#032 05-11-59 Order Condemnation Laurel AvenueResolution No. 32 May 11, 1959 Member Teresi introduced and read the following resolution and MOVED its adoption: "RESOLUTION ORDERING CONDEMNATION - (Laurel Avenue) WHEREAS, it is necessary, advisable, and in the public interest that the Village of Golden Valley acquire (an) easement(s) over certain lands for street, road, and utility purposes, and for access to said land for said purposes, and WHEREAS, in order to accomplish such purpose it is necessary to ac- quire an easement(s) over the following -described land, namely: Laurel Avenue for street and road purposes from the Minneapolis Northfield and Southern Railroad tracks westerly to the proposed location of the Continental Bakery Company. WHEREAS, it has become and is necessary to procure said easements and title thereto by right of eminent domain, and WHEREAS, the Village is advised and believes that the most feasible location for such street, road and utility easement(s) is on the land above described, NOW THEREFORE, BE IT RESOLVED, that easements and construction easements of the necessary width be obtained, BE IT RESOLVED, that the Village of Golden Valley proceed to procure said easements and title thereto, under its right of eminent domain, and that the Village Attorney be instructed and directed to file the necess- ary petitions therefor, and to prosecute such action to a successful con- clusion, or until it is abandoned, dismissed, or terminated by the Village or by the Court; and that the Village Attorney, the Mayor and the Clerk, do all things necessary to be done in the commencement, prosecution and successful termination of such action. BE IT RESOLVED, that the terms of this resolution are contingent upon the ordering by the Minneapolis Northfield and Southern Railroad of con- demnation for railroad purposes of an adequate strip of land along the south line of Laurel Avenue as set forth above.
