RESOLUTION ESTABLISHING RULES AND REGULATIONS
GOVERNING THE CONDUCT OF THE GOLDEN VALLEY POLICE DEPARTMENT
Preamble: Rules and regulations must be kept as brief as
possible, and therefore cannot cover every situa-
tion which may arise. Where these rules and
regulations are not specific, the Chief of Police
shall have the right of reasonable interpretation.
In such interpretation the foremost consideration
shall be the intent of the rules and regulations.
Where intent may be difficult to ascertain, these
rules and regulations shall be interpreted to serve
the best interests of the citizens and government
of the Village of Golden Valley.
The short title of these rules and regulations
shall be "Rules and Regulations, Police Department".
1. Responsibility: The Chief of Police is hereby declared
to be responsible to the Village Council for the efficient
operation of the Police Department, and is charged with the
enforcement and application of these rules and regulations.

The Chief of Police shall be responsive to reasonable and
lawful requests and suggestions from the Village Administra-
tor and shall comply with such requests and suggestions unless
he shall serve notice in writing that he wishes to appeal
any request or suggestion to the Village Council.
In all cases the Village Administrator shall be regarded as
the spokesman for the Council and shall have authority to set
reasonable time limits for compliance.
2. Manual of Procedure: The dhief of Police shall compile
data to be incorporated into�'a�a'Manual of Procedure". Said
manual shall be an elaboration of these rules and regulations,
and shall include interpretations of said rules and regula-
tions and all other data necessary to guide police personnel
in their routine duties.
Said Manual of Procedure shall be submitted to the Village
Council in June of 1955. Upon receipt of the manual the
Council shall have three calendar months to study the manual
for the purpose of accepting or rejecting it, in whole or

in part. Failure to reject shall constitute approval.
3. Training: The Chief of Police shall be responsible for
the state of training of all police officers.
In order to raise the standard of law enforcement and to
elevate police work to professional status the Chief of
Police shall prepare, on January lst of each gear, or as soon
thereafter as possible, a training program for the next
ensuing calendar year. Said training program shall be
posted in the Village Hall, and the Police Station, and
shall set forth the dates, times, places, and subject matter
of each training period. A minimum of one hour each week
shall be devoted to police training. Such training shall
be in addition to the forty hour work week. No extra com-
pensation shall be paid any officer for attending training
periods.
In addition to local police department training as set forth
herein, police department personnel shall participate in area
or zone training programs insofar as the Village Council in
its discretion finances such participation.
For 1955 the required training program is set forth below,
and shall be adhered to as the items in said training pro-
gram become available and necessary. Each officer shall
receive a minimum of three hours training each week. For
succeeding years, the Chief of Police shall prepare training
programs taking into account the experience, length of
service, and state of training of each member of the Police
Department,

4- Merit and Personnel SZstem:
A. Within ninety days from the date of adoption of,this
resolution the Chief of Police shall organize and inaugurate
a system calibrating the efficiency of police officers. Said
system shall be called the "Efficiency Report" of each police
officer, shall include all phases of police work and practice,
and shall include a method of grading each officer on appear-
ance and neatness, sense of responisbility, temperance, phy-
sical fitness, ability to get along with the public, ability
to get along with other personnel, perseverance, integrity,
courtesy, tact, aggressiveness, respect for higher authority,
discretion, leadership abilities, trustworthiness, and all
other qualities desirbale in a police officer.
The method of organization of the Merit System shall be sub-
mitted to the Council for approval, and must be approved
before the system shall become effective. Efficiency Reports
are hereby declared to be confidential, and shall be kept
under lock and key, and shall in no case be displayed to any
person or persons except the Village Council duly convened
according to law in the presence of the Chief of Police, or
to the official representative of the Council upon due notice
to the Chief' of Police.
B. �,githin ninety days from the date of adoption of; this
resolution the Chief of Police shall organize and inaugbrate
a system of individual personnel records for each member of
the Police Department, whether part or full time. Said system
shall be called the "Personnel Status Record" of each police
officer, and shall include the name, birthplace, and birthdate,
marital status, number of dependents, changes in family status,
copies of the officer's fingerprints, his photograph on March
lst of every other year, notes as to other means of identifi-
cation, next of kin to be notified in case of an accident,
education, former trades or occupations; his police service
history including date of appointment, changes in rank, commen-
dations, police training, special qualifications, violation

of rules and regulations and complaints and charges perferred
against the officer, leaves of absence, days lost from duty
for any reason, a complete inventory of police equipment issued
to him with dates of issue, date of return if any, and records
of cost of maintenance and operation of police equipment issued
to him.
The method of organizing such Personnel Status Records shall
be submitted to the Council for approval, and must be approved
before the system shall become effective. Personnel Status
Records are hereby declared to be confidential, and shall be
kept under lock and key, and shall in no case be displayed to
any person or persons except the Village Council duly convened
according to law in the presence of the Chief of Police, or
to the official representative of the Council upon due notice
to the Chief of Police.
C. Chief of Police: The Council shall appoint one person,
and delegate him the authority to keep efficiency reports
regarding the Chief of Police. Said efficiency report shall
be kept in such place as said person shall determine. The
requirements of paragraphs A and B, above, shall apply to
such person

