#133 03-11-58 Order Sewer Improvement No. 58 LFResolution No. 133 March 11, 1958 Member Teresi then introduced the following resolution and MVED its adoptions "RESOLUTION ORDERING CONSTRUCTION OF AND DIRECTING PREPARATION OF FINAL PLANS AND SPECIFICATIONS FOR LATERAL SEWER IMPROVEMENT ( Project No. 58-L.F.) if BE IT RESOLVED by the Village Council of the Village of Golden Valley, Minnesota as follows: 1. That all actions of the Village Attorney in correcting any notice of public hearing on arrj improvement and resetting the date of any public hearing in connection with the public improvements under consideration are hereby ratified. 2. That at a hearing held on February 4, 1958 at 7:30 o'clock P. M. and on February 6, 1958, at 7:30 o'clock P. M. and on this date at 7:30 o'clock P. M., all three hearings being at 8030 Floyd B. Olson Memorial Highway in the Village of Golden Valley, and the hearings of February 6, 1958 and of this date being continuations of the hearing of February 4, 1958, after notice of said hearing of February 4, 1958 duly published as required by law, this Council has considered the view of all persons int- erested and, being fully advised of the pertinent facts, does hereby det- ermine to proceed with the constructions of Lateral Sewer Improvement (Project No. 58-L.F.) in and for the Village in accordance with the descri- ption of said improvement(s) contained in said notice, but only to the ex- tent set forth as follows: Project No. 58-L.F.-2 Brookri dge Avenue from the Village limits to Westbrook Road. Zane Avenue from the Village Limits to Wolfberry Lane extended. Wynwood Road from Douglas Drive to Zane Avenue. Westbrook Road from Brunswick Avenue to Zane Avenue. Colorado Avenue and Westbrook Road from Wynwood Road to Brunswick Avenue. Brunswick Avenue from Wynwood Road to a point 330 feet South of 23rd Avenue North. 22nd Avenue North from Brunswick Avenue to Zane Avenue, including also construction across a private easement connecting sewer lines in Zane Avenue and Westbrook Road. Project No. 58-L.F.-3 w For property in Westbrook abutting on West Constance Drive. Project No. 58-L.F.-4 All of 4 as described in notice. Project No. 58-L.F.-7 As described in notice. Resolution No. 133 (continued) March 11, 1958 Project No. 58-L.F.-9 As described in notice. Project No. 58-L.F.-12 As described in notice, including Rhode Island Avenue to the railroad tracks. Thence to Pennsylvania Avenue and Pennsylvania Avenue to Bassett's Drive, and excepting the following: Golden Valley Road from Rhode Island Avenue to Pennsylvania Avenue; Glenwood Avenue in Schuller's Addition; Pennsylvania Avenue from Golden Valley Road to the Minnesota Western Railroad; Sixth Avenue North from Rhode Island Avenue to a point approximately 1400 feet East thereof. Project No. 58-L.F.-15 As described in notice. Project No. 58-L.F.-18 As described in notice. 3. That at a hearing held on this date at 7.30 ofclock P. M. at 8030 Floyd B. Olson Memorial Highway in the Village of Golden Valley, after notice of said hearing duly published as required by law, this Council has consulted the views of all persons interested and,being fully advised of the pertinent facts, does hereby determine to proceed with the construction of certain proposed public improvements for said Village in accordance with the description of said improvements contained in said notice as follows.- Project ollows: Project No. 58-L.F.-1 and Project No. 58-L.F.-6 These projects are ordered constructed, including Xenia Avenue and Welcome Avenue in Project No. 58-L.F.-1, and the West Service Drive on T.H. 100, Pheonix Avenue and Welcome Avenue in Project No. 58-L.F.-6; provided, however, that the Golden Valley Road part shall not be constructed except for that portion thereof between Welcome Avenue and Xenia Avenue, necessary to connect Project No. 58-L.F.-1 with Project No. 58-L.F.-6. Project No. 58-L.F.-20 As described in notice. 3A. The public hearing on and in consideration of Project No. 58-L.F.-14 in continued to the meeting of March 18, 1958, pending a further check of the adequacy of the petition therefor, it appearing on this date that less than a 4/5ths majority of the Council favored ordering construction of this project. 