#137 04-01-58 Construction Sewer Improvement No. 57 LF 5 thru 24306 Resolution No. 137 April 1, 1958 Member Teresi then introduced the following resolution and moved its adoption: "RESOLUTION ORDERING CONSTRUCTION OF AND DIRECTING PREPARATION OF FINAL PLANS AND SPECIFICATIONS FOR LATERAL SEWER IMPROVEMENT" (Project No. 58-L.F.) (Nos. 5, 14, 21; 10, 22, 23 and 24) BE IT RESOLVED by theVillage Council of the Village of Golden Valley, Minnesota as follows: 1. That at a public hearing held on March 11, 1958 at 7:30 o•clock P.M. and on March 18, 1958 at 7:30 otclock P.M., both hearings being held at 8030 Floyd B. Olson Memorial'Highway in the Village of Golden Valley, the hearing of March 18 being a continuation of the hearing of March 11, 1958, after notice of said hearing of March 11, 1958 duly published as required by law, this Council has considered the views of all persons interested and, being fully advised of the pertinent facts, does hereby determine to proceed with the construction of Lateral Sewer Improvements (Project No. 58»-L.F . ) in and for the Village in accordance with the description of said improvement(s) contained in said notice, but only to the extent set forth as follows: Project No.-58-L.F.-55, Project No. 58-L.F.-14 and Pro ct No.. 588-L,F 1 in their entirety Projects Nos. 58-L.F.-13, -15A, 17, and 19 shall not be constructed at this time. 2. That at a hearing held on this date at 7:30 oftrlock P.M. at 8030 Floyd B. Olson Memorial Highway in the Village of Golden Valley, after notice of said hearing duly published as required by law, this Council has fully consulted the views of all persons interested and being fully advised of the pertinent facts, does hereby determine to.proceed with the construction of certain proposed public improvement(s) for said Village in accordance with the description of said improvement(s) contained in said notice as follows: Project No. 58-L.F.-10 All that part thereof lying South of Plymouth Avenue and all that part abutting on both the North and South sides of Plymouth Avenue from its intersection with Sumpter Avenue to its intersection with the Easterly boundary line of Lot Nineteen (19), Block Ten (10), Winnetka; provided, however, that the remaining parts of this proposed -project shall not be constructed at this time. Project No. 58-L.F.-ll Shall not be constructed at this time. Resolution No, 137 (continued) April 1, 1958 Project Nos. 58-L.F.-22, -23 and -24 Shall be constructed in their entirety. 3. The Council, having been advised by the G. M. Orr Engineering Company, that the proposed improvements described in Paragraphs 1 and 2 above are feasible andthat each of them shoulc best be made in connection with the other and in connection with other sewer projects, whose construction has heretofore been ordered and which projects have heretofore been designated Lateral Sanitary Sewers Project No. 58-L.F., it is hereby found and determined that the improvements described in Paragraphs 1 and 2 above shall be combined to- gether and, as so combined, shall be combined with Lateral Sanitary Sewers Projects Noy 58-L.F. and shall become a part of said project and constructed in connection with it. 4. The cost of said improvement shall be paid out of special assessments to be levied as set forth in said notices of public hearings. 5. G. M. Orr Engineering Company is hereby designated as consulting engineers for the construction of Lateral Sewer Improvement (Project No. 58-L.F.)°and they are hereby authorized, ordered and instructed to prepare final pians and specifications for said improvement and submit the same to the Village Council for approval at the earliest possible date,,all in accordance with the contract(s) heretofore existing between the Village and said engineers; and not otherwise. Mayor Attest: Vil Administrator and Clerk The motion for the adoption of the foregoing resolution was duly seconded by Member Flannagan, and upon vote being taken thereon, the following members voted in favor thereof: Flannagan, Nadasdy, Scherer, and Teresi; . and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the Clerk. 1
