#058 07-02-57 Condemnation East 1/2 Yale Garden HomesResolution No. 58 July 2, 1957 Member Teresi introduced and read the following resolution and moved its adoption: "RESOLUTION ORDERING CONDEMNATION" (Streets in East One-half Yale Garden Homes) WHEREAS, it is necessary, advisable, and in the public interest, that the Village of Golden Valley acquire an easement over certain lands for the purpose of establishing certain public streets, and WHEREAS, in order to accomplish such purpose it is necessary to acquire an easement over the following described land, namely: Parcel 211 The South 82 feet of that part of the East One-half of the South One-half lying South of the North 200 feet there- of of Lot 9, Yale Garden Homes, Village of Golden Valley, Hennepin County, Minnesota; also the fillet area formed by a circular curve whose radius is 20 feet and which curve is tangent to the West line of Quail Avenue and the North line of 33rd Avenue, for street and road purposes. Name of parties interested in said land and nature of interest: Name Nature of Interest Robert Henry Widholm and Marvel May Widholm Fee Security Mutual Life Insurance Company Mortgage Parcel 216 The North 132 feet, the West 30 feet, and the South 30 feet of the North One-half of Lot 8, Yale Garden Homes, Village of Golden Valley, Hennepin County, Minnesota; also the fillet area formed by a circular curve whose radius is 20 feet and which curve is tangent to the South line of 34th Avenue North, as herein dedicated, and tangent to the East line of Quail Avenue as herein dedicated; and also the fillet area formed by a circular curve whose radius is 20 feet and which curve is tangent to the East line of Quail Avenue and the North line of Drake Road, for street and road purposes. Indahl and Delorous Indahl Minnesota Federal Savings and Loan Association Parcel 241 Nature of Interest Fee Mortgage The North 132 feet of the East One-half of the East One- half of Lot 1, Yale Garden Homes, Village of Golden Valley, Hennepin County, Minnesota, except the West 100 feet thereof; also the fillet area formed by a circular curve whose radius is 20 feet, and which curve is tangent to the west line of Noble Avenue as now located and the South line of 34th Avenue North as now located, for street and road purposes. Name of parties interested in said land and nature of interest: Name Nature of Interest Arvid Pearson and Lillian Pearson Fee WHEREAS, it has become and is necessary to procure said easements and title thereto by right of eminent domain, and WHEREAS, the Village is advised and believes that the most feasible location for such streets is on the land above described, Now Therefore, BE IT RESOLVED, that the Village of Golden Valley proceed to procure said easements and title thereto, under its right of eminent domain, and that the Village Attorney be instructed and directed to file the necessary petitions therefor, and to prosecute such action to a successful conclusion, or until it is abandoned, dismissed, or terminated by the Village or by the Court; and that the Village Attorney, the Mayor, and the Clerk, do all things necessary to be done in the commencement, prosecution, and successful termination of such action.