1 Resolution No. 133 (continued) March 11, 1958 3B. The public hearing on and in further consideration of Project No. 58-L.F.-19 is continued to the meeting of March 18, 1958. 3C. The public hearing on and in further consideration of Project No. 58-L.F.-21 is continued to the meting of March 18, 1958• _- 3D. The public hearing on and in further consideration of Project No. 58-L.F.-5, Project No. 58-L.F.-13, Project No. 58-L.F.-15A and Project No. 58-L.F.-17 is continued to the meeting of March 18, 1958. 4. The Council, having been advised by the G. M. Orr Engineering Company that the proposed improvements described in Paragraphs 2 and 3 above are feasible and that each of them should best be made in connection with the other, it is hereby found and determined that the improvements descri- bed in Paragraphs 2 and 3 above shall be combined and, as so combined, are hereby designated Lateral Sanitary Sewers - Project No. 58/L.F. 5. The cost of said improvement shall be paid out of special assess- ments to be levied as set forth in said notices of public hearing. 6. G. M. Orr Engineering Company is hereby designated as consulting engineers for the construction of Lateral Sewer Improvement (Project No. 58-L.F.) and they are hereby authorized, ordered and instructed to prepare final plans and specifications for said improvement and submit the same to the Village Council for approval at the earliest possible date, all in accordance with the contract(s) heretofore existing between the Village and said engineers; and not otherwise. Attest: Acting i age Clerk and Adminffstrator The motion for the adoption of the foregoing resolution was duly seconded by Member Flannagan, and upon vote being taken thereon, the following members voted in favor thereof: Bies, Flannagan, Nadasdy, Scherer and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor, and his signature attested by the Clerk. 1 300 Resolution No. 134 March 11, 1958 Member Teresi then introdeced the following resolution and MDVED its adoption: "RESOLUTION PROVIDING FOR PUBLIC HEARING ON A LATERAL SANITARY SEWER IMPROVEMENT (LATERAL SANITARY SEWERS - PROJECT NO. 58-L.F.) (10, 11, 22, 23, and 24) BE IT RESOLVED, by the Village Council of the Village of Golden Valley, Minnesota, as follows: 1. In conformity with the provisions of Chapter 398, Session Laws of Minnesota, 1953, this Council proposes to construct a certain Lateral Sanitary Sewer Improvement within the Village as stated in the form of not- ice included in Paragraph 4 hereof. 2. The G. M. Orr Engineering Company, the engineers designated for the project, has reported to the Council, advising it in a preliminary way that the proposed lateral sanitary sewer improvement is feasible and that it should best be made as proposed and in connection with such other lateral sanitary sewer projects as may be and constitute part of Project No. 58-L.F. and the order for construction in 1958, and has given its estimated cost of the improvement hereinafter described as follows: Total cost of - improvement: 3. The Council shall meet at the time and place specified in the form of notice included in Paragraph 4 hereof for the purpose of holding a public hearing on the proposed Lateral Sanitary Sewer Improvement as described there- in. 4. The Clerk is authorized and directed to cause notice of the time, place and purpose of said meeting to be published for two successive weeks in the Suburban Press, the official newspaper of the Village, the first of such publications to be in the issue of said paper dated March 201 1958, and the second of said publications to be in the issue of said paper dated March 27, 1958. Such notice shall be in substantially the following form VILLAGE OF GOLDEN VALLEY HENNEPIN COUNTY, MINNESOTA NOTICE OF PUBLIC HEARING ON A CERTAIN PROPOSED LATERAL SANITARY SEWER IMPROVEMENT (LATERAL SANITARY SEWERS - PROJECT NO. 58-L.F.) (10, 11, 22, 23 and 24) NOTICE IS HEREBY GIVEN that the Village Council of the Village of Golden Valley, Hennepin County, Minnesota will meet on April 1, 1958 at 7:30 otclock P. M. at 8030 Floyd B. Olson Memorial Highway in said Village, for the purpose of holding a public hearing on a certain proposed lateral sanitary sewer improvement.
