#065 09-07-54 Provide Public Hearing Sewer ImprovementResolution No. 65 September 7, 1954 Member Rahn introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED SEWER IMPROVEMENT BE IT RESOLVED by the Village Council of the Village of Golden Valley, Hennepin County, Minnesota, as follows: e 1. It is hereby found and determined that G. M. Orr Engineering Company, Engineers, have heretofore reported to this Council that several lateral sewer improvements for the Village as hereinafter described is feasible and may best be made as proposed, and that the estimated cost of said improvements to the Village is $878,5OO.00. 2. This Council shall meet at the time and place specified in the form of notice included in paragraph 3 hereof for the purpose of holding a public hearing on the proposed construction of a system of lateral sanitary sewers as therein described. 3. The Clerk is authorized and directed to cause notice of the time, place and purpose of said meeting to be published for two successive weeks, in the North Hennepin Post, being the official newspaper of the Village, the first of such publication to be not less than 10 days and second not less than 3 days prior to the date of said meeting. Such notice shall be in substantially the following form: NOTICE OF PUBLIC HEARING ON PROPOSED SANITARY SEWER IMPROVEMENTS, VILLAGE OF GOLDEN VALLEY, HENNEPIN COUNTY, MINNESOTA. NOTICE IS HEREBY GIVEN THAT THE VILLAGE COUNCIL of the Village of Golden Valley, Hennepin County, Minnesota, will meet on Tuesday, October 5, 1954, at 7:30 o'clock P.M., at the Village Hall in said Village, for the purpose of holding a public hearing on a proposed sanitary lateral sewer improvements in various lateral sewer districts in Sewer District No. 1 and Sewer District No. 2 cE the Village, to serve the northeast portion of the Village and the lateral sewer districts described below and to follow the following course: The lateral sewers will run in all of the public streets and highways in and abutting upon the latex4sewer districts described below and in the case of Lateral Sewer District No. 1-a will run along the Northwest shore of Sweeney Lake as well as run in all the public streets and highways in said lateral sewer district No. 1-a and some of said lateral Sewers in Sewer District No. 1 and 2 will run'over privately owned land. The sanitary sewer lateral improvements are to be located in the lateral sewer districts described below. Each of them will be considered at said public hearing and all are in accordance with preliminary plans and estimates now on file in the office of the Village Clerk. Each of said improvements will be separately 1 1 1 1 1 considered and are separately numbered below. The Engineers for the Villaa estimate that the entire cost of the improvement will be 1 878,500.00. The lateral sewer districts to be improved are as follows: Lateral Sewer District No. 1 (a) Beginning at the intersection of the Minnesota, Northfield & Southern railroad tracks with T. H. No. 100; thence north- easterly along the railroad right-of-way of the Minnesota Northfield and Southern Railway to the intersection of said right-of-way with the right-of-way of the Minnesota Western Railroad; thence westerly along the right-of-way of the Minn- esota Western Railroad to its intersection with Natchez Ave- nue North extended; thence north along Natchez Avenue North extended to Sweeney Lake; thence along the south and west shores of Sweeney Lake to a point on the shore of Sweeney Lake which is 300 feet south of Golden Valley Road; thence westerly to Noble Avenue extended; thence southerly to St. Croix Avenue extended; thence westerly approximately 165 feet north of the center line of St. Croix Avenue to Regent Avenue extended; thence south 350 feet; thence westerly to Toledo Avenue; thence southwest to T. H. No. 100; thence south along trunk highway No. 100 to point of beginning. Lateral Sewer District No. 1(b) All of the land east of France Avenue North lying north and east of the right-of-way of the Great Northern Railway and north of the southerly boundary of the west one-half (W2) of Section 17, Township 290 Range 24, and including specifi- cally, but not exclusively, the following platted areas: Delphian Heights, Delphian Heights 2nd Unit, Delphian Heights 3rd Unit, and McNair Manor. Lateral Sewer District No. 1(c) 1. Noble Grove, including any and all public streets located in or abutting on Noble Grove. 2. Golden Valley Gardens, including any and all public streets located in or abutting on Golden Valley Gardens. 3. Woodlawn Park, including any and all public streets located in or abutting on Woodlawn Park and including aloe the property south of Culver Road as said Culver Road abuts on Woodlawn Park, whether or not said property be located in Woodlawn Park. 4. That part of Yale Garden homes which lies easterly of Regent Avenue, but also including the property abutting on Regent Avenue lying west of said Regent Avenue. 