#276 07-16-63 Waive Public Hearing Public Improvementt 10 Resolution No. 276 July 16, 1963 Member Flannagan then introduced the following resolution and NTOVED its adoption: RESOLUT ION WANING THE PUBLIC HEARING PURSUANT TO NiIlMSCTA STATUTES 429-031, SUBD. 3 AND ORDERING CONSTRUCTION OF A CERTAIN PROPOSED PUBLIC IMPROVEMENT (63-1°TTNlL-106) BE IT RESOLVED, by the Village Council of the Village of Golden Valley, Minnesota as follows: I. WF1ER.EAS, all the owners of real property affected by public improvement 63-UJML-106 and abutting upon any street named as the location of said improve- ment have petitioned the Council to construct the improvement and to assess the entire cost against their property, it is hereby found and determined that public hearing is not necessary pursuant to M-nnesota Statutes 429.031, Subd. 3. II. Being fully advised of the pertinent facts, this Council does hereby determine to proceed with the construction of the proposed public improve- ment for -said Village in accordance with the description of said improve- ment contained in the petition and waiver of right to public hearing. III. It is hereby found and determined that said public improvement is feas- ible (the Council reserves the right to consolidate said improvement with such other public improvements as it may seem advisable to do). IV. The cost of said improvement shall be paid out of special assessments to be levied as authorized by law. V. The Village Engineer is hereby designated as engineer for the construction of said proposed public improvement and is hereby authorized, ordered and in- structed to prepare final plans and specifications for said improvement and submit the same to the Village Council for approval at the earliest possible date. May or Attest:/: Village er 1 1 Resolution No. 276 July 16, 1963 The motion for the adoption of the foregoing resolution was duly seconded by Member Teresi and upon vote being taken thereon, the following members voted in favor thereof: Flannagan, Nadasdy, Schaphorst, Scherer, and Teresi; and the following voted against the same: None, whereupon the said resolution was by duly passed and adopted, signed by the Mayor and his signature attested y the Village Clerk. 1 111
