#162 10-04-60 Provide Election of Constructing Waterworks Utility312 Resolution No. 162 October 4, 1960 Member Teresi introduced the following resolution and MOVED its adoption: RESOLUTION PROVIDING FOR THE SUBMISSION AT THE NEXT ANNUAL VILLAGE ELECTION OF THE QUESTION OF CONSTRUCTING A WATERWORKS UTILITY BE IT RESOLVED by the Council of the Village of Golden Valley, Minnesota, as follows: 1. It is hereby found and determined that it is necessary and expedient for the Village to own and operate a waterworks system in the Village for supplying water utility service needed by the Village and by private consumers; that it is necessary, before such public utility is constructed, that the proposal to do so be submitted to the voters at an election and approved by a majority of those voting on the question; and that it is desirable that the question of constructing such utility be submitted at the next regular Village election. 2. The proposition of constructing such utility, as set forth in the form of ballot prescribed below, shall be submitted to the voters at the regular Village election which is to be held on Tuesday, the 6th day of December, 1960, between the hours of 7:00 o'clock A.M. and 8:00 o'clock P.M. Said election shall be held at the polling places within each of the election districts heretofore established. 3. The Village Clerk is hereby authorized and directed to cause notice of the submission of the question at said election to be posted at each polling place and at least three other public and conspicuous places within each election district, not less than ten days before the date of said election, and to cause such notice to be published twice in the Suburban Press, the first publication to be not less than two weeks and the second publication to be not less than one week before said date, which notice shall be in substantially the following form: NOTICE OF WATER UTILITY QUESTION TO BE VOTED UPON AT THE ANNUAL VILLAGE ELECTION VILLAGE OF GOLDEN VALLEY, MINNESOTA NOTICE IS HEREBY GIVEN that at the annual election to be held in and for the Village of Golden Valley, Minnesota, on Tuesday, the 6th day of December, 1960, between the hours of 7:00 o'clock A.M. and 8:00 o'clock P.M., the following proposition will be submitted to the voters of the Village; "Shall the Village of Golden Valley construct, own and operate a public waterworks utility, the estimated cost of establishing said utility being $2,756,500, exclusive of the cost of constructing lateral mains and extensions?" 1 Resolution No. 162 (Continued) Every registered and qualified voter of the Village is entitled to vote on said question at the polling place established for the election dis- trict in which he resides, as set forth in the notice of annual Village elec- tion. 4. The Village Clerk is hereby authorized and directed to cause official ballots to be prepared for said election, in sufficient supply to meet the requirements of absent and disabled voters entitled to vote at said election. He shall also cause a sample of said ballot to be published in the Suburban Press not less than one week prior to the date of election, and shall post a sample ballot in his office and at each polling place not less than four days prior to the date of election. The official ballots shall be printed on light green colored paper, and the face thereof shall read as follows: OFFICIAL WATER UTILITY BALLOT ANNUAL ELECTION VILLAGE OF GOLDEN VALLEY, MINNESOTA December 6, 1960 "Shall the Village of Golden operate a public waterworks of establishing said utility of the cost of constructing YES NO Valley construct, own and utility, the estimated cost being $2,756,500, exclusive lateral mains and extensions? INSTRUCTIONS TO VOTERS: If you wish to vote in favor of the above proposition, mark a cross (x) in the square opposite the word "YES" immediately following such proposi- tion. If you wish to vote against the above proposition, mark a cross (x) in the square opposite the word "NO" immediately following such proposition. On the back of each ballot there shall be printed the words "OFFICIAL BOND BALLOT", the date of election, the facsimile signature of the Village Clerk and lines for the initials of two judges. The sample ballots shall be inden- tical with the official ballots, except that the word 'SAMPLE" shall be used thereon in place of the word "OFFICIAL". 5. The ballot labels as to the water utility question to be inserted in the voting machines used at said election, and the same bond bal- lots to be posted at the several polling places, shall conform as closely as possible to the form of ballot above set forth. The Clerk shall provide the election officials at each polling place with a sufficient quantity of sample ballots for posting to enable them to comply with Minnesota Statutes, Section 206.09. The election officials shall canvass the results of the voting upon said question in the same manner and at the same time as they canvass the votes cast upon offices voted on at said election. The Village Council shall, when it meets as a canvassing board following said election, also declare the results appearing from the returns of the election officials as to the vote cast upon said question.
