Mmber Flannagan introduced the following resolution and N1EVED its adoption:
RESOLUTION
(Acceptance of Plat- Hipp's
Graceful Plaza Addition)
IP.T REAS, the Village Council of the Village of Golden Valley, pursuant
to due notice, has on this date conducted a public hearing on the proposed
plat, to be known as Hipp's Graceful Plaza Addition,of the following -de-
scribed tract of land;
That part of Tracts D, E and F, Registered Land
Survey No. 331, files of Registrar of Titles, County
of Hennepin, lying South of County Road No. 66''4nd
West of State Trunk Highway No. 100; also that part
of Government Lot 3, Section 28, Township 118, Range
21, lying North of St. Croix Avenue and West and
South of Tract E in said Registered Land Survey No.
331; also the South 217.8 feet of the East 130 feet
of that part of said Government Lot 3 lying North of
St. Croix Avenue except, that part thereof lying
East of the Westerly line of State Trunk Highway No.
100.
WHEREAS, these are special circumstances or conditions affecting said
property so that the strict application of the provisions of the Platting
Regulations of the Village would deprive the applicant of the reasonable
use of his land, and
WHEREAS, Siad proposed plat contains a parcel of land not abutting
by its whole frontage on a public street, and
ZEAS, a variance is necessary for the preservation and enjoyment
of a substantial property right of the petitioner, and
WHEREAS, the granting of the variance will not be detrimental of the
public welfare or injurious to other property in the neighborhood in which
said property is situated, and
WHEREAS, all persons present were given the opportunity to be heard,
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village
of Golden Valley, that a variance may be and hereby is granted to permit
the acceptance of said plat, not withstanding its non-compliance with the
Platting Regulations as indicated, and
BE IT FURTHER RESOLVED by the Village Council of the Village of Golden
Valley, that said proposed plat be, and the same hereby is accepted and
approved, and the proper officers of the Village are hereby authorized and
instructed to sign the original and copy of said plat and to do all other

things necessary and proper in the premises.

The motion for the adoption of the foregoing resolution was seconded by
Member Teresi and, upon vote being taken thereon, the following voted in
favor thereof: Bies, Flannagan, Nadasdy, Scherer, and Teresi; and the
following voted against the same: None, whereupon said resolution was
declared duly passed and adopted, signed by`the Mayor and his signature
attested by the Village Clerk.
