#059 07-02-57 Order Condemnation 1/2 Yale Garden HomesResolution No. 59 July 2, 1957 Member Bies introduced and read the following resolution and moved its adoptions "RESOLUTION ORDERING CONDEMNkTION" (Streets in West One-half Yale Garden Homes) WHEREAS, it is necessary, advisable, and in the public interest, that the Village of Golden Valley acquire an easement over certain lands for the purpose of establishing certain public streets, and WHEREAS, in order to accomplish such purpose it is necessary to acquire an easement over the following described land, namely: Parcel 401 The East 27 feet and the West 60 feet of the East 375 feet of the following described tract, for public street purposes: Beginning .at the Southwest corner of the East One-half of the North One- half of Lot 12; thence East along the South line of the North One-half of Lot 12 to the Southeast corner of the North One-half of said lot; thence North along the East line of Lots 12 and 13 a distance of 89 feet; thence West parallel with the South line of the North One-half of Lot 12 to the West line of the East One- half of said Lot 13; thence South 89 feet to the point of beginning, all in Yale Garden Homes. Rech Fee WHEREAS, it has become and is necessary to procure said easements and title thereto by right of eminent domain, and Wi MEAS, the Village is advised and believes that the most feasible loca- tion for such streets is on the land above described, Now Therefore, BE IT RESOLVED, that the Village of Golden Valley proceed to procure said easements and title thereto, under its right of eminent domain, and that the Village Attorney be instructed and directed to file the necessary petitions therefor, and to prosecute such action to a successful conclusion, or until it is abandoned, dismissed, or terminated by the Village or by the Court; and that the Village Attorney, the mayor, and the Clerk, do all things necessary to be done in the commencement, prosecution, and successful termination of such action.
