#090 01-05-60 Order Condemnation Olson Highway Service RoadResolution No, 90 January 5, 1960 Member Teresi introduced and read the following resolution and moved its adoption: RESOLUTION ORDERING CONDEMNATION (Olson Highway Service Road) WHEREAS, It is necessary, advisable, and in the public interest that the Village of Golden Valley acquire (an) easement (s) over, across and in certain lands for street and road purposes, and WHEREAS, In order to accomplish this it is necessary to acquire (an) easement (s) over, across and in the following -described lands, namely: Parcel 1 The North 30 feet of the West 125 feet of the East 700 feet of the following -described tract of land: That part of the North 709.5 feet of the North- east Quarter (1) of the Southwest Quarter (4) lying East of a line described as follows: Begin- ing at a point on the North line of the Southwest Quarter (j), distant 1639 feet East of the North- west corner of the Southwest Quarter (4); thence, South at right angles to said North line 291 feet; thence deflecting to the left 7050' and running southeasterly to its intersection with a line running parallel to and 709.5 feet South of the North line of the Southwest Quarter (4); except that part thereof lying South of the Northwesterly right-of-way line of the Minneapolis, Northfield and Southern Railway in Section 19, Township 29, Range 24, according to the Government Survey thereof. WHEREAS, It has become and is necessary to procure said easement (s) and title thereto by right of eminent domain, and WHEREAS, The Village of Golden Valley believes that the most feasible location for such street and parts thereof is on the lands described above, Now, therefore, BE IT RESOLVED that the Village of Golden Valley proceed to procure said easement (s) and title thereto, under its right of eminent domain, and that the Village Attorney be instructed and directed to file the necessary petitions therefor, and to prosecute such action to a successful conclusion or until it is abandoned, dismissed or terminated by the Village or by the Court; and that the Village Attorney, the Mayor, and the Clerk, do all things necessary to be done in the commencement, prosecution, and success- ful termination of such action.
