#116 05-03-60 Authorize Condemnation, DischingerResolution No. 116 May 3, 1960 Member Bies introduced the following resolution and MOVED its adoption: RESOLUTION AUTHORIZING CONDEMNATION (Dischinger) WHEREAS, It is necessary, advisable, and in the public interest that the Village of Golden Valley acquire a certain tract and parcel of land for park and recreation purposes, as well as a permanent easement for drainage and utility purposes in, on, over and across a certain -described tract of land and temporary slope easements adjacent to Plymouth Avenue in and on a certain tract of land, said slope easement to expire on January 1, 1961; and WHEREAS, In order to accomplish these purposes it is necessary to acquire said tract of land and said permanent and temporary easements which tract and easements are described as follows: Parcel 1 The South Half (2) of the Fast Quarter (4) of the Southwest Quarter (4) of the Southeast Quarter (4) of Section 30, Township 118, Range 21, Hennepin County, Minnesota, except the South 173.02 feet thereof. Name of parties interested in said land and nature of interest: Name Interest Otto F. Dischinger and Ruth Dischinger, as joint tenants Fee The Equitable Life Assurance Society of the United States (New York Corporation) Mortgagee Parcel 2 The Easterly 20 feet of the North 140 feet of the South 173.02 feet of the South Half (2) of the East Quarter (4) of the Southwest Quarter (4) of the Southeast Quarter (4) of Section 30, Township 118, Range 21, Hennepin County, Minnesota. Name of parties interested in said land and nature of interest: Name Interest Otto F. Dischinger and Ruth Dischinger, as joint tenants Fee The Equitable Life Assurance Society of the United States (New York Corporation) Mortgagee w�a Resolution No. 116 (Continued) Parcel 3 A temporary slope easement to expire January 1, 1960, adjacent to Plymouth Avenue, and in and on the following -described tract of land: The South 8 feet of the North 140 feet of the South 173.02 feet of the South Half (2) of the East Quarter (4) of the Southwest Quarter (a) of the Southeast Quarter (4) of Section 30, Township 118, Range 21, Hennepin County, Minnesota. Name of parties interested in said land and nature of interest: Name Interest Otto F. Dischinger and Ruth Dischinger, as joint tenants Fee The Equitable Life Assurance Society of the United States (New York Corporation) Mortgagee WHEREAS, It has become and is necessary to procure said tract and easements and title thereto by right of eminent domain, and WHEREAS, The Village of Golden Valley believes that the most feasible location for such park and recreational area and for such easements is in and on the lands described above, Now, Therefore, BE IT RESOLVED That the Village of Golden Valley proceed to procure said tract and said easements and title thereto, under its right of eminent domain, and that the Village Attorney be instructed and directed to file the necessary petitions therefor, and to prosecute such action to a successful conclusion or until it is abandoned, dismissed or terminated by the Village or by the Court; and that the Village Attorney, the Mayor, and the Village Manager (Clerk), do all things necessary to be done in the commencement, prosecution, and successful termination of such action. Adopted by the Village Council this 3rd day of May, 1960. Mayor Attest: U age Manag r (Clerk) The motion for the adoption of the foregoing resolution was duly seconded by Member Scherer, and, upon vote being taken thereon, the following voted in favor thereof: Bies, Flannagan, Nadasdy, Scherer, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor, and his signature attested by the Village Manager (Clerk).
