Member Stark introduced the following resolution and moved its
adoption:
RESOLUTION APPROVING FLANS AND SPECIFICATIONS
AND ORDERING ADVERTISEMENT FOR BIDS
WHEREAS, pursuant to a resolution passed by the Council
on September 27, 1954s the G. M. Orr Engineering Company,
consulting engineers retained for the purpose, have prepared
plans and specifications for the construction of a water main
improvement in the Village and have presented such plans and
specifications to the Council for approval,
NOW THEREFORE, BE IT RESOLVED, by the Village Council of
Golden Valley, Minnesota:
1. Ruch plans and specifications, a copy of which are
hereto attached and made a part hereof, are hereby approved.
2. The Village Clerk shall prepare and cause to be inser-
ted in the official newspaper and in the Construction Bulletin,
an advertisement for bids upon the making of such improvement
under such approved plans and specifications. The advertise-
ment shall be published once, shall specify work to be done,
shall state that until 12:00 o'clock Noon on the. 26th day of
October, 1954, sealed proposals will be received by the Village
Council of the Village _of Golden Valley, Hennepin County,
Minnesota, at the Village Clerkta Office, and will then and
there be publicly opened and read in the presence of the Village
Clerk, the Village Attorney, the Village Administrator, and
the Village Engineer,,and all other persons who may wish to
attend said opening and reading, and that the Village Council
in the Council Chambers of the Golden Valley Village Hall will
consider all proposals submitted and read as set forth above
at 7:30 o'clock P.M. on the 26th day of October, 1954s and
that no bids will be considered unless sealed and filed with
the Clerk and accompanied by a cash deposit, cashier's check,
bid bond, or certified check, payable to the VillageofGolden
Valley for 5% of the amount bid.

Notice is hereby given that sealed proposals will be
received by the Village Council of the Village of Golden
Valley, Hennepin County, Minnesota, at the Golden Valley
Village Clerk's office, until 12:00 o'clock Noon on the
26th day of October, 1954s, and will then and there be publicly
opened and read in the presence of the Village Clerk, the

Village Attorneys the Village administrator, the Village
Engineer, and all other persons who may wish to -attend said
opening and reading, and that the Village Council in the
Council Chambers of the Golden Valley Village Hall will
consider all proposals submitted and read as set forth above
at 7:30 o*clock P.M. on the 26th day of October, 1954s for
the construction, furnishing labor and materials complete
in place for the construction of a water main improvement
consisting of approximately 5,000 lineal feet of twelve
inch cast iron pipe and appurtenant items.
Proposals arriving after the designated time will be
returned unopened.
Each proposal and all papers bound and attached thereto,
together with proposal guaranty, shall be placed in an envelope
and securely sealed therein.
The envelope shall be so marked as to indicate, (1) the
name of bidder, (2) type of construction and shall be addressed
'to the Village Clerk, Village of Golden Valley, Village Hall,
7830 Sixth Avenue North, Golden Valley (Minneapolis 22),
Minnesota. It may be either mailed s delivered by messenger
or submitted in person.
Proposal forms, contract documents, plans and specifica-
tions as prepared by G. M. Orr Engineering Company,_ 1004
Marquette Avenue, Minneapolis 2, Minnesota, are on TI -le and
may be seen at the office of the Village Clerk, Golden Valley,
Minnesota, or the Consulting Engineers.
Copies of Proposal Forms, Plans and Specifications for
use by contractors submitted a bid ma be obtained from the
Consulting Engineers upon deposit of 9,Q0, This deposit
will be returned to contractors who sub`t a bona fide bid
and who return the plans and specifications in good condition
within fifteen (15) days after the opening of the bids. One-
half of the amount of the deposit will be refunded for each
of all other sets of documents so returned.
This work will be paid for in cash. Partial payments
will be made monthly equal to 85 per cent of the value of the
work, including the value of the materials on the ground
required in the construction which have been delivered to the
site or adjacent thereto. Such payments will be based upon
estimates submitted by the contractor, monthly showing work
completed to date and approved by the Engineer and the Village
Council. The Village of Golden Valley will make final pay-
ment within thirty days after acceptance of the work in con-
formance with the general requirements and covenants of the
contract.

No bids will be considered unless sealed and filed with
the Village Clerk of Golden Valley and accompanied by a cash
deposit, cashiers check, bid bond or certified check payable
to the Village of Golden Valley for 5 per cent of the amount
bid (to be forfeited as liquidated damages in the event that
the bid be accepted and the bidder shall fail to enter prompt-
ly into a written contract and furnish the required bond.)
The Village of Golden Valley reserves the right to reject
any and all bids.

The motion for the adoption of the foregoing resolution
was duly seconded by Member Rahn and upon vote being taken
thereon, the following members.voted in favor thereof: Bies,
Foss, Huebsch, Rahn and Stark, and the following voted against
the same: None, whereupon said resolution was declared duly
passed and adopted, signed by the Mayor and his signature
attested by the Clerk.