118 Lateral Sewer District No. 1(d) All that part of the SE4 of the NE4 and of the NE4 of the SE4 180 Township 29N, Range described as follows: of Section 'V Beginning at the SE corner of the NEW of the SE4 of said Section 18; thence West along the South line of said NE4 of SET' to the SW corner of said NEX of SE4; thence North along the West line of said NE4 of SE's 893.42 feet; thence East, at right angles to last described line 32.5 feet; thence North parallel to the West line of said NEI,of SEW and West line of said SEI of NE4 896'feet more or less to the center line of the Minneapolis and Watertown Road, so-called County Road No. 6; thence Easterly along the center line of said Road to its intersection with the East line of said Section 18; thence South along said East line of Section 18 to the point of beginn- ing; The boundaries having been marked by Judicial land marks placed at the Southeast and Southwest corners respectively of said land, at the intersections of the East line and the West line respectively of said land and the South line of said road, and at points in the respective West lines 370.5 feet North along the most westerly of said lines from said Southwest corner at a point in the other of said lines 217.3 feet ;South along said line from the east and west quarter line of the NE4 of SE4 of said Section 18, Village of Golden Valley, County of Hennepin, State of Minnesota. Lateral Sewer District No. 1(e) Bounded on the North by the northerly line of Westurban and said line extended to Trunk Highway 100; Bounded on the East by Noble Avenue and Noble Avenue extended southerly to the easterly terminus of the South line; Bounded on the South by a line extending from the easterly line above described, along the center line of Town Road extended east and west in a westerly direction to the center line of Trunk Highway 100; Bounded on the West from the westerly terminus of the southerly line along Trunk Highway 100 to the westerly terminus of the North line and point of beginning. Lateral Sewer District No. 1(g) The area bounded on the North by the tracks of the Minnesota, Western Railroad; on the South by T. H. 55; on the East by T. H. 100; and on the West by Douglas Drive North, Lateral Sewer District No. 1(h) Commencing at a point 2001 North of the North line of West Urban Addition and the center line of 'Noble Avenue, thence East 1651, thence North to the South line of Merribee Hills Addition, thence Easterly along the Southerly line of Merribee Hills Addition to the East line of Merribee Hills addition, thence North to the South line of Merribee Hills Second Addition, thence Easterly to the East line of Merribee Hills Second Addition, thence Northerly along the East line of Merribee Hills Second Addition to the center line of 27th Avenue North, thence Westerly 'to a point 165' East of the center line of Noble Avenue, thence North to the South line of Lot 1, Block 41 Golden Valley Gardens Addition, thence Nest to the center line of Noble Avenue, thence South along the center line of Noble Avenue for 62t, thence West for 165t, thence South to the North line of the School Property, thence West to the West line of the School Property, thence South to a point 2001 North of the North line of West Urban Addition, thence East to the point of beginning. Lateral Sewer District No. 1(f) Beginning at a point at the intersection of the North Line of Golden Valley Road and approximately 1201 Westerly of the West line of Indiana Avenue, thence Northerly to the South line of the NE -41 of NEI, Sec. 18, T. 29, R 24, including that addition known as Cumberland Hills Addition, thence Southerly on a line parallel to the East line of Indiana Avenue and 135' East of the East line of Indiana Avenue to a point 1351 North of the North line of Golden Valley Road, thence Easterly 1351 North of the North line of Golden Valley Road and parallel to the North line of Golden Valley Road to the West line of R.L.S. 292, thence Southerly to the North line of Golden Valley Road, thence Westerly along the North line of Golden Valley Road to the point of beginning. In conducting said public hearing for making its decisions on the proposed improvements, the Village Council proposes to proceed under the authority granted by Chapter 398, Minnesota Laws for 1953• All property within the Village which is benefited by the impro- vements is proposed to be assessed for such improvements as follows: All property in all of the above described areas, including all property abutting on any and all public streets and highways within the above described areas or abutting on said areas. In the case of Sewer Lateral District 1(g) above, all property in said area will be assessed, including all property in said area abutting on all public streets and highways located in said area or abutting on said area. All property in Lateral Sewer District No. 1 (g) will likewise be assessed for its share of the cost of the trunk sewer in Sewer District No. 1. All property in Lateral Sewer District No. 1(g) shall be specifically assessed for costs of the trunk sewer in Sewer District No. 1 and the lateral sewer in Lateral Sewer District No. 1(g), or the costs of said trunk and lateral sewer may be imposed on said property by a connection charge, or a combination of special assessments and connection charges may be imposed in the case of Lateral Sewer District No. 1(g). 120 All owners of such property in Lateral Sewer District Nos. 1(a), 1(b): 1(c)' 1(d), 1(e)$ 1(f)s 1(g),, and 1(h), are hereby notified to be present at said public hearing, there to make knowh their objections to such proposed improvements if any there be.
