#090 01-27-55 No. 90 Police ChargesRESOLUTIONS ADOPTED by the VILLAGE COUNCIL Resolution No. 90 January 27, 1955 Member Rahn introduced the following resolution and MOVED its adoptions RESOLUTION NUMBER 90 CHARGES AGAINST POLICE CHIEF AL MCGINNI5 The undersigned number of the Police Civil Service Commission of the Village of Golden Valley hereby makes and prefers the following charges of inefficiency and misconduct against Village Police Chief Al McGinnis: I. That on November 16, 1951, Officer Hans Walz issued a tag to one John Christianson, charging him with a stop sign violation; that thereafter, a warrant was issued by Justice of the Peace Chester Campbell for the arrest of said John Christianson upon his failure to appear as directed by said tag; that, thereafter on December 71 1954s Constable Herbert Smith arrested said John Christianson and caused him to be imprisoned in the Hennepin County Jail, subject to release on deposit of bail in the amount of One Hundred ($100.00) Dollars as ordered by Justice of the Peace Chester Campbell; that, thereafter, on December 7, Chief of Police Al McGinnis wrongfully caused the release of said John Christianson from Jail and, in violation of his duty as a police officer, obstructed the course of justice and prevented the case of said John Christianson from coming on.promptly for trial as required by law. Ii. That Chief of Police Al McGinnis, has been guilty of conduct unbecoming a police officer, or Police Chief, in that on one occasion in the month of December 1951, or January 1955, he was in the Point Supper Club at 1:50 otclock in the morning, at which time the police force had to be called by the proprietor of the Point in order to clear customers out. The repeatedly, Chief of Police McGinnis has, in the last six month period, failed to tell the members of the force of criminal matters that had come to his attention and to which all members of the force should have been alerted in the interests of better policing and crime detection. IV. That some time in the months of February or January, 1954, Chief of 192 Police, Al McGinnis, wrongfully reprimanded and censured Officer Hans Walz and demanded his resignation, solely because Officer Hans Walz had carried out his duties by making a billboard survey of the Village as requested by the Village Council. V. That on or about July 26th, 195., Chief of Police Al McGinnis wrongfully took a police car outside the Village limits of Golden Valley and caused it to be involved in an accident because of his negligent driving, which accident took place at the intersection of Highway 5 and Portland Avenue, in which accident the police car was damaged in the amount of approximately Four Hundred ($400.00) Dollars. Vi. That on or about August 30, 1954, Chief of Police Al McGinnis wrongfully called the police force together and then and there took a vote of the members of the force, including himself, as to whether or not the members of the force should punch the Village time clock pursuant to a rule promulgated to him and them by the Village Council and that thereafter, and for several days, McGinnis and the other members of the Village Police Force did not punch the Village time clock, all pursuant to said vote. VII. That on or about January 3, 1955, Chief of Police Al McGinnis left the squad car unattended and entered the Sheriff's radio transmitter station for the purpose of taUng a nap while on,duty. VIII. ''that on or about October 6, 1954, Chief of Police Al McGinnis failed to act promptly and completely ignored his duties in an indecent exposure case. That during the last six month period, Police Chief Al McGinnis had consistently failed and refused to enforce the ordinances of the Village of Golden Valley, particularly those regulating the operation of motor vehicles, and has counseled his subordinates on the police force to do likewise; and that during the said period he has consistently failed and refused to arrest law violators. If That Chief of Police Al McGinnis has repeatedly and on accasions to numerous for separate citation, publicly criticized the Village Council and Village officials; that he has obscenely.eriticized the police rules and regulations promulgated by the Village Council; that he has called the Village Council and Village officials "dictators and Communists"; that he has advised non-cooperation with the Council on the part of the officers of the force; and that he has been guilty of conduct unbecoming a police officer. 1 1 The undersigned prefers these charges against Chief of Police Al.McGinnis before the Police Civil Service Commission of Golden Valley for consideration and action by that body., all in accordance with the law for such case made and provided. Member of Police Civi Sery ce Commission Village of Golden Valley The motion for the adoption of the foregoing resolution was duly seconded by Member Bies, and upon vote being taken thereon, the following members voted in favor thereof: Bies, Foss, Huebsch, Rahn and Stark; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature was attested by the Clerk.
