Member Flannagan introduced the following resolution and MOVED its adoption:
RESOLUTION ORDERING CONDEMNATION
(Sollner - Malenke)
WHEREAS it is necessary, advisable and in the public interest that the
Village of Golden Valley acquire a certain tract and parcel of land for a
public park and for drainage purposes, said tract and parcel of land being
described as follows:
Parcel 1 (Sollner)
The North Half (z) of the East Quarter (4) of the
Southwest Quarter (4) of the Southeast Quarter (1)
of Section 30, Township 118, Range 21, Hennepin
County, Minnesota.

Karl Sollner and Herta Sollner, his wife, Fee
WHEREAS it is necessary, advisable and in the public interest that the
Village of Golden Valley acquire (an) easement(s) over, across and in
certain lands for all public utilities and storm and surface water drainage
purposes and for a public street and highway, and
WHEREAS in order to accomplish this it is necessary to acquire (an)
easement(s) over, across and in the following -described lands, namely:
Parcel 2 (Malenke)
The North 20 Feet, the West 20 Feet and the South
13.5 Feet of that part of the South 299.85 Feet of
the Southwest Quarter (4) of the Southwest Quarter
(4) of the Southeast Quarter (4) of the Northeast
Quarter (n) of Section 30, Township 118, Range 21,
lying West of the East 170.23 Feet thereof, Hennepin
County, Minnesota.

WHEREAS it has become and is necessary to procure said tract and
parcel of land and said easement(s) and title thereto by right of eminent
domain, and
WHEREAS, the Village of Golden Valley believes that the most feasible
location for such park and street and parts thereof and for such easement(s)
for all public utilities and drainage purposes are on the lands described
above, Now, Therefore,
BE IT RESOLVED that the Village of Golden Valley proceed to procure
said tract and parcel and easement(s) and title thereto, under its right of
eminent domain, and that the Village Attorney be instructed and directed to
file the necessary petition(s) therefor, and to prosecute such action to a
successful conclusion or until it is abandoned, dismissed or terminated by
the Village or by the Court; and that the Village Attorney, the Mayor, and
the Clerk (Village Manager), do all things necessary to be done in the
commencement, prosecution, and successful termination of such action.
Adopted by the Village Council this 5th day of April, 1960.

The motion for the adoption of the foregoing resolution was duly seconded by
Member Scherer and, upon vote being taken thereon, the following voted in
favor thereof: Bies, Flannagan, Nadasdy, Scherer and Teresi; and the
following voted against the same: None,
whereupon said resolution was declared duly passed and adopted, signed by
the Mayor, and his signature attested by the Village Manager (Clerk).
