Member Teresi introduced and read the following resolution and moved its
adoption:
"RESOLUTION ORDERING CONDEMNATION"
(Streets in East One-half Yale Garden Homes)
WHEREAS, it is necessary, advisable, and in the public interest, that the
Village of Golden Valley acquire an easement over certain lands for the
purpose of establishing certain public streets, and
WHEREAS, in order to accomplish such purpose it is necessary to acquire
an easement over the following described land, namely:
Parcel 211
The South 82 feet of that part of the East One-half of
the South One-half lying South of the North 200 feet there-
of of Lot 9, Yale Garden Homes, Village of Golden Valley,
Hennepin County, Minnesota; also the fillet area formed
by a circular curve whose radius is 20 feet and which
curve is tangent to the West line of Quail Avenue and
the North line of 33rd Avenue, for street and road purposes.

34th Avenue North, as herein dedicated, and tangent to
the East line of Quail Avenue as herein dedicated; and

radius is 20 feet and which curve is tangent to the
East line of Quail Avenue and the North line of Drake
Road, for street and road purposes.

East One-half of said Lot 2, One Hundred feet; thence
Easterly and parallel to the North line of said Lot 2,
Fifty feet Northerly; thence along said curve Northeasterly
to point of tangency located 50 feet Southerly of the
North line and along; a line parallel to the West line of said
East One-half of Lot 2; thence Northerly along said line
50 feet to the North line of said Lot 2; thence Westerly
and along the North line of said Lot 2, 100 feet to the

WHEREAS, it has become and is necessary to procure said easements and title
thereto by right of eminent domain, and
WHEREAS, the Village is advised and believes that the most feasible location
for such streets is on the land above described, Now Therefore,
BE IT RESOLVED, that the Village of Golden Valley proceed to procure
said easements and title thereto, under its right of eminent domain, and that
the Village Attorney be instructed and directed to file the necessary
petitions therefor, and to prosecute such action to a successful conclusion,
or until it is abandoned, dismissed, or terminated by the Village or by
the Court; and that the Village Attorney, the Mayor, and the Clerk, do all
things necessary to be done in the commencement, prosecution, and successful
termination of such action.
Adopted by the Village Council this 2nd day of July, 1957.

The motion for the adoption of the foregoing resolution was duly seconded
by Member Stark and, upon vote being taken thereon, the following voted
in favor thereof: Bies, Nadasdy, Rahn, Stark, Teresi, and the following
voted against the same: None; whereupon said resolution was declared duly
passed and adopted, signed by the Mayor, and his signature attested by
the Clerk.