5. Unprofessional Conduct:
A. Political Activity: No police officer shall seek or
accept election, nomination, or appointment as an officer of
a political club or organization, or take an active part in
,any municipal political campaign, except on behalf of his own
candidacy for public office; nor file as a candidate for public
office without seeking and obtaining a leave of absence; nor
shall any police officer serve as a member of a committee of
such a club or organization; nor seek signatures to any petition
provided by law; nor act as a worker at the polls; nor distribute
badges or pamphlets, dodgers and handbills of any kind favoring
or opposing any candidate for municipal office; nor speak
publicly for or against any candidate for municipal public office.
B. Conduct Unbecoming An Officer: No police officer shall
conduct himself so as to reflect discredit upon the police service
or upon the Village of Golden Valley. No officer shall partake
of intoxicating liquors four hours prior to his tour of duty,
no officer shall be intoxicated while on duty, nor shall any
police officer partake of intoxicating liquors while on duty.
No officer shall publicly criticize a superior officer, nor
shall he publicly criticize any elected or appointed official
of the Village of Golden Valley. No officer shall use profane
or insolent language. No officer shall accept any gift, fee,
or reward without the consent of the Council, other than a
reward publicly offered for the identification, apprehension,

and/or conviction of any person, or reward publicly offered
for the recovery of property.
6. Other Employment: I't is hereby declared to be against
public policy for any police officer to seek or accept full or
part time employment of any nature with any employer whatsoever,
nor shall any police officer engage in any business or private
enterprise of any whatsoever that will tend to impair his
efficiency as a police officer. Police officers may, with the
written consent of the Chief of Police act as police officers
at any public gathering during their free time, provided such
extra police activity of this nature is within the corporate
limits of the Village of Golden Valley, and provided that
such extra police activity is not conducted at any establishment
where intoxicating liquors or where non -intoxicating malt
beverages are sold, or where public dances are held. The Village
Council may revoke permission granted by the Chief of Police
by simple motion duly passed at any regularly called Council
meeting. Each police officer shall, for the purpose of
availability for manpower emergencies, advise the Village Admin-
istrator where he can be reached. When such officer(s) accepts
part time employment they shall advise the Village Administrator
of the name and address of their employer.
7. Uniforms: Shall be "uniform". Uniforms shall be kept
clean, neat and in good repair. Within thirty days from the date
of adoption of this resolution the Chief of Police shall consult
with the Village Administrator regarding the types of uniforms
which shall be approved attire for all police officers for
all seasons of the year. After agreement as to the standard
uniform and/or uniforms, notice of uniform requirements shall
be posted in the Village Hall and shall become a part of these
rules and regulations. Uniforms shall not be worn while off
duty except with the permission of the Police Chief. However,
uniforms no longer servicable for police duty may be worn after
removal of identifying insignia. Within six months from the
adoption of a standard uniform, the Chief of Police shall cause
all police officers to wear the approved uniform when on duty.
Purchase of Uniforms: Uniforms may be purchased through
the administrative office of the Village. Each officer shall
be allowed a uniform credit of $50.00 per annum. The Chief of
Police shall be primarily responsible for uniform purchase,
where uniform purchases are made through the Village. Purchases
exceeding $50.00 per annum shall be deducted from each officer's
pay at a rate to be determined by the Chief of Police and Village
Administrator.
8. Squad Car: The police squad car or cars shall not be
taken outside the Village limits except on official business.
The squad car shall not be used for the purpose of going out-
side the Village for lunches. It shall not be used for the
transaction of personal business of any kind. When not in the
personal custody of an officer on duty, the police squad car
shall be stored where garage facilities may be available under

