Member Teresi introduced the following resolution and MOVED its adoptions
RESOLUTION CONCERNING PARKVIEW TERRACE WATERMAIN IMPROVEMENT
AND OTHER WATER MATTERS
BE IT RESOLVED by the Village Council of the Village of Golden Valley that
the Village Attorney be, and he hereby is, authorised to institute and
bring to completion appropriate proceedings against the City of Minneapolis
whose object will be the declaratory judgement or other order of the Court
as follows:
1. Declaring and ordering that the City supply water to Village
mains as heretofore requested located in Parkview Terrace
from Glenwood Avenue to Meadow Land and in North Tyrol Trail
from Meadow Lane to Wayzata Boulevard and, if found necessary
or desireable, in such other Golden Walley Streets as are
located near by and connected therewith for which the abutting
owners have heretofore presented sufficient petitions to the
Village of Golden Valley.
2. Declaring and ordering that the City shall supply water upon
the due and reasonable request of the Village of Golden Valley
to mains located anywhere in said Village thus eliminating the
necessity for further litigation and avoiding a multiplicity of
law suits.
3. Interpreting and clarifying the franchise granted to the Village
of Golden Valley by the City of Minneapolis and determining that
the rates heretofore charged the Village by the City have been
in excess of those required by said franchise.
4. Determining the amount of said overcharge and ordering judgement
for said amount against the City and in favor of the Village.

The motion for the adoption of the foregoing resolution was duly seconded
by Member Bies and, upon vote being taken thereon, the following voted in
favor thereof: Bies, Nadasdy, Rahn, Stark, and Teresi; and the following
voted against the same; Mone; whereupon said resolution was declared
duly passed and adopted, signed by the Mayor and his signature attested by
the Clerk.
