#242 05-07-63 Approve Public Improvements 63-CP-3,6,7D u 1 Resolution No. 212 May 7, 1963 Member Teresi introduced and read the following written resolution and MOVED its adoption: RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS ON CERTAIN PROPOSED PUBLIC IMPROVEMENTS (Concrete Pavement with Integral Curb -63 -CP -3,6,7) WHEREAS, the Engineers for the Village have prepared plans and specifications for concrete pavement with integral curb improvements (63 -CP -3, 6, 7) and have presented such plans and specifications for the approval of the Council, Now, Therefore, BE IT RESOLVED by the Village Council of the Village of Golden Valley: 1. That such plans and specifications are hereby approved. 2. That the Village Clerk shall prepare and cause to be inserted in the Suburban Press and in the Construction Bulletin an advertisement for bids for making of such improvements under such approved plans and specifications. The advertisement shall be published once in the Sub- urban Press and in the Construction Bulletin, shall specify the work to be done, shall state that bids will be opened on June 14, 1963, in the Council Chambers, and that no bids will be considered unless sealed and filed with the Village Clerk and accompanied by a cash deposit, money order, cashier's check, bid bond or certified check payable to the Village Clerk for five percent (5%) of the amount of such bid. Such bids will be considered by the Village Council at its meeting of June 18, 1963, at 8:00 o'clock p.m. in the Council Chambers in the Civic Cen- ter. Mayor Attest:- Village Clergy The motion for the adoption of the foregoing resolution was duly second- ed by Member Scherer and, upon vote being taken thereon, the following voted in favor thereof: Flannagan, Nadasdy, Schaphorst, Scherer, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the mayor and his signature attested by the Village Clerk. 53 54 Resolution No. 243 May 7, 1963 Member Teresi introduced and read the following resolution and MOVED its adoption: RESOLUTION ORDERING CONDEMNATION (Western Avenue) WHEREAS, it is necessary, advisable, and in the public interest that the Village of Golden Valley acquire (an) easement(s) over, across and in certain lands for street, road, and utility purposes, and WHEREAS, in order to accomplish this it is necessary to acquire (an) easement(s) over, across and in the following -described lands, namely: All that part of Lot 61, Auditoes Subdivision No. 322 lying South of the following described line: Commencing at a point on the West line of the Southwest Quarter (SW4) of Section 32, Township 118, Range 21, distant 75 feet North of the Southwest corner thereof; thence East parallel with the South line of said Section 32, 157.641; thence on a curve to the right with a radius of 239.33' a distance of 89.081; thence tangential to the last described curve 36.244; thence on a curve to the left with a radius of 79.33' a distance of 29.531; thence continuing tangential to the last described curve to its intersection with the East line of that part of Lot 61, Auditor's Subdivision No. 322 lying Westerly of the East five acres thereof and there terminating. WHEREAS, it has become and is necessary to procure said easement(s) and title thereto by right of eminent domain, and WHEREAS, the Village of Golden Valley believes that the most feasi- ble location for such street and parts thereof is on the lands described above, Now, Therefore, BE IT RESOLVED that the Village of Golden Valley proceed to procure said easement(s) and title thereto, under its right of eminent domain, and that the Village Attorney be instructed and directed to file the necessary petitions therefor, and to prosecute such action to a successful conclusion or until it is abandoned, dismissed or terminated by the Village or by the Court; and that the Village Attorney, the Mayor, and the Village Clerk do all things necessary to be done in the eommencement, prosecution, and successful termination of such action. adopted by the Village Council this 7th day of May, 1963.
