#016 04-07-59 Order Condemnation 58-LF-56Resolution No. 16 April 7, 1959 Member Bies introduced the following resolution and LVED its adoption: "RESOLUTION.ORDERING CONDEMNATION (58-L.F.-56) WHEREAS, it is necessary, advisable, and in the public interest that the Village of Golden Valley acquire (an) easement (s) over certain lands for street, road, and utility purposes, and for access to said land for said purposes, and WHEREAS, in order to accomplish such purpose it is necessary to acquire an easement(s) over the following -described land, namely: The South Twenty (20) feet and the East Thirty (30) feet for street purposes, of the following described property: NOTE: The South Twenty (20) feet being a part of Wynwood Road, the East Thirty (30) feet being a part of Zane Avenue North. The North Thirty (30) acres of the Northwest Quarter (NWD of the Northwest Quarter (NW4) of Section Twenty-eight (28), Township One Hundred Eighteen (118), Range Twenty-one (21), except that part thereof described as follows: Commencing at the point in the West Line of said Section where the same in instersected by a line running East and West parallel with and distant Twenty (20) feet North of the South Line of the North Thirty (30) acres of the said Northwest Quarter (NWD of the Northwest Quarter (NWD of said Section Twenty-eight (28), thence North along the West line of said North Thirty (30) acres a distance of Five Hundred Ninety-five (595) feet more or less to -a point Three Hundred Seventy- seven (377) feet South of the Northwest corner of said section, thence East parallel with the North line of said Section a distance of Three - Hundred Ninety-nine (399) feet, thence South Parallel with the West line of said Section to a point Twenty (20) feet North of the South line of said North Thirty (30) acres, thence West to point of beginning and except that part described as follows: Commencing at the point in the West line of said Section where the same is intersected by a line running East and West parallel with and distant Twenty (20) feet North of the South line of the North Thirty (30) acres of said Northwest Quarter (NWD of the Northwest Quarter (NW4) of said Section Twenty-eight, thence East parallel with the North line of said North Thirty (30) acres a distance of Three Hundred Ninety-nine (399) feet which is the point of beginning of the land to be described, thence North parallel with the West line of said Section Twenty-eight (28) a distance of One Hundred Sixty-six and Fifty-two Hundredths (166.52) feet, thence East along a line parallel with the South line of said North Thirty (30) acres to a point on the East line of the West One-half (W2) of the Northwest Quarter (NW4) of the Northwest Quarter (NWD thence South along aforesaid East line a distance of One Hundred Sixty-six and Fifty- two Hundredths (166.52) feet to a point Twenty (20) feet North from the South line of said North Thirty (30) acres, thence West parallel with the South line of said North Thirty (30) acres to the point of beginning and also except that except that part described as follows: Resolution No. 16 (Continued) April 7, 1959 Commencing at the Northwest corner of the Northwest Quarter (NW4) of the Northwest Quarter (NW4) of Section Twenty-eight (28), Township One Hundred Eighteen (118), Range Twenty-one (21), thence South along the West line of said Northwest Quarter (NW4) of the Northwest Quarter (NW4) a distance of Two Hundred Sixty-one (261),feet, thence East parallel with the North line of the Northwest Quarter (NW4) of the Northwest Quarter (NW4)a distance of Two Hundred Sixteen (216) feet, thence North on a line parallel with the West line of said Northwest Quarter (NW4) of the Northwest Quarter (NW4) to a point on the North line of said Northwest Quarter (NW4) of the North- west Quarter (NW'), thence West along said North line to the point ob be- ginning. WHEREAS, it has become and is necessary to procure said easements and title thereto by right of eminent domain, and WHEREAS, the Village is advised and believes that the most feasible location for such street, road and utility easements(s) is on the land above described, Now Therefore, BE IT RESOLVED, that the Village of Golden Valley proceed to procure said easements and title thereto, under its right of eminent domain, and that the Village Attorney be instructed and directed to file the necessary petitions therefor, and to prosecute such action to a successful conclusion, or until it is abandoned, dismissed, or terminated by the Village or by the Court; and that the Village Attorney, the Mayor and the Clerk, do all things necessary to be done in the commencement, prosecution and successful term- ination of such action.
