#119 07-19-55 Vacate Street1 Resolution No® 119 . .Y- a9 1955 Member Stark introduced the following resolution and moved its adoptions RESOLUTION VACATING STREET WHEREAS, a petition of a m4jority of the owners of real property fronting on the line of the street described below has been duly filed with the Village Council, and the Village Council has met at the time and place specified in a notice embracing a copy of said petition, duly.published and posted and has heard all interested persons,mnd it appears in the interest of the public that said portion of said street be vacated, Not# Therefore, BE IT RESOLVED, by the Village Council of the Village of Golden Valley, that the street described below, as the same is now dedicated and laid out within the corporate limits of said Village, be hereby vacateds That part of Byrd Avenue North lying Easterly of and contiguous to the Easterly line of France Avenue North as dedicated in Delphian Heights 3rd Unit; Southerly of the South line of 26th Avenue --North;. and Westerly of a line which originates on the North line of Section 17, Township 29 N. Range 24 W, 31®45' Easterly of the Northwesterly corner of said Section 17 and extends Southeasterly of an angle of 710 - 301 with the North line of said Section 17® BY RDER 6F THE VILLAGE COUNCIL Mayor The motion for the adoption of the foregoing resolution was duly seconded by Member Bies and upon vote being taken thereon, the following voted in favor thereof: Bies, Foss, Nadasdy, Stark; and the following voted against. the same: None' whereupon said resolution was declared duly passed and adopted® RESOLUTION WHEREAS, Morrell and Nichols, Inc®, Consulting Engineers, have here- to fore prepared and have now revised a re=latting including a proposed road pattern for Yale Garden Homes, all under the instuctions of the Village Councile NOW, THEREFORE, BE IT RESOLVED, ll by the Village Council of the Village of Golden Valley as follows: 1. The action of the Village Council in adopting on My , 1955, Resolution No. referring to the re -platting of Yale Garden Homes, is hereby rescinded. 2® That the revised re -platting of Yale Garden Homes referred to above, is hereby accepted and the road pattern therein established is declared to be the future road pattern of Yale Garden Homes® 236 3® The Village Attorney and C. E. Coulter, Surveyor, are hereby instructed to obtain legal descriptions of easements for said road pattern and sanitary; sewers to be laid therein, and to proceed to obtain said easements by negotiating or condemnation, or both® r 4, That assessments for road and sewer construction shall be levied in accordance withsaid re -platting and established road pattern& 5. That it will be the policy of this Council to grant harship waivers in accordance with the Zoning and Building ordinances of the Village where said re -platting establishes lots of less thanthe required minimum front footage or area, or where requirements of said ordinances for setback, side yards and rear yardsaare such that they work a hardship in view of said re -platting and road pattern; provided, however, that it is the policy of the Village Council not to grant such hardship waivers unless property is divided and roads established in accordance with the above re -platting and road pattern.
