Member Flannagan then introduced the following resolution and
MOVED its adoption:
RESOLUTION
ORDERING CONSTRUCTION OF A CERTAIN PROPOSED PUBLIC IMPROVEMENT
(64-WML-10)
BE IT RESOLVED by the Village Council of the Village of Golden
Valley Minnesota, as follows:
1. That at a public hearing held on this day at 8:00 o'clock p.m.
at the address of 7800 Golden Valley Road in the Village of Golden
Valley, Minnesota, after notice of said hearing duly published as
required by law, this Council has consulted the view of all persons
interested and, being fully advised of the pertinent facts, does here-
by determine to proceed with the construction of a certain proposed
improvement for said Village, in accordance with the description of
said improvement contained in said notice, as follows:
NOTICE OF PUBLIC HEARING ON CERTAIN
PROPOSED PUBLIC IMPROVEMENTS
Lateral Water Main Improvement 64 WML-10
NOTICE IS HEREBY GIVEN that the Village Council of the Village
of Golden Valley, Hennepin County, Minnesota, will meet on September
17, 1963 at 8:00 o'clock p.m. at the Civic Center, 7800 Golden Valley
Road in said Village for the purpose of holding a public haring on
certain proposed public improvements, consisting of the construction
and installation of Lateral Water Main Improvement and subsequent street
repair and replacement.
The Engineer estimates that the cost of the improvement will be
$5,911-74.
The area where said improvements will be constructed and which
it will serve are as follows:
All lots, tracts, or parcels of land abutting on the following
described street:
64 -WK -10 - On Hampshire Place, from Douglas Drive to
Florida Ave. No.
In conducting said public hearing for making its decision on the
proposed improvement, the Village Council proposes to proceed under
the authority granted by Chapter 398, Minnesota Laws of 1953, as amended.

All property within the Village which is benefited by the improve-
ments as set forth in the above description, including all property
within the described area and/or abutting on streets or lines described
above and including all railroad property and railroad rights-of-way and
public property located in or abutting on the above described street,
lines and areas.
All owners of such property in the areas and abutting upon the
street or lines described above, are hereby notified to be present
at said public hearing and to make known their objections to such
proposed public improvement, if any there be.

2. It is hereby found and determined that said public improve-
ment is feasible and can best be constructed as set forth in said re-
port and not in connection with some other improvement (the Council
reserves the right to consolidate said improvements with other public
improvements if it seems advisable to do so.)
3. The cost of said improvement shall be paid out of special
assessments to be levied as set forth in said notice of public hearing.
4. The Engineers for the Village are hereby designated as engineers
for the construction of said proposed public improvement, and are hereby
authorized, ordered and instructed to prepare final plans and specifi-
cations for said improvements and submit the same to the Village Council
for approval at the earliest possible date.

The motion for adoption of the foregoing resolution was duly
seconded by Member Schaphorst, and, upon vote being taken thereon,
the following members voted in favor thereof: Flannagan, Nadasdy,
Schaphorst, Scherer, and Teresi; and the following voted against
the same: None, whereupon said resolution was declared duly passed
and adopted, signed by the Mayor, and his signature attested by the
Village Clerk.
