#217 11-18-58 Order Condemnation 58-LF-11 thru 29 Raymond, Good Shepherd, Lovering4196 Resolution No. 217 November 18, 1958 Member Flannagan introduced and read the following resolution and LVED its adoption; "RESOLUTION ORDERING CONDEMNATION" (58 -LF -1, 111, 28 and 29, Raymond, Good Shepherd and Lovering) Whereas, it is necessary, advisable, and in the public interest that the Village of Golden Valley acquire an easement over certain lands for the purpose of construction, maintenance, repair, alteration and reconstruction of sanitary sewers, and for access to said land for said purposes, and Whereas, in order to accomplish such purpose it is necessary to acquire an easement over the following described land, namely; Parcel 1 A Five (5) foot perpetual easement for sanitary sewer purposes over and across the West Five (5) feet of the following described tract of land and over and across that part of the North Five (5) Feet of the following described tract of land lying West of a line drawn parallel with and Five (5) feet East of the Southerly extension of the West line of Lot Eighty-two (82), "Auditor's Subdivision Number 322, Hennepin County, Minnesota", and a Thirty (30) foot temporary construction easement for sanitary sewer purposes, said temporary easement to expire on or before December 31, 1959, over and across the West Thirty (30) feet of the following described tract of land and over and across that part of the North Thirty (30) feet of the following described tract of land lying West of a line drawn parallel with and Thirty (30) feet East of the Southerly extension of the West line of Lot Eighty-two (82), "Auditorts Subdivision Number 322, Hennepin County, Minnesota"; All that part of the Northeast Quarter (NEI) of the Northeast Quarter (NEI) of Section Five (5), Toi�mship One Hundred Seven- teen (117), Range Twenty-one (21), Hennepin County, Minnesota, described as follows; Commencing on the North line of said Northeast Quarter (NEI) of the Northeast Quarter (NE4) at a point Thirty (30) rods West of the Northeast corner thereof; thence at right angles South Sixteen (16) rods; thence at right angles West Twenty (20) rods; thence at right angles North Sixteen (16) rods to the North line of said Quarter section; thence East along said North line to the point of beginning. Name of parties interested in said land and nature of inter -est: Name Interest Robert L. and Marian Helen Lovering Fee 5th Northwestern National Bank of Minneapolis Mortgage Parcel 29 A Five (5) foot perpetual easement for sanitary sewer purposes over and across the West Five (5) feet of Lot Eighty-two (82), "Auditor*s Subdivision Number 322, Hennepin County, Minnesota" and a Thirty (30) foot temporary construction easement for sanitary sewer purposes, said temporary easement to expire on or before December 31, 1959, over and across the West Thirty (30) feet of Lot Eight -two (82), "Auditor*s Subdivision No. 322, Hennepin County, Minnesota; Name of parties interested in said land and nature of interest: Name - Interest W. A. Raymond and Mary Raymone Fee Lyle Stanley Swanson and Lois Blacklock Swanson Contract Vendees Whereas, it has become and is necessary to procure said easements and title thereto by right of eminent domain, and Whereas, the Village is advised and believes that the'most feasible location for such sanitary sewers is -on the land above described, Now Therefore, 1 L Resolution No. 217 (Continued) November 18, 1958 BE IT RESOLVED, that the Village of Golden Valley proceed to procure said easements and title thereto, under its right of eminent domain, and that the Village Attorney be instructed and directed to file the necessary petitions therefor, and to prosecute such action to a successful conclusion, or until it is abandoned, dismissed, or terminated by the Village or by the Court; and that the Village Attorney, the Mayor and the Clerk, do all things necessary to be done in the commencement, prosecution and successful termina— tion of such action.