the direction of the Village Administrator, such place of storage
to be as close to the premises of the Village Hall as possible.
No unauthorized person shall be permitted to ride in the
squad car. This rule shall not be applied to officials on the
Village who may ride in.the squad car in order to observe
patrolmen in action, or for other good and sufficient reason.
No'Village official shall be permitted to "joy ride" in the
police squad car.
In cases of emergency the senior officer of duty shall have
discretion in the application of all rules applying to the squad
car, but in each case said officer shall note the time leaving
the Village limits and the time of return, shall note the reason
for the trip, and shall note all passengers, not prisoners or
in official custody, in the daily log sheet or such other record
as may be prescribed by the Chief of Police.
9. Accidents: All accidents resulting in property damage
or personal injury in which the police squad car itself is
involved shall be reported to the Village Administrative office
at once by telephone. Such oral report shall state the time,
date, officer at the wheel, type of accident, nature of injuries
to any person involved in the accident. Within eight hours of
any such accident a complete report shall be filed with the
administrative office by the officer at the wheel at the time
of the accident upon the standard report form required by the
State of Minnesota and upon the report form required by the
Village insurance company. Copies of the statements of witnesses,
if any, shall accompany said report. The Village Administrator
shall report all accidents in the next ensuing administrative
report.
10. Car Maintenance: The Chief of Police shall submit car
maintenance reports to the administrative office on a prescribed
form not later than the first day of every month.
It is the declared policy of the Village Council that
servicing and maintaining the police squad car shall be equitably
dbtributed among existing service stations and garages. The
nearest garage shall be called where vehicles, public or private,
are in need of towing service. The service station or garage
to be used for squad car maintenance and servicing shall be
determined jointly by the Chief of Police and the Village Admin-
istrator in accordance with these rules and regulations.
11. Police Protection: The Village of Golden Valley shall
never be without police protection.
Where vacations or lack of personnel prevents one officer
from being on active duty at all times, the Chief of Police
shall assign an officer as "special duty officer". He shall
respond to all calls in which life or property is in jeopardy
(that is, shall respond in case of dire emergency), but shall
not be called upon to respond to routine police calls.
12. Duty Schedules: Duty schedules shall be first pre-
pared by the Chief of Police and then forwarded through the
administrative office to the Village Council for approval.
Lack of action by the Council for two consecutive Council
meetings shall constitubapproval. Council approval shall be
indicated by the signature of the Village Administrator on
duty schedules. No duty schedule shall be effective unless
it bears the signature of both the Chief of Police and the
Village Administrator.
All duty authorized duly schedules shall be available
in the Village Hall thirty days in advance of any officer's
tour of duty. Duty schedules shall incorporate the name or
names of special duty officers, in any.
Changes in Duty Schedules: In case of sickness, injury,
or absence of any police officers the Chief of Police shall
immediately assign another officW(s) to the tour of duty vaca-
ted for the above reasons. Such changes shall be reported
to the General Administrative Office immediately and notice
of the change posted in the Village Hall. Should such absence
continue for more than 72 consecutive hours the duty schedule
shall be revised immediately, signed by the Chief of Police
or senior officer and posted in the Village Hall, and shall
be submitted to the next regularly called Council meeting
for ratification.
All police officers are hereby declared to be subject
to call and assignment to duty in case of local emergency -by
the senior officer on duty or the Village Council, without
additional pay.
13. Vacations: Each police officer shall be entitled
to two weeks vacation per annum, plus compensatory time off
as set forth below. Special duty officers shall not be en-
titled
ntitled to compensatory time off, nor shall officers substit-
uting for a sick or injured officer.
The Chief of Police shall keep an accurate record of
police officers on duty during state or national holidays
recognized by the Village Council. One day's compensatory
time off shall be earned by officers for each such holiday,
such compensatory time off to be taken consecutively with
annual vacation leave. Other than as herein provided, -
police officers shall be paid overtime at the rate of time
and one half for all hours of work in excess of the forty hour
work week.
Vacation schedules must, by reason of Rule 6, above,

be submitted and filed in the General Administrative Office
thirty days before the date of any officerts absenting him-
self from duty by reason of =dation. In case of national
emergency (war) or local catastrophe, any officer on vacation
shall report on his own volition to the Chief of Police as
soon as practicable.
14. Target Practice: Each police officer shall engage
in target practice as ordered by this Council on February 17,
1953. The date, time, and place of target practice shall be
posted on the 'pillage Hall and Police Station bulletin board.
15. Radio: The Chief of Police shall within thirty days
after the adoption of these rules and regulations prepare and
present to the Council for approval rules for operation of the
police radio. Said rules, after said approval, shall become
a part of these tules and regulations, and shall be incorporated
into the manual of procedure.
16. Personnel Time Records: The daily log sheets shall
show the time each officer begins and ends his tour of duty,
and shall show the total number of hours worked by each officer
each day. Each officer shall record his hours of work as
prescribed by Resolution No. 64. Where any police officer is
not present for duty, the daily log sheets and time cards
shall be marked by the Chief of Police or acting Chief of
Police as follows:

