#123 04-03-62 Authorize Condemnation 62-WM 62-WMSE 32 Thru 10122 Resolution No. 123 April 3, 1962 Member Teresi introduced and read the following resolution and MOVED its adoption: RESOLUTION AUTHORIZING CONDEMNATION (62-WM and 62 WMSR: Nos. 32-E, 33-E, 34-E, 35-E, 36-E, 37-E, 38-E, 39-E, 57-E, 58-E, 59-E, 60-E, 91-E, 92-E, 93-E, and 101-E) WHEREAS, it is necessary, advisable, and in the public interest that the Village of Golden Valley acquire temporary construction easements for water main and water facility purposes and perpetual easements for water main and water facility purposes in, on, over and across certain -described tracts of land as hereinafter set forth; and WHEREAS, it is necessary, advisable and in the public interest that the Village of Golden Valley acquire perpetual easements for street, road and utility purposes in, on, over and across certain -described tracts of -land as hereinafter set forth; and WHEREAS, in order to accomplish these purposes it is necessary to acquire said temporary and perpetual easements over and across the following -described lands for the purposes and to the extents set forth in each case: Parcel 1 (62-WM-32 "Ell) A perpetual easement for water main and water facility purposes over and across Lot 7, Block 3, Kavlis Cedardale, Hennepin County, Minnesota, including adjacent 1/2 alley vacated except Beltline Highway, described as follows: The West 5 feet thereof, and also a temporary construction easement, such easement to expire on or before December 1, 1963 over the West 25 feet of Lot 7, Block 3 lying East of Beltline Highway right-of-way; Name of parties interested in said land and nature of interest: Name Intim Selby Enterprizes, a Minnesota corporation Fee Minneapolis Savings and Loan Association Mortgage Parcel 2 (62-WM-33 'B") A perpetual easement for water main and water facility purposes over and across the South 60 feet of Lot 4, Block 4, Kavlis Cedardale, Hennepin County, Minnesota, including adjacent 1/2 alley vacated except Highway, described as follows: The Easterly 7.5 feet as measured parallel with Beltline Highway right-of-way line and also a temporary construction zZC) Resolution No, 123 (Continued) easement, such temporary easement to expire on or before December 1, 1963, over and across the Easterly 30 feet as measured parallel with the Beltline Highway right-of-way line. Anderson, husband and wife, joint tenants Fee Twin City Federal Savings and Loan Association Mortgage WHEREAS, it has become and is necessary to procure said tempor- ary and perpetual easements and title thereto by right of eminent domain; and 2,33 Resolution No_._123 (Continued) WHEREAS, the Village of Golden Valley believes that the most— favorable location for said temporary and perpetual easements is in, on, over and across the lands described above, NOW, THEREFORE, BE IT RESOLVED that the Village of Golden valley proceed to procure said temporary and perpetual easements and title thereto under its right of eminent domain, and that the Village Attorney be instructed and directed to file the necessary petitions therefor and to prosecute such action to a successful conclusion or until it is abandoned, dismissed or terminated by the Village or by the Court; and that the Village Attorney, the Mayor, and the Village Clerk do all things necessary to be done in the commencement, prosecution, and successful termination of such action.
