#119 01-21-58 Provide Reassessment Brookview Country Club Sewer Improvement No. 3264 Resolution No. 119 January 21, 1958 Member Teresi introduced the following resolution and moved its adoption. "RESOLUTION PROVIDING FOR HEARING ON REASSESSMENT OF BROOKVIEW COUNTRY CLUB (ALSO KNOWN AS SUPERIOR COUNTRY CLUB) FOR TRUNK SEWER IMPROVEMENT NO. 3 WHEREAS, special assessments have heretofore been levied upon benefited properties for the making of Trunk Sewer Improvement No. 3 of the Village, by resolution of the Village -Coiuicil' dated`October 1,' 1.957, ­'and WHEREAS, the amount so assessed against property of the Brookview or Superior Country Club is challenged in a certain action now pending in the District Court of the Fourth Judicial District, and WHEREAS, it is asserted by said club in said action that it did not have legally sufficient notice of the hearing held by the Council on October 1, 19571 at which said assessments were levied, and therefore said assessment upon property of said club is invalid, and WHEREAS, the Council is advised by the Village Attorney that said asses sment upon property of said club may be invalid for lack of sufficient notice of said hearing being given to said club, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Golden Valley, Minnesota, as followsr 1. The proposed reassessment of property of Brookview Country Club (also known as Superior Country Club) for Trunk Sewer Improvement No. 3, and now on file in the office of the Clerk, is hereby approved as the proposed reassessment of said property for said improvement, and this Council shall meet at the time and place indicated in the notice set forth in paragraph 2 hereof for the purpose of passing upon said reassessment and hearing all ob- jections thereto. 2. The Village Clerk is hereby authorized and directed to cause notice of said meeting to be published in the Suburban Press of Golden Valley, the official newspaper of this municipality, at least two weeks before the date of said meeting, and to serve a copy of the same upon the President or Manager of said club, at least two weeks prior to said date, which notice shall be in substantially the following form: NOTICE OF HEARING ON REASSESSMENT OF BROOKVIEW (SUPERIOR) COUNTRY CLUB PROPERTY FOR TRUNK SEWER. IMPROVEMENT N0.3 NOTICE IS HEREBY GIVEN that the Village Council of the Village of Golden Valley, Minnesota, will meet at 8030 Floyd B. Olson memorial Highway in said Village on February 18, 1958, at 7:30 otclock P. M., to hear, consider and pass upon all written or oral objections, if any, to a proposed reassessment in respect of Trunk Sewer Improvement No. 3 upon property of the Brookview (Superior Country Club). Resolution No. 119 (continued) January 21, 1958 The proposed reassessment is now on file and open to public inspection by all persons interested, in the office of the Village Clerk. The entire amount assessed will be payable, unless prepaid, in 19 equal consecutive annual in- stallments the first of such installments to be payable with general taxes for the year.1958, collectible with such taxes during the year 1959• The first installment will be payable with interest at the rate of 6% per annum on the entire reassessment from the date of the resolution levying said reassessment ,to December 31, 1959, and each subsequent installment will be payable with one year's interest at said rate., on all unpaid installments, except that no interest will be charged if the entire reassessment as to any parcel is paid at the office of the Treasurer within 30 days from the date of adoption of the reassessment. The general nature of Trunk Sewer Improvement No. 3 is sanitary trunk sewer serving the following described area: Beginning at the Northwest corner of the Village thence Easterly along the Northerly boundary of the Village to Trunk Highway No. 100 (Belt Line); thence South along Highway No. 100to Trunk Highway 55 (Olson Highway); thence west along Trunk Highway 55 to its intersection with Winnetka Avenue; thence South along Winnetka Avenue to the Southerly boundary of the Village; thence West along the Southerly boundary of the Village to the Westerly boundary of the Village (County Road. 18); thence Northerly along the Westerly boundary of the Village to the point of beginning. The area proposed to be reassessed in respect of said improvement will include that portion of the property of the Brookview or Superior Country Club situated within the above-described area. Dated January 21, 1958. BY ORDER OF THE VILLAGE COUNCIL DON SORENSEN Acting Village Administrator and Clerk Golden Valley, Minnesota 3. Each and all of the terms and provision , of said form of notice are hereby adopted as the terms and conditions by which this Council shall be governed in hearing and passing upon objections to said reassessment, as fully as though the same were separately set forth and resolved herein. The motion for the adoption -of the foregoing resolution was duly seconded by Member Flannagan, and upon vote being taken thereon, the following voted in favor thereof: Bies, Flannagan, Nadasdy, Scherer and Teresi; and the following voted against the same: None whereupon said resolution was declared duly passed and signed by the Mayor, and his signature attested by the Clerk.
