Member Flannagan introduced and read the following resolution and LVED
its adoption;
"RESOLUTION ORDERING CONDEMNATION"
(58 -LF -1, 111, 28 and 29, Raymond, Good Shepherd and Lovering)
Whereas, it is necessary, advisable, and in the public interest
that the Village of Golden Valley acquire an easement over certain lands
for the purpose of construction, maintenance, repair, alteration and
reconstruction of sanitary sewers, and for access to said land for said
purposes, and
Whereas, in order to accomplish such purpose it is necessary to
acquire an easement over the following described land, namely;
Parcel 1
A Five (5) foot perpetual easement for sanitary sewer purposes
over and across the West Five (5) feet of the following described
tract of land and over and across that part of the North Five (5)
Feet of the following described tract of land lying West of a
line drawn parallel with and Five (5) feet East of the Southerly
extension of the West line of Lot Eighty-two (82), "Auditor's
Subdivision Number 322, Hennepin County, Minnesota", and a
Thirty (30) foot temporary construction easement for sanitary
sewer purposes, said temporary easement to expire on or before
December 31, 1959, over and across the West Thirty (30) feet of
the following described tract of land and over and across that
part of the North Thirty (30) feet of the following described
tract of land lying West of a line drawn parallel with and
Thirty (30) feet East of the Southerly extension of the West
line of Lot Eighty-two (82), "Auditorts Subdivision Number 322,
Hennepin County, Minnesota";
All that part of the Northeast Quarter (NEI) of the Northeast
Quarter (NEI) of Section Five (5), Toi�mship One Hundred Seven-
teen (117), Range Twenty-one (21), Hennepin County, Minnesota,
described as follows;
Commencing on the North line of said Northeast Quarter (NEI)
of the Northeast Quarter (NE4) at a point Thirty (30) rods
West of the Northeast corner thereof; thence at right angles
South Sixteen (16) rods; thence at right angles West Twenty
(20) rods; thence at right angles North Sixteen (16) rods to
the North line of said Quarter section; thence East along said
North line to the point of beginning.

as follows: Beginning at a point in the South line of said Lot
a distance of One Hundred Twenty-four (124) feet West of the
Southeast corner of said lot; thence North and parallel with the
East line of said lot a distance of Two Hundred Thirty-one and
Sixty-seven Hundredths (231.67) feet; thence at an angle which
deflects to the right and which angle equals Twenty Degrees Forty-
five Minutes (200 45*9 a distance of Seventy (70) feet; thence
at an angle of Twenty-one Degrees Ten Minutes (210 10•) which
deflects to the right a distance of Forty-four and Nine Tenths
(44.9) feet, more or less, to the Southerly line of what is
known as Glenwood Avenue or County Highway No. Forty (40), which

322, Hennepin County, Minnesota;

Whereas, it has become and is necessary to procure said easements

BE IT RESOLVED, that the Village of Golden Valley proceed to procure
said easements and title thereto, under its right of eminent domain, and
that the Village Attorney be instructed and directed to file the necessary
petitions therefor, and to prosecute such action to a successful conclusion,
or until it is abandoned, dismissed, or terminated by the Village or by the
Court; and that the Village Attorney, the Mayor and the Clerk, do all things
necessary to be done in the commencement, prosecution and successful termina—
tion of such action.
Adopted by the Village Council this 18th day of November, 1958,

The motion for the adoption of the foregoing resolution was duly
seconded by Member Teresi and, upon vote being taken thereon, the following
voted in favor thereof: Flannagan, Nadasdy, and Teresi;
and the following voted against the same: None;
whereupon said resolution was declared duly passed and adopted, signed by
the Mayor, and his signature attested by the Clerk.
