell: ORDINANCE #147, 2ND SERIES AN ORDINANCE AMENDING THE CITY CODE Chapter 11, Land Use Regulation (Zoning) Adding Special Provision for Planned Unit Develoments (PUD's) Involving Multiple Parcels Allen Barnard and Mark Grimes, Director of Planning and Development reviewed the amendment and answered questions from the Council. Emilie Johnson, Planning Commission Representative, presented the Commission report. The Mayor opened the meeting for public input and persons present to do so were afforded the opportunity to express their views thereon. Hearing and seeing no one, the Mayor closed the public hearing. Regular Meeting of the City Council July 2, 1996 Page 4 Public Hearing -Ordinance #147 - Special Provisions For (PUD's) Planned Unit Developments Involving Multiple Parcels - Continued MOVED by Johnson, seconded by Russell and motion carried unanimously to table consideration of the item until the August 7, 1996 Council Meeting. ANDERSON - YES JOHNSON - YES LESUER - YES MICKS - YES RUSSELL - YES *Approval of Requests for Beer and/or Wine at Brookview Park MOVED by Russell, seconded by Johnson and motion carried unaimously to approve the requests for beer and/or wine at Brookview Park as recommended by staff. Authorize Justification Study and Traffic Signal Design for 10th Avenue North and Boone Avenue North Fred Salsbury introduced the agenda item. MOVED by Micks, seconded by Johnson and motion carried unanimously to authorize the City Engineer to retain a traffic consultant to undertake a traffic justification study, and if justified, to prepare plans and specifications for traffic signals at 10th Avenue North and Boone Avenue North. Ratify Emergency Installation of Stop Signs on Boone Avenue North at 10th Avenue North 96-61 Fred Salsbury introduced the agenda item. Member Johnson introduced the following resolution and moved its adoption: RESOLUTION 96-61 RESOLUTION AUTHORIZING INSTALLATION OF STOP SIGNS ON BOONE AVENUE NORTH AT 10TH AVENUE NORTH The motion for the adoption of the foregoing resolution was seconded by Member Micks and upon a vote being taken thereon, the following voted in favor thereof: Anderson, Johnson, LeSuer, Micks and Russell; and the following voted against the same: none; whereupon said resolution was declared duly passed and adopted, signed by the Mayor and her signature attested by the City Clerk. Regular Meeting of the City Council July 2, 1996 Page 5 *Call for Feasibility Study - RSL 217 - Perry Avenue North and Culver Road Member Russell introduced the following resolution and moved its adoption: RESOLUTION 96-59 RESOLUTION ORDERING PREPARATION OF REPORT ON IMPROVEMENT RSL 217 PERRY AVENUE NORTH AND CULVER ROAD The motion for the adoption of the foregoing resolution was seconded by Member Johnson and upon a vote being taken thereon, the following voted in favor thereof: Anderson, Johnson, LeSuer, Micks and Russell; and the following voted against the same: none; whereupon said resolution was declared duly passed and adopted, signed by the Mayor and her signature attested by the City Clerk. *Call for Public Hearing - RSL 217 - Perry Avenue North and Culver Road - 8/7/96 Member Russell introduced the following resolution and moved its adoption: RESOLUTION 96-60 RESOLUTION PROVIDING FOR PUBLIC HEARING ON CERTAIN PROPOSED PUBLIC IMPROVEMENTS RSL 217 PERRY AVENUE NORTH AND CULVER ROAD The motion for the adoption of the foregoing resolution was seconded by Member Johnson and upon a vote being taken thereon, the following voted in favor thereof: Anderson, Johnson, LeSuer, Micks and Russell; and the following voted against the same: none; whereupon said resolution was declared duly passed and adopted, signed by the Mayor and her signature attested by the City Clerk. Announcements of Meetings HRA Chair Johnson stated there will be a Special Housing and Redevelopment Meeting on July 16, 1996 at 5:30 pm. The AMM Breakfast Meeting is on July 16, 1996 at 7:30 am in Brooklyn Park. The Metropolitan Council will be holding a Growth Options Electronic Focus Group Meeting on July 10, 1996 from 7:00 - 9:00 pm at the Minnetonka Community Center. Regular Meeting of the City Council July 2, 1996 Page 6 Announcements of Meetings - Continued Mayor Anderson stated the Hopkins School District will be holding a Celebration of Partnerships on September 26, 1996 from 6:00 pm to 7:00 pm at the Lindberg Center. Council Members LeSuer and Micks stated they will attend. Mayor and Council Communications Mayor Anderson updated the Council on the Highway 100 Council she attended. The Council discussed possible locations within the City for an informational meeting to be held by MnDOT, including Brookview Community Center, Sandburg Middle School, Breck School, Prudential, and the Minnesota Arts High School. Mayor Anderson will inform the Council staff of suggested locations. Mayor Anderson read an announcement from the Director of Public Works/City Engineer regarding the proposed 1-394 overlay and sound barrier project scheduled for this fall. Discussion of Street Reconstruction Tour Jeanne Andre introduced the agenda item. MOVED by Russell, seconded by Micks and motion carried unanimously to conduct a street reconstruction tour on Wednesday, August 7, 1996 at 9:30 am. The Council will hold a Special Council/Manager Meeting on August 7, 1996 at 4:00 pm to discuss the street reconstruction program.
