#050 07-07-59 Order Improvements 59-LF-23 Thru 30Resolution No. 50 July 7, 1959 Member Teresi then introduced the following resolution and MOVED its adoption: "RESOLUTION ORDERING CONSTRUCTION OF CERTAIN PUBLIC IMPROVEMENTS" (Lateral Sanitary Sewers - Project Numbers 59-L.F.23, 24, 25, 27, 29 and 30) BE IT RESOLVED by the Village Council of the Village of Golden Valley, Minnesota, as follows: 1. That at a public hearing held on this day at 7:30 o•clock P.M. at 7800 Golden Valley Road in the Village of Golden Valley, Minnesota, after notice of said hearing duly published as required by law, this Council has consulted the views of all persons interested and, being fully advised of the pertinent facts, does hereby determine to proceed with the con- struction of certain proposed public improvements for said Village, in accordance with the description of said improvements contained in said notice, as follows: VILLAGE OF GOLDEN VALLEY NOTICE OF PUBLIC HEARING ON A CERTAIN PROPOSED LATERAL SANITARY SEWER IMPROVEMENT PROJECT NO. 59-L.F. (No. 23, 24, 25, 27, 29 & 30) NOTICE IS HEREBY GIVEN that Village Council of the Village of Golden Valley will meet on July 7, 1959, at 7:30 o*clock P. M. at 7800 Golden Valley Road in said Village for the purpose of holding a public hearing on a certain proposed lateral sewer improvement. Orr-Schelen, Inc. engineers for the project estimate that the entire cost for the improvement will be $223,000.00. The area to be served will be as follows: All that property which may be served by lateral sanitary sewer in- stalled on the following streets and easements and all that property abutting on the following streets, easements and land: Project 5599L, -F-23 The West 900' of the N.W. quarter of the N.E. quar- ter of Section 30, Township 118, Range 21. The S.W. quarter of the N.E. quarter of Section 30, Township 118, Range 21. The West 650* of the North 1,000*of the S.E. quarter of the N.E. quarter of Section 30, Township 118, Range 21. Bergstrom•s Valley Heights Addition -The N.W. quarter of S.E. quarter of Section 30, Township 118, Range 21. Aquilla Avenue from Mandan Avenue to Olympia Avenue. Boone Avenue from Plymouth Avenue to Olympia Avenue. Olympia Avenue from Boone Avenue to Zealand Avenue. Project 59LF-25 Maryland Avenue from Plymouth Avenue to 300' North of Plymouth Avenue. Project 59LF-27 Idaho Avenue from Western Avenue to Glenwood Avenue. The East 165• of the North 250' of N.W. quarter of N.E. quarter Section 5, Township 117, Range 21. The South 165' of Lot 78 and 79, Auditor's Subdivision No. 322 in Section 32, Township' 118, Range 21. Project 59LF-29 The South 400* of the West 700* of the N.W. quarter of the S.W. quarter of Section 29, Township 118, Range 21 and Sumter Avenue from Winsdale Street to Olympia Street. Project 59LF-30 Winnetka Avenue from Medicine Lake Road to 800* South of Medicine Lake Road. In conducting said public hearing for making its decision on the proposed improvement the Village Council proposes to proceed under the authority granted by Chapter 398, Minnesota Laws for 1953, as amended. All property within the Village which is benefited by the im- provement is proposed to be assessed for such improvement as set forth in the description set forth above, including all property within the described areas and/or abutting on streets, easements and/or land described above and also including all railroad property and railroad rights-of-way located in or abutting on the above de- scribed areas. All owners of such property in the areas and aubtting upon the streets, etc, described above are hereby notified to be present at said public hearing and to make known their objections to such proposed lateral sanitary sewer improvement if any there be. The cost of said improvement(s) shall be paid out of special assessments to be levied as set forth in said notice of public hearing. 4. Orr-Schelen, Inc. is hereby designated as engineer for the con— struction of said proposed public improvements, and it is hereby auth— orized, ordered and instructed to prepare final plans and specifications for said improvements and submit the same to the Village Council for approval at the earliest possible date. Attest: Villag lerk and Administrator The motion for the adoption of the foregoing resolution was duly seconded by Member Flannagan and, upon vote being taken thereon, the following members voted in favor thereof: Bies, Flannagan, Nadasdy, Scherer, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor, and his signature attested by the Clerk. 1 Resolution No. 50 (Continued) July 7, 1959 2. It is hereby found and determined that said public improvement is feasible and can best be constructed as set forth in said -report and not in connection with some other improvement (the Council reserves the right to consolidate said improvement with other public improve— ment(s) at a later date if it seems advisable to do so). 3. The cost of said improvement(s) shall be paid out of special assessments to be levied as set forth in said notice of public hearing. 4.
