All bids must be submitted on the basis of cash payment for
the work. No bids will be considered unless sealed, and filed
with the undersigned Clerk before the time of said meeting,
and accompanied by a cash deposit, bid bond, or cashier's
or certified check in the amount of 5% of the amount of the
bid, payable to the Village Clerk, to be forfeited as liq-
uidated damages in the event that the bid be accepted and the
bidder shall fail to enter promptly into a written contract
and to.furnish the required bond. All bidders may bid on
all or any part. of the above work. The •Village reserves.the
right to reject any and all bids or portions of bids and to
waive any informalities in any bid.

3. Each and all of the terms of the foregoing advertisement
for bids are hereby adopted as the terms and conditions of the
award of the contract or contracts for said improvement.

seconded by Member Foss and upon vote being taken thereon the
following voted in favor thereof: Bies, Foss, Buebsch, Rahn
and Stark and the following voted against the same: None,
whereupon said resolution was declared duly passed and adopted
and was signed by the Mayor and his signature attested by the
Clerk.

Member Rahn introduced the following resolution and moved
its adoption:

RESOLUTION PROVIDING FOR PUBLIC del
HEARING ON PROPOSED STREET AND SIDEWALK IM-
PROVEMENT
BE IT RESOLVED by the Village Council of the Village of
Golden Valley, Minnesota, as follows:
1. In conformity with the provisions of Chapter 398,
Session Laws of Minnesota, 19531 this Council proposes to
construct certain sidewalk and street improvement within
the Village as stated in the form of.notice included in
paragraph 4 hereof:

It in a preliminary_.way..,that the proposed sidewalk and street
improvement is feasible and that it should best be made as
proposed and in connection with other improvements ordered
constructed by resoltuion of this Council adopted July 6,
1954, and has given his estimated cost of the improvement as
follows:
For proposed sidewalk and street improvement X50,450.00
3. The Council shall meet at the time and place specified in
the form of notice included in paragraph 4 hereof for the
purpose of holding a public hearing on the proposed street and
sidewalk improvement as described therein.
4. The Clerk is authorized and directed to cause notice of
the time, place, and -purpose of said meeting to.be published
for two successive weeks in the North Hennepin Post, the
official newspaper of the Village, the first of such publi-
cations'to be in the issue of said paper dated July 22, and
the second of said publications to be in the issue of said
paper dated July 29, 1954• Such notice shall be in substanti-
ally the following form:
NOTICE OF PUBLIC HEARING ON PROPOSED
STREET AND SIDEWALK IMPROVEMENT
Notice is hereby given that the Village Council of the Village
of Golden Valley, Hennepin County, Minnesota, will meet on the
3rd day of August, 1954, at 7:30 otclock P.M. at the Village
Hall in said Village, at which time and place a public hearing
will be held on a certain proposed sidewalk and street impro-
vement which will be considered at said public hearing, which
improvement is described below, all in accordance with prelim-
inary plans and estimates now on file in the office of the
Village Clerk,
The Village Engineer estimates that the entire cost of the
improvement will be $50,450.00. The Amprovement is as follows:
Concrete and/or bituminous sidewalk and app-
urtenant street regrading and repaving on the
following described street:
11. As to sidewalk on the east side of Noble Avenue from its

intersection with 29th Avenue North northerly to its inter-
section with 34th Avenue North, and on the west side of Noble
Avenue from its intersection with 29th Avenue North southerly
to its intersection with Ordway; and, as to street repairing
and regrading on Noble Avenue North from 34th Avenue North to
Ordway.
In conducting said public hearing for making its decisions on
the proposed improvement, the Village Council proposes to
proceed under the authority granted by Chapter 3981 Minnesota
Laws.for 1953•
All property within the Village which is benefited by the
improvement is proposed to be assessed for such improvement
as follows: All property abutting on both sides of Noble Avenue
from 34th Avenue North to Ordway, and all property in School
District No. 24 within the Village of Golden Valley or, in the
alternative, the Council will assess the property of School
District No. 24 within the Village consisting of the school
building and premises commonly known as the Noble Avenue
School. All owners of such property are hereby notified to
be present at said public hearing, there to make known their
objections to such improvement if any there be.
