#176 07-02-56 Amend Resolution Adopted June 26, 1956Resolution No. 176 July 2, 1956 Member Bies introduced the following resolution and moved its adoption: RESOLUTION AMENDING "RESOLUTION ORDERING CONSTRUCTION OF CERTAIN PROPOSED PUBLIC IMPROVEMENTS" ADOPTED JUNE 26, 1956 (FUND 20) BE IT RESOLVED by the Village Council that that certain resolution entitled "Resolution Ordering Construction of Certain Proposed Public Improvements" adopted by the Village Council on June 26, 1956, is hereby amended by adding thereto the following paragraphs: 5. The opening, grading and graveling of Jersey Avenue from its present southerly terminus southerly to T.H. No. 12 and the installation of curb and gutter in and for Xenia Avenue from Golden Valley Road to St. Croix Avenue and not ordered constructed and are not covered by the terms of this resolution. 6. It appearing that an ambiguity exists with reference to the ordering of construction and installation of curb and gutter in and for Welcome Avenue from Golden Valley Road to Xenia Avenue, and it further appearing that a full and complete public hearing having been held with reference to said construction and all persons present having been given an opportunity to be heard, it is hereby specifically ordered that said curb and gutter be constructed and be specifically included within all the other terms and conditions of the within resolution; provided, however, that said curb and gutter shall be extended on Xenia Avenue in front of the two following described lots, which have frontage on both Xenia and Welcome Avenues: Lot 8, B1ock..l, and Lot 4, Block 2, Graceful Addition. mayor The motion for the adoption of the foregoing resolution was duly seconded by Member Stark and upon vote being taken thereon, the following members voted in favor thereof: Bies, Nadasdy, Rahn, Stark, and Teresi; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the Clerk. 1
