#311 09-03-63 Waive Public Hearing Authorizing Contract Changes1,82 Resolution No. 311 September 3, 1963 Member Flannagan introduced and read the following written resolution and MOVED its adoption: RESOLUTION WAIVING PUBLIC HEARING PURSUANT TO MINNESOTA STATUTES 429.031, SUBD. 3, ORDERING CONSTRUCTION, APPROVING PLANS AND SPECIFICATIONS AND AUTHORIZING CONTRACT CHANGES PURSUANT, TO MINNESOTA STATUTES 429.041 (63-cG-8, Orkla Drive) BE IT RESOLVED, by the Village Council of the Village of Golden Valley, Minnesota as follows: 1. Whereas, all the owners of real property affected by public improvement 63 -CG -8, Orkla Drive, and abutting on any street named as the location of said improvement have petitioned the Council to con- struct the improvement and to assess the entire cost against their property, it is hereby found and determined that the public hearing is not necessary pursuant to Minnesota Statutes 429.031, Subd. 3• 2. Being fully advised of the pertinent facts, this Council does hereby determine to proceed with the construction of the proposed public improvement for said Village in accordance with the description of said improvement contained in the petition and waiver of right to public hearing. 3. It is hereby found and determined that said public improvement is feasible (the Council reserves the right to consolidate said improve- ment with such public improvement as it may seem advisable to do so.) 4. The cost of said improvement shall be paid out of special assess- ments to be levied as authorized by law and the Village Engineer is here- by designated as engineer for the construction of said proposed public improvement and is hereby authorized, ordered, and instructed to prepare final plans and specifications �vr�sa dat t�earliest possible daand submit tee same to the Village Council for app 5. That the final plans and specifications for 63 -CG -8, Orkla Drive, are hereby approved. 6. That a certain contract was entered into August 6, 1963 with Hiawatha Cement Company for public improvements 63 -CG -1 through 10 and awarded on a unit price basis with a total contract price of $17,944.203 and whereas, the above improvement on the same unit price basis, includ- ing the cost of other improvements previously added thereto, does not exceed 25 per cent of the original contract price, the Mayor and the Village Clerk are hereby authorized to change the contract awarded for 63 -CG -1 through 10 of August 6, 1963 so as to include the additional Resolution No. 311 September 3, 1963 units of work at the same unit price providing for the construction of public improvement number 63 -CG -8, Orkla Drive, when the contractor shall have furnished a contractor's bond in the amount of the additional work conditioned as required by law. Attest: i Village Clerk P Mayor The motion for the adoption of the foregoing resolution was duly seconded by Member Schaphorst and upon vote being taken thereon, the following voted in favor thereof: Flannagan, Nadasdy, Schaphorst, Scherer, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the Village Clerk.
