#153 05-13-58 Order Condemnation Winnetka Ave ImprovementResolution No. 15. May 139 1958 Member Teresi introduced and read the following resolution and MOVED its adoption: "RESOLUTION ORDERING CONDEMNATION" (Winnetka Avenue Improvement) WHEREAS, it is necessary, advisable, and in the public interest, that the Village of Golden Valley acquire and easement over certain lands for the purpose of establishing a certain public street, and WHEREAS, in order to accomplish such purpose it is necessary to acquire an easement over the following described land, namely: Parcel 10 That part of Lot 33, Auditor*s Subdivision Number 360, Hennepin County, State of Minnesota, according to the plat thereof on file and of record in the office of the Register of Deeds in and for Hennepin County, described as follows: Beginning at a point on the West line of Section 32, Township 118 North, Range 21 West, distant 1004.0 feet North of the West 1 corner thereof; thence Northeasterly at an angle of 53 degrees 30 minutes, with the West line of said Section 32, a distance of 111.0 feet; thence deflect to the left at an angle of 75 degrees 15 minutes a distance of 40.0 feet; thence deflect to the left at an angle of 48 degrees 30 minutes a distance of 80 feet more or less to a point on the West line of said Section 31; thence South to point of beginning; Containing 0.062 acres more or less in addition to existing road. Dietz Interest Fee WHEREAS, it is necessary, advisable and in the public interest that the Village of Golden Valley acquire a slope permit over certain lands for the purpose of establishing a certain public street, and WHEREAS, in order to accomplish such purpose it is necessary to acquire a slope permit covering the following described land, namely: Parcel 15 On that part of Lot 1, Olsen Manor, according to the plat thereof on file and of record in the office of the Registrar of Titles,being regestered land as evidenced by Certificate of Title No. 254613, lying Northeasterly of the Southwesterly line of said Lot 1, Hennepin County, Minnesota. Bird Fee Minneapolis Savings and Load Association Mortgage WHEREAS, it has become and is necessary to procure said easement and slope permit and title thereto by right of eminent domain, and WHEREAS, the Village is advised and believes that the most feasible location for such street easement and slope permit is on the lands above described, Now Therefore, BE IT RE -SOLVED that the Village of Golden Valley proceed to procure said easement and slope permit under its right of eminent domain, and that the Village Attorney be instructed and directed to file the necessary petitions therefor, and to prosecute such action to a successful conclusion, or until it is abandoned, dismissed, or terminated by the Village or by the Court; and that the Village Attorney, the Mayor, and the Clerk, do all things nec- essary to be done in the commencement, prosecution, and successful termina- tion of such action.
