Member Flannagan introduced and read the following written resolution and
MOVED its adoption:
RESOLUTION
(Outlot A, Village Terrace Addition)
WHEREAS,the Village Council of the Village of Golden Valley has hereto-
fore rezoned and established as a Multiple Dwelling Zoning District Outlot
A, Village Terrace Addition, according to the map and plat thereof on file
and of record in the office of the Registrar of Titles in and for Hennepin
County, Minnesota, and
WHEREAS, the Village Council has heretofore authorized the issuance of
a building permit for the construction of 79 living units in four apartment
buildings to be erected on said Outlot A, Village Terrace Addition in accord-
ance with plans and specifications which comply in all respects with the
building and zoning codes and platting regulations and other applicable ordi-
nances and rules of the Village of Golden Valley, and
WHEREAS, The present owner(s) of said Outlot A have imposed restrictive
convenants on said Outlot A, which convenants run with the land and provide,
among other things, that no more than said 79 units in four buildings shall
over be erected on said Outlot A, and
WHEREAS, the Village Council is advised that for purposes of financing
the construction of said apartment buildings it is necessary to place sepa-
rate mortgages on the easterly and westerly tracts of said Outlot A as the
same are described below, although title to all of said Outlot A will remain
in one ownership,
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of
Golden Valley that the division of said Outlot A into easterly and westerly
tracts is for mortgage purposes only, is hereby approved, any provisions of
the zoning and building codes or platting regulations, or other ordinances
and rules of the Village of Golden Valley notwithstanding, and
BE IT FURTHER RESOLVED, that the proper officers, agents, and employees
of the Village are authorized and instructed, upon request, to advise any
person making inquiry, including any title insuror, that the construction of
said 79 living units in said four buildings in accordance with said plans
and specifications is, and has been approved, and is, and will be in con-
formance with the zoning and building codes, platting regulations, and other
applicable ordinances and rules of the Village.
The descriptions of said easterly and westerly tracts are as follows:
Easterly Tract
That part of Outlot A, Village Terrace Addition, lying Northerly and
Easterly of the following described line, towit: Beginning at the Easterly
terminus of the Southerly line of said outlot which is 418 feet in length;

thence Westerly along said Southerly line and the same extended 542.5 feet;
thence at a right angle Northerly 74.7 feet; thence at a right angle Westerly
209.5 feet; thence at a right angle Northerly 100 feet; thence at a right
angle Westerly 6 feet; thence at a right angle Northerly to the Northerly
line of said outlot and there terminating. Subject to and together with an
easement for driveway, walkway, parking and utility purposes over the follow-
ing described property; Beginning at the Westerly terminus of the aforesaid
Southerly line of Outlot A which is 418 feet in length; thence Westerly a-
long an extension of said Southerly line 62 feet; thence at a right angle
Northerly 195 feet to the actual point of beginning of the easement to be
described;thence Southerly along last described course 156 feet; thence at a
right angle Westerly 286 feet; thence at a right angle Northerly 156 feet;
thence at a right angle Easterly 235 feet; thence Northeasterly deflecting
to the left 40 degrees to the Southerly line of Yosemite Circle; thence East-
erly along the Southerly line of Yosemite Circle 40 feet; thence Southwesterly
to the actual point of beginning.
Subject to an easement for utility purposed over a strip of land 20 feet
in width and 10 feet on each side of a line parallel with and 307 feet West
of the most Easterly line of said Outlot A, and extending from the Southerly
line to the Northerly line of said outlot.
Westerly Tract
That part of Outlot A, Village Terrace Addition, lying Westerly and
Southerly of the following described line, towit: Beginning at the Westerly
terminus of the Southerly line of said outlot which is 418 feet in length;
thence Westerly along an extension of said Southerly line 124.5 feet; thence
at a right angle Northerly 74.7 feet; thence at a rigth angle Westerly 209.5
feet; thence at a right angle Northerly 100 feet; thence at a right angle
Westerly 6 feet; thence at a right angle to the Northerly line of said outlot
and there terminating.
Subject to and together with an easement for driveway, walkway, parking
and utility purposes over the following described property: Beginning at
the Westerly terminus of the aforesaid Southerly line of Outlot A which is
418 feet in length; thence Westerly along an extension of said Southerly line
62 feet; thence at a right angle Northerly 195 feet to the actual point of
beginning of the easement to be described; thence Southerly along last des-
cribed course 156 feet; thence at a right angle Westerly 286 feet; thence at
a'.right angle Northerly 156 feet; thence at a right angle Easterly 235 feet;
thence Northeasterly deflecting to the left 40 degrees to the Southerly line
of Yosemite Circle; thence Easterly along the Southerly line of Yosemite
Circle 40 feet; thence Southwesterly to the a¢t al oint of beginnin .

The motion for the adoption of the foregoing resolution was duly seconded
by Member Scherer and, upon vote being taken thereon, the following voted
in favor thereof: Bies, Flannagan, Nadasdy, Scherer, and Teresi; and the
following voted against the same: None, whereupon said resolution was de-
clared duly passed and adopted, signed by the Mayor and his signature at-
tested by the Village Clerk.