Where any police officer shall be delayed in recording his
hours of work on the,time cards, the Chief of Police (or,
acting Chief of Police in the absence of the Chief of Police)
shall mark the time card in the appropriate space as follows:

Failure to mark the time cards as set forth above shall result
in the withholding of the pay of any delinquent officer until
all delays, absences, or tardiness is explained to the satis-
faction of the Pay Roll Officer.
If there is no "acting Chief of Police's said term shall
be construed to mean the police officer who assumes responsi-
bility for police activities in the absence of the Chief of
Police.

17. Equipment: Each police officer shall be indivi-
dually responsible for all equipment and vehicle(s) assigned
to the Police Department. .Any member of the Council or any
person authorized by any member of the Council, shall have
the authority to call for a spot check of police firearms.
Should the weapon be found to be in unserviceable condition
the police officer to whom the weapon is assigned shall be
pecuniarily responsible for the repair of the weapon. ($ee
Rule 14) .
18. General administration: No police officer shall
appear before the Village Council regarding Police Departmert
matters unless the Village Administrator has first been
advised on all details of the matter on or before the Friday
next preceeding any regularly called Council meeting, except
upon the spedfic request of the Council.
All correspondence directed to the Village Council shall
first be channeled through the Village Administrator, who
shall advise the Council of the contents of such correspondence.
No correspondence relating to Village affairs of any
nature shall be publicized by release to public information
facilities by any -member of the Police Department. This rule
applies to handbills, dodgers, pamphlets, or written material
of any kind, and also includes within its scope dissemination
of such information at any public gathering, or gathering which
numbers of persons may attend by invitation. (See Rule 5B)
19. Records: An adequate record system is hereby declared
to be indirspensable to the efficient operation of the Police
Department. Within six months from the adoption of this resol-
ution the Chief of Police shall devise a system of record keep-
ing based upon the record system recommended by the Federal
Bureau of Investigation for cities of -our class. Said record
system shall be incorporated in the manual of procedure.
20. Loitering:_ Loitering is prohibited. This rule shall
not prevent a police officer from observing traffic or actions
of suspicious persons from a vantage point. During --such obser-
vations, police officers are on duty and are enjoined to con-
duct themselves in a manner which will reflect credit upon the
service. Police officers while on duty are specially forbidden,
to engage in long conversations in public. Persons reportirg
to a police officer shall be courteously invited to accompany
the police officer to as private a place as circumstances will
permit, and there to discuss the matter with the officer.
21. Civil Services: Police officers shall immediately report
any damage to municipal equipment (street signs, street lights
out, and so forth), roads in need of repair, and other matter
which, if not promptly remedied, will result in damages to
private or public property or liability to the Village of Golden
Valley.

Police officers on duty shall respond promptly to all
fire alarms, whether notified of a fire alarm actually or
constructively.
The Chief of Police and each member of the Police Department
shall be individually and collectively accountable to the
Council for the enforcement of all laws of the State of Minnesota
and ordinances of the Village of Golden Valley.
22. Addition to These Rules and Regulations: The Village
Council, may, at any regularly called Council meeting, amend,
interpret, or add to these rules and regulations by.simple motion.
All interpretations of these rules and regulations by the
Chief of Police or by the Village Administrator shall be reduced
to writing at the earliest practicable time, and shall be incor-
porated into the manual of procedure.
23. Disciplinary Action: Upon duly authenicated report
of disobedience or these rules and regulations or interpretations
or amendments thereof, by any police officer, the Village Council
may at any regularly called Council meeting recommend the
filing of charges with the Police Civil Service Commission for
the Village of Golden Valley.
24. These rules and regulations shall not be construed to
abrogate any rules and regulations heretofore adopted by the
Council unless these rules and regulations are in conflict there-
with, nor shall these rules and regulations be construed as
condoning any past delinquencies of any police officer.
25: Effective Date: Where not specifically stated elsewhere
herein, these rules and regulations shall have full force and
effect from and after the date of adoption by the Council.

seconded by Member Rahn and upon vote being taken thereon, the
following members voted in favor thereof: Bies, Foss, Ruebsch,
Rahn, and Stark; and the following voted against the same: None,
whereupon said resolution was declared duly passed and adopted
signed by the Mayor and his signature attested by the Clerk.
