#092 10-01-57 Order Condemnation Sanitary Sewer Easement Laterals 4a,b,c210 Resolution No. 92 October 1, 1957 Member Teresi introduced the following resolution and MOVED its adoptions RESOLUTION ORDERING CONDEMNATION (Various Sanitary Sewer Easements: Wilson, Olson, Adams, etc. - Laterals 4(a), (b), (c) ) Whereas, it is necessary, advisable, and in the public interest, that the Village of Golden Valley acquire an easement over certain lands for the purpose of construction, maintenance, repair, alteration and reconstruction of sanitary sewers, and for access to said land for said purposes, and Whereas, in order to accomplish such purpose it is necessary to acgaare an easement over the following described land, namelya Parcel 33 A Ten (10) foot perpetual easement for sanitary sewer purposes, and a Sixty (60) foot temporary construction easement said temporary easement to empire on or before September 30, 1958, over and across the tract of land described below, the centerline of said easements being described as followsr Beginning at the Northwest corner of Lot Twelve (12), Block One (1), Spring Green; thence running East along the South line of the described tract of land to'apoint in the Southwesterly line of State Trunk High- way No. 100 and there terminatings All that part of the Northeast Quarter (NE -;11) of the Northwest Quarter (NWI) of Section Thirty (30), Township Twenty-nine (29), Range Twenty -four -(24), described as follows Commencing at the Northwest corner of the Northeast Quarter (NEI) of the Northwest Quarter (NW4)"'of said section; thence South Forty (40) rods; thence East Twenty (20) rods; thence North Forty (40) rods; thence West to a point of beginning; except part taken for highway. Mandile Fee Whereas, it has become and is necessary to procure said easements and title thereto by right of eminent domain, and Whereas, the Village is advised and believes that the most feasible location for such sanitary severs is on the land above described, NOW THEREFORE., BE IT RESOLVED, that the Village of Golden Valley proceed to procure said easements and title thereto,Junder its right of eminent domain, and that the Village Attorney be instructed and directed to file the necessary petitions therefor, and to_prosecute such action to a successful conclusion, or until it is abandoned, dismissed, or terminated by the Village or by the Court; and that the Village Attorney, the Mayor, and the Clerk, do all things necessary to be done in the commencement, prosecution, and successful term- ination of such action.
