#083 10-20-59 Authorize Condemnation Tract AA MolenResolution No. 83 October 20, 1959 Member Bies introduced the following resolution and moved its adoption: "RESOLUTION AUTHORIZING CONDEMNATION" (Tract AA Molen) WHEREAS, it is necessary, advisable and in the public interest that the Village of Golden Valley acquire (an) easement(s) over certain lands for street, road and utility purposes, and for access to said land for said purposes, and WHEREAS, in order to accomplish such purpose it is necessary to acquire (an) easement(s) over the following -described land, namely: Tract AA, Registered Land Survey No. 30, WHEREAS, it has become and is necessary to procure said easement(s) and title thereto by right of eminent domain, and WHEREAS, the Village is advised and believes that the most feasible location for such street, road and utility easement(s) is on the land above-described, NOW THEREFORE, BE IT RESOLVED, that (an) easement(s) of the necessary width be obtained, BE IT RESOLVED, that the Village of Golden Valley proceed to procure said easement(s) and title thereto, under its right of eminent domain, and that the Village Attorney be instructed and directed to file the necessary petitions therefor, and to prosecute such action to a successful conclusion, or until it is abandoned, dismissed, or terminated by the Village or. by, -the Court; and that the Village Attorney, the Mayor and the Clerk, do all things necessary to be done in the commencement, prosecution and successful termination of such action. Adopted by the Village Council this 20th day of October, 1959. Attest: 2, xl ge Clerk' The motion for the adoption of the foregoing resolution was duly seconded by Member Scherer and, upon vote being taken thereon, the following voted in favor thereof: Bies, Flannagan, Nadasdy, Scherer, and Teresi; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the Clerk. avY I�
