#299 08-20-63 Order Public Improvements Bituminous Surfacing149 Resolution No. 299 August 20, 1963 Member Flannagan then introduced the following resolution and MOVED its adoption: RESOLUTION ORDERING CONSTRUCTION OF CERTAIN PROPOSED PUBLIC IMPROVEMENTS (Bituminous Surfacing 63 -BS -26) BE IT RESOLVED by the Village Council of the Village of Golden Valley, Minnesota as follows: 1. That at a public hearing held on this day at 8:00 o'clock p.m. at the address of 7800 Golden Valley Road in the Village of Golden Valley, Minnesota, after notice of said hearing duly published as required by law this Council has consulted the view of all persons interested and, being advised of the pertinent facts, does hereby determine to proceed with the construction of certain proposed improvements for said Village, in accord- ance with the description of said improvements contained in said notice, as follows: NOTICE OF PUBLIC HEARING PROPOSED STREET IMPROVEMENTS BITUMINOUS SURFACING (63 -BS -26) NOTICE IS HEREBY GIVEN that the Village Council of the Village of Golden Valley, Hennepin County, Minnesota, will meet on August 20, 1963, on August 20, 1963, at 8:00 o1clock p.m. at the Civic Center, 7800 Golden Valley Road in said Village for the purpose of holding a public hearing on proposed street improvement. The proposed improvement and the cost as estimated by the Village Engineer is as follows.- 63-BS-26 ollows:63-BS-26 Bituminous Surfacing on Circle Down from Trunerts Cross- road to T.H. No. 100. $8,987.87 In conducting said public hearing for making its decision on the proposed improvement, the Village Council proposes to proceed under the authority granted by Chapter 398, Minnesota Laws for 1953, as amended. All property within the Village which is benefited by the improve- ment is proposed to be assessed for such improvement as set forth in the abaDve descriptions, including all property within the described area, and/or abutting on streets described above and also including all railroad property and/or railroad rights-of-way located in or abutting on the above described areas. 150 Resolution No. 299 August 20, 1963 All owners of such property in the area and abutting upon the streets described above, are hereby notified to be present at said public hearing and to make known their objections to this proposed street improvement if any there be. It is hereby found and determined that said public improvements are feasibile and can best be constructed as set forth in said report and not in connection with some other improvement (the Council reserves the right to consolidate said improvements with other public improvements if it seems advisable to do so.) 3. The cost of said improvements shall be paid out of special assessments to be levied as set forth in said notice of public hearing. 4. The Engineers for the Village are hereby designated as engineers for the construction of said proposed public improvements, and are hereby authorized, authorized, ordered and instructed to prepare final plans and specifications for said improvements and submit the same to the Village Council for approval at the earliest possible date. Mayor Attest: Village Clerk The motion for the adoption of the foregoing resolution was duly seconded by Member Schaphorst and, upon vote being taken thereon, the following members voted in favor thereof: Flannagan, Nadasdy, Schaphorst, Scherer, and Teresi; and the following voted against the same; None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor, and his signature attested by the Village Clerk.
