Member Teresi then introduced the following resolution and MOVED its
adoption:
"RESOLUTION ORDERING CONSTRUCTION
OF CERTAIN PUBLIC IMPROVEMENTS"
(Lateral Sanitary Sewers - Project Numbers 59-L.F.23,
24, 25, 27, 29 and 30)
BE IT RESOLVED by the Village Council of the Village of Golden Valley,
Minnesota, as follows:
1. That at a public hearing held on this day at 7:30 o•clock P.M. at
7800 Golden Valley Road in the Village of Golden Valley, Minnesota, after
notice of said hearing duly published as required by law, this Council
has consulted the views of all persons interested and, being fully advised
of the pertinent facts, does hereby determine to proceed with the con-
struction of certain proposed public improvements for said Village, in
accordance with the description of said improvements contained in said
notice, as follows:

SANITARY SEWER IMPROVEMENT

NOTICE IS HEREBY GIVEN that Village Council of the Village of Golden
Valley will meet on July 7, 1959, at 7:30 o*clock P. M. at 7800 Golden
Valley Road in said Village for the purpose of holding a public hearing
on a certain proposed lateral sewer improvement.
Orr-Schelen, Inc. engineers for the project estimate that the entire
cost for the improvement will be $223,000.00.
The area to be served will be as follows:
All that property which may be served by lateral sanitary sewer in-
stalled on the following streets and easements and all that property
abutting on the following streets, easements and land:

Project 59LF-29 The South 400* of the West 700* of the N.W.
quarter of the S.W. quarter of Section 29, Township 118, Range 21
and Sumter Avenue from Winsdale Street to Olympia Street.
Project 59LF-30 Winnetka Avenue from Medicine Lake Road to 800*
South of Medicine Lake Road.
In conducting said public hearing for making its decision on the
proposed improvement the Village Council proposes to proceed under
the authority granted by Chapter 398, Minnesota Laws for 1953, as
amended.
All property within the Village which is benefited by the im-
provement is proposed to be assessed for such improvement as set
forth in the description set forth above, including all property
within the described areas and/or abutting on streets, easements
and/or land described above and also including all railroad property
and railroad rights-of-way located in or abutting on the above de-
scribed areas.
All owners of such property in the areas and aubtting upon the
streets, etc, described above are hereby notified to be present at
said public hearing and to make known their objections to such
proposed lateral sanitary sewer improvement if any there be.

3. The cost of said improvement(s) shall be paid out of special
assessments to be levied as set forth in said notice of public hearing.
4. Orr-Schelen, Inc. is hereby designated as engineer for the con—
struction of said proposed public improvements, and it is hereby auth—
orized, ordered and instructed to prepare final plans and specifications
for said improvements and submit the same to the Village Council for
approval at the earliest possible date.

The motion for the adoption of the foregoing resolution was duly
seconded by Member Flannagan and, upon vote being taken thereon,
the following members voted in favor thereof: Bies, Flannagan,
Nadasdy, Scherer, and Teresi;
and the following voted against the same: None,
whereupon said resolution was declared duly passed and adopted,
signed by the Mayor, and his signature attested by the Clerk.

2. It
is hereby found and
determined that said public improvement
is feasible
and can best be constructed as set forth in said -report
and not in
connection with some other improvement (the Council reserves
the right
to consolidate said
improvement with other public improve—
ment(s) at
a later date if it
seems advisable to do so).
3. The cost of said improvement(s) shall be paid out of special
