Member Bies introduced and read the following resolution and MOVED its
adoption:
RESOLUTION AUTHORIZING CONDEMNATION
(C.S.A.H. No. 66: 13A, 30, 31, 32, 33, 34)
WHEREAS, it is necessary, advisable, and in the public interest that
the Village of Golden Valley acquire temporary construction and slope
easements for street and road purposes and temporary construction and
perpetual easements for drainage and utility purposes in, on, over and
across certain described tracts of land as hereinafter set forth; and
WHEREAS, in order to accomplish these purposes it is necessary to
acquire said temporary and perpetual easements over and across the
following -described lands for the purposes and to the extent set forth
in each case:
The following temporary construction easement is for street and
road purposes:
Parcel 13-A
A temporary easement 10 feet in width to construct slopes over and across
that part of the following -described tract of land lying Northeasterly and
adjacent to a line running parallel with and 40 feet Northeasterly of the
following -described line, said temporary slope easement to expire on
December 31, 1962:
All that part of Lot Nine (9), Auditor*s Subdivision Number 361, Hennepin
County, Minnesota, which lies within the distance of 40 feet Northeasterly
of the following -described line:
Beginning at a point of the West line of the Northwest Quarter (4) of
Section 18, Township 29 North, Range 24 West, Distant 84.10 feet North
of the Southwest corner of said Northwest Quarter (4); thence running
Fast parallel with the South line of said Northwest Quarter (4) 771.50
feet; thence deflect to the right on a 10 degree 22 minute 34 second
circular curve, delta angle 47 degrees 18 minutes 30 seconds, radius
552.18 feet and running Easterly and Southeasterly for a distance of
455.89 feet and there terminating.

A temporary construction easement over and across the East Thirty (30) feet
of Lot Nine(9), Auditor's Subdivision No. 361, said temporary construction
easement to expire on December 31, 1962.

A temporary construction easement over and across the West Thirty (30) feet
of the South 100 feet of the North 200 feet of Lot 8, Auditor's Subdivision

170 feet thereof, said temporary easement to expire on December 31, 1962.

WHEREAS, it has become and is necessary to procure said temporary and
perpetual easements and title thereto by right of eminent domain; and
WHAREAS, the Village of Golden Valley believes that the most -
favorable location for said temporary and perpetual easements is in, on,
over and across the lands described above, Now, Therefore,

BE IT RESOLVED that the Village of Golden Valley proceed to
procure said temporary and perpetual easements and title thereto under
its right of eminent domain, and that the Village Attorney be instructed
and directed to file the necessary petitions therefor, and to prosecute
such action to a successful conclusion or until it is abandoned, dis-
missed or terminated by the Village or by the Court; and that the
Village Attorney, the Mayor, and the Village Clerk do all things
necessary to be done in the commencement, prosecution, and successful
termination of such action.

The motion for the adoption of the foregoing resolution was duly seconded
by Member Flannagan and, upon vote being taken thereon, the following
voted in favor thereof: Bies, Flannagan, Nadasdy, Scherer, and Teresi;
and the following voted against the same: None,
whereupon said resolution was declared duly passed and adopted, signed
by the Mayor, and his signature attested by the Village Clerk.
