12-09-97 Special Meeting Minutes unsigned Special Meeting of the City Council December 9, 1997 Pursuant to due call and notice thereof, a special meeting of the City Council of the City of Golden Valley, Hennepin County, Minnesota was held at 7800 Golden Valley Road in said City on December 9, 1997 at 7:00 p.m. The following members were present: Anderson, Johnson, LeSuer, Micks and Russell. Also present were: William Joynes, City Manager; Fred Salsbury, Director of Public Works; Allen Barnard, City Attorney, and Judy Nally, Administrative Secretary. Receipt of Letters Reqardinq Pavement Manaaement Proqram MOVED by Johnson, seconded by Russell and motion carried unanimously to receive and file the letters regarding the Pavement Management Program as follows: Letter from Joseph Dundovic, dated November 26, 1997; David Hanson, dated November 26, 1997; Rosemary Marrs, received December 8, 1997; Jerome Unger, November 28, 1997, and Dean and Ruby Van Horn, dated December 5, 1997. Review of Pavement Manaqement Proqram - Bill Jovnes, Citv Manaaer William Joynes previewed the program and background of the program and differences between 1993 and 1997 program. Fred Salsbury reviewed the policy elements and Don Taylor, Finance Director reviewed the financing of the program. Allen Barnard and staff answered the questions throughout the public hearing. Public Hearinq The Mayor opened the meeting for public input and persons present to do so were afforded the opportunity to express their views thereon. Hazel Belvo, 4300 Glencrest Road, feels the power to make a decision on each street program should be made at the neighborhood meetings rather than adopt a policy which ultimately gives the Council the authority, stated the reason she likes her neighborhood is because it doesn't have curb and gutter, likes the character of the neighborhood and doesn't want to see it destroyed. Jerry Mundt, 4212 Poplar Drive, stated that his street was totally reconstructed, and the neighbors also buried their power lines at the same time, feels the process was tremendous, stated that the neighborhood meetings worked very well, feels his property values have doubled and is pleased with how the street came out. Loraine McCarthy, 5900 Westbrook Road, wanted to know more about the testing of the street by staff, wanted to know if the tests are available to the public. Special Meeting of the City Council December 9, 1997 Page 2 Public Hearinq - Continued Frederick Held, 5001 Colonial Drive, stated that the street in front of his house was rebuilt in 1994 by MnDOT and wants to make sure that the street is not disturbed in any way by any proposed road construction and that no assessments or other taxes be levied against his property and submitted a letter for the record. Dale Gerdin, 300 Burntside Drive, stated that 3 or 4 years ago they reconstructed the street in front of his house and feels it was very well done and they are happy with it. Rosemary Marrs, 4840 Markay Ridge, thought there were going to be experts heard from and that didn't, felt they were not heard and not asked for their input. She stated the Concerned Citizens Program is as follows and reviewed each point: 1) use reclamation in stead of reconstruction; 2) asphalt berms should be an option to concrete curb; 3) pay as you go - no bonded debt and no special assessments. Violet Meyer, 35 Natchez Avenue North, stated she disagrees with Ms. Marrs statement, that her street was supposed to be repaved last year and she was terribly disappointed it was not, feels the Council should proceed with the program and hopes her street will be repaved next summer. Ray Stockman, 3125 Quail Avenue North, wanted to encourage the Council to end the moratorium on the street program, wanted to know what the maintenance costs were on the roads that were to have been done, feels it will cost more in future years if the policy is not approved, feels the City has the responsibility to get the water out of the City and that curb and gutter is one of the best ways to accomplish this, asphalt gets damaged by street plows, feels that streets are important to the quality of life, and that it increases the value of the property. Bob Provost, 1429 South Tyrol Trail, supports the proposed policy, feels a major responsibility is professional staff , that staff competency has been a source of good strength to good government and supports the professional commitment to quality in managing our streets and roadways. Jack Terrio, 3139 Orchard Avenue North, said that the city should proceed as he is tired of "mowing" the street, can't go up the other block because in the spring he is tired of the 8" ice ruts, feels that reclamation sounds real good-but won't fix the drainage problems. Paul Johnson, 109 South Meadow Lane, stated he is happy with the street situation as it is but, feels a look at each individual street situation may result in some improvements that will be satisfactory to everyone, showed pictures of streets with asphalt berms, asked how long have the asphalt berms been on Glenwood Avenue, and that the County must think asphalt berm are adequate, asked about the clogging of the storm sewer drains, and feels that maybe concrete curb and gutter may not be the best in some areas. Special Meeting of the City Council December 9, 1997 Page 3 Public Hearinq - Continued Mille LeSar, 3100 Regent Avenue North, asked about the $2,000 assessment if her street only gets an overlay or seal coating and a few years later her street is reconstructed or reclamation process is used, will she have to pay again. Julie Swarze, 2943 Orchard Avenue North, stated they were real excited to get a new street last year and were let down when it didn't happen, and wants to get a new street like Noble Avenue. Sue Mason, Short Elliott Hendrickson (SEH) consultant, explained the visual inspection, soil borings and process for reviewing the individual streets. Dan Cramer, 244 Janalyn Circle, asked when the last time Janalyn Circle and Glencrest Road were repaved, feels that residents should be included in the process and stated he has been to a number of ineetings and feels that the residents feel that they are not involved. Mike Schock, 4316 Glencrest Road, asked staff to clarify what is the length of life of the street if it is reconstructed or reclamation, asked about a report from the City Forester on the impact of the trees on their street. Jerry Roper, 3100 Regent Avenue North, asked about the payment of the $2,000 assessment and asked how the corner lot is assessed. Richard Huntly, 2925 Kyle Avenue North, stated he supports the Council moving ahead with the policy and feels that we should not second guess the professional staff, and would like to see a policy that dictates concrete curb and doesn not looking down the street and seeing some blocks with asphalt berm and some with concrete. David Swarte, 2943 Orchard Avenue North, stated he would like to see the street reconstructed as his son fell off his bike and ended up with stitches, and after a rainfall he has pot holes with water in them for up to 2 weeks. The Mayor closed the public hearing. Special Meeting of the City Council December 9, 1997 Page 4 Public Hearinq - Continued Member LeSuer introduced the following resolution and moved its adoption: RESOLUTION 97-88 RESOLUTION AMENDING THE CITY'S PAVEMENT MANAGEMENT POLICY The motion for the adoption of the foregoing resolution was seconded by Member Russell, and upon a vote being taken thereon, the following voted in favor thereof: Anderson, Johnson, LeSuer, and Russell, and the following voted against the same: Micks, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and her signature attested by the City Clerk. MOVED by LeSuer, seconded by Micks and motion carried unanimously to amend the Pavement Management Policy to affirm that this policy and program invisions to reconstructing or reclamation of the 12 miles of the "worst streets" in a two year period (1998-1999); after that a geographic sector approach will be used and the type of work done on each street will be determined by the condition of the street. MOVED by Micks, seconded by Russell and motion carried unanimously to amend the Pavement Management Policy to request the City Forester to develop an impact statement on trees as streets are proposed for reconstruction. MOVED by Micks, seconded by Johnson and motion carried to amend the Pavement Management Policy to add a statement on considering design criteria of the citizens.
