#061 07-09-57 Establish Working Condition and HoursResolution No. 61 July 9, 1957 Member Teresi introduced the following resolution and moved its adoptions "RESOLUTION ESTABLISHING WORKING CONDITIONS AND HOURS FOR E GUYEES OF THE VILLAGE OF GOLDEN VALLEY'." BE IT RESOLVED that the following rules and regulations covering the employment of the employees of the Village of Golden Valley be adopted and placed in effect as follows, to wits ARTICLE I Longevity 1. A list shall be established listing employees in all departments according to total length of service with the Village. Persons hired as full time employees shall be added to this list after completion of 90 days of satisfactory service. 2. In the event of lay off due to lack of work or insufficient funds, employees within any given job classification with the least service shall be the first to be laid off, and in the event of rehire, the last employee laid off shall be the first to be rehired. 3. In the event of a job opening within a department, the job should be announced by bulletin. The oldest employee in the department within the next lower job classification should be given opportunity to step up for promotion. 4. Employees shall not be reduced in pay scale when assigned work of a lower classification. 5. No employee shall be laid off out of turn on the list except a disciplinary lay off for just cause. 6. Discharges All notices of discharge shall be in writing, if re- quested in writing by the affected employee. Said notice shall state the reason for lay off or discharge. Such request shall be made within two weeks after the employee learns of the proposed discharge. The employee may secure a hearing before the Village Council if he requests same in writing within ten days after receipt of written notice of discharge. The decision of the Council shall be final. If it is deter- mined by the Council that the employee has been unjustly discharged, he shall be reinstated at once and all wages and other benefits shall be credited to him without any penalty whatsoever. ARTICLE II Hours of Employment 1. The regular work day for employees shall be eight hours. Resolution No. 61 (continued) July 92 1957 2. The regular work week for all employees shall be forty hours per week. 3. Any employee called back to work after he has completed his regular day or called out on his day off shall be entitled to a minimum of two hours work at the regular overtime rate.. ARTICLE III overtime 1. Payment for work in excess of forty hours per week shall be allowed where duly authorized. 'Where an employee is entitled to overtime pay, said pay shall be computed at the rate of one and one-half times the regular rate of pay. 2. over time for an employee is defined as work beyond eight hours in any one day, forty hours in any one week, and for work done on Saturdays, Sundays, and legal holidays. 3. overtime for all employees shall be paid as it is earned. ARTICLE IV Vacation With Pay 1. Each full-time employee shall be entitled to 5/6 of a day of vacation with full pay and allowances for each month of employment during each year of continuous service under regular employment, except that no employee shall take a vacation during his first six months of employment. 2. After five years of continuous employment, an employee shall be entitled to 11, days vacation leave with full pay and allowances for each month of employment. 3. Vacations are to be taken during the year earned. However, if vacation cannot be taken during the year earned because the department is unable to schedule the vacation, vacation time may be accrued for a maximum of four calandar weeks. 4. If an employee has four calendar weeks of accrued vacation to his credit, he may take time off the job with full pay, subject to reasonable depart- mental regulation, to avoid losing earned vacation. 5. All vacations must be arranged for at least two calendar weeks in ad- vane, Employees will be given an opportunity to select vacation periods in so far as it is possible or practical. 6. In the event a holiday named in Article VI falls during an employee vacation period, one day shall be added to his regular vacation sbhedule. Resolution No. 61 (continued) ARTICLE V Sick Leave July 9, 1957 Each full-time employee shall be granted one day of sick leave with pay for each month of employment and will be allowed to accumulate credit for earned sick leave up to one hundred days subject to the following provisions: 1. No sick leave will be paid or credited for the f rst six months of employment, but after having six consecutive months employment, an employee will be given credit for days earned during the first six months. Persons whose employment is entirely part-time or casual shall not be entitled to sick leave. 2. Sick leave will be granted for actual sickness, temporary physical disability, serious illness or death in the immediate family or quarantine. 3i'.,Pa fit, -mf' -sick leave may be withhold until proof of one of the fore- going conditions is presented to and is accepted by the proper village official. 4. For every day of sick leave an employee earns after he had accumulated one hundred days, he will be given credit for one-half day additional vacation and one-half day of banked sick leave which may be used only in case of long illness, lasting over the accumulated one hundred days, and shall not be used in the computation of severance pay either as accrued vacation or accrued sick leave. 5. Sick leave shall be charged off on a working day basis; for example, is an employee is absent because of illness for one week, only five days will be charged against his accumulated sick leave. If he is absent on a holiday, he shall not be charged with a day of sick leave. ARTICLE VI Holidays 1. All employees shall be granted leave of absence with regular pay on all legal holidays. These are: *New Year's Day Labor Day Lincoln's Birthday Columbus Day Washington's Birthday Veterans Day Good Friday Thanksgiving Day *Memorial Day *Phristmas Day *Independence Day 2. New Year's Day, Memorial Day, Independence Day, and Christmas Day will be considered "Major" holidays. When such major:'holiday falls upon a Sunday, the following Monday shall be considered a holiday for all employees. When such major holiday falls on a Saturday, the preceding Friday shall be considered a holiday for all employees. 1 Resolution No. 61 (contimed) July 9, 1957 3. Evez7 employee entitled to vote at an election shall be permitted to absent himself from his work for that purpose for a reasonable time during the forenoon of each general election day without any penalty or deduction from salary or wages on account of such absence. ARTICLE VST Amendment This resolution may be amended, altered, or rescinded at any time by the Village Council by simple motion. ARTICLE VITT Effective Date This resolution shall be considered to have been in full force and effect as of January 1, 1957, however, in computing the employeets vacation and sick leave benefits, the employeets original date of employment will be used in determining benefits. Member Teresi introduced the foregoing resolution entitled.- "RESOLUTION ntitled: "RESOLUTION ESTABLISHING WORKING CONDITIONS ARID HOURS FOR EMPLOYEES OF THE VILLAGE OF GOLDEN VALLEY" The motion for the adoption of the above entitled resolution was duly seconded by Member Bies, and upon vote being taken thereon, the following voted in favor thereof: Bies, Nadasdy, Stark, and Teresi, and the following abstained: Rahn whereupon the Mayor declared the motion carried, signed same, and his signature was attested by the Clerk. 1
