Resolution No. 161 October 4, 1960
Member Flannagan introduced the following resolution and MOVED its adoption:
RESOLUTION ESTABLISHING A MUNICIPAL COURT
for the VILLAGE OF GOLDEN VALLEY
BE IT RESOLVED by the Village Council of the Village of Golden
Valley as follows:
1. A Court of record to be known as "The Municipal Court of the
Village of Golden Valley" is hereby established in and for the Village of
Golden Valley, County of Hennepin, State of Minnesota. At the next annual
Village election to be held in said Village there shall be elected one Judge
to hold office for a period of six years and until his successor is elected
and qualified, who shall be an attorney admitted to the practice of law in the
State of Minnesota, and a resident of the Village of Golden Valley. Said Judge
and his successors shall take office on the first Monday of the month next
following their election.
2. The jurisdiction of said Court, the practice and procedure there-
in, the tenure and compensation of the Judge and other officers thereof and
the taking of appeals therefrom shall in all things be governed under and
pursuant to the provisions of Chapter 488, Minnesota Statutes Annotated, as.
amended, and not otherwise.
3. The Clerk of said Court shall be appointed by the Municipal
Judge and shall receive such compensation as the Village Council shall
designate and shall receive all fines, deposits, penalties and other money
paid into the Court and keep a detailed account thereof. He shall dispose of
such moneys in accordance with the provisions of Chapter 488, Minnesota
Statutes Annotated and not otherwise.
4. The Judge of said Court shall appoint one or more police officers
of the Village of Golden Valley to act as and perform the duties of Court
Officers without extra salary.
5. The Village Council of the Village of Golden Valley shall provide
suitable space for said Municipal Court and shall provide the Judge with a
seal and all necessary books and forms for proceedings in said Municipal Court.
6. The Court may make and alter rules for the conduct of its
business and prescribe therein forms of process and procedure conformable to
the law. The Court shall prescribe the times when it will be open, except on
Sundays and Holidays, for the hearing and disposition of all matters of which
the Court has jurisdiction.
7. Jurors in the Municipal Court shall be compensated in the manner
provided by law.
8. The office of Justice of the Peace is hereby abolished,
effective on the date of expiration of the terms of office of the present
Justices.

9. This resolution is adopted in conformity with Chapter 488,
Minnesota Statutes Annotated, and enactments amendatory thereof and supple-
mentary thereto, to take effect and be in force from and after its adoption
in accordance with its terms.

The motion for the adoption of the foregoing resolution was duly seconded by
Member Teresi and, upon vote being taken thereon, the following voted in favor
thereof: Bies, Flannagan, Nadasdy, Scherer, and Teresi; and the following
voted against the same: None,
whereupon said resolution was declared duly passed and adopted, signed by the
Mayor and his signature attested by the Village Manager (Clerk).
