#159 07-10-62 Approve ResolutionResolution No. 159 July 10, 1962 At a special meeting of the Village Council of the Village of Golden Valley duly held on the 10th day of July, 1962, the following Resolution was of- fered by Member Scherer; seconded by Member Teresi; to -wit: WHEREAS the Village of Golden Valley has approved the plans and spec- ifications for the improvement of that part of Trunk Highway Number 130 renumbered as Trunk Highway Number 100 within the corporate limits of the Village of Golden Valley from 1873 feet N. of Wayzata Blvd. to 1589 feet S. of 6th Ave. No.; and WHEREAS in order to obtain Federal Aid in the construction Of said Trunk Highway Number 130 renumbered as Trunk Highway Number 100 the Bureau of Public Roads requires the assurance that the Village of Golden Valley will not suffer any encroachment of any nature or kind whatsoever on the right of way of said Trunk Highway Number 130 renumbered as Trunk Highway Number 100 within the corporate limits of the said Village of Golden Valley; and WHEREAS the Commissioner of Highways desires in the interest of public safety that all parking of vehicles on said trunk highway be parallell with the curb and at least 20 feet from any crosswalk. NOW, THEN, BE 1T RESOLVED that said Village of Golden Valley does hereby agree and covenant that it will never permit or suffer, within its corporate limits, any encroachment of any kind whatsoever, including curb gas pumps and gas stations, billboards or other structures of any kind whatsoever, upon the right of way of Trunk Highway Number 130 renumbered as Trunk Highway Number 100 and to the above end said Village of Golden Valley hereby agrees that it will never issue any license, permit, or grant, or give any leave or liberty or any other consent of whatever form for the construction or maintenance of any encroachment whatsoever, including curb gas pumps and gas stations, billboards or other structures of any kind whatsoever, upon said right of way; and that said Village of Golden Valley will cooperate insofar as possible to eliminate existing encroach- ments constituting traffic hazards and will further take any necessary action to eliminate any encroachment that may hereafter exist on said trunk highway right of way; and BE IT FURTHER RESOLVED that said Village of Golden Valley does here- by agree to require the parking of all vehicles on said trunk highway to be parallel with the curb and at least twenty (20) feet from any cross- walks on all public streets intersecting said trunk highway within the corporate limits of said Village of Golden Valley. Upon the call of the roll the following Members voted in favor of the Reso- lution, Flannagan, Scherer and Teresi; the following Members voted against its adoption: None, whereupon the Mayor and presiding officer declared the Resolution adopted.
